Op woensdag 2 maart kiest u de Eilandsraadsleden van het openbaar lichaam waar u woont. Voor deze Eilandsraadsverkiezingen zijn enkele stemregels gewijzigd. Het is belangrijk dat u als stemgerechtigde op de hoogte bent van deze wijzigingen. Hieronder een beeld van de belangrijkste wijzigingen. Op deze manier weet u wat u te wachten staat op 2 maart. MAG IK STEMMEN? Op 10 januari 2011 heeft Gemeenschappelijk Hof van Justitie een uitspraak gedaan in de zaak Santana versus het bestuurscollege van Bonaire. Deze uitspraak leidt er toe dat niet alleen Nederlanders zullen kunnen stemmen bij verkiezingen voor de eilandsraden op 2 maart Kiesgerechtigd voor deze verkiezing zijn ingezetenen van het openbaar lichaam op de dag van de kandidaatstelling (18 januari 2011) die op de dag van de verkiezing (2 maart 2011) 18 jaar of ouder zijn en: over de Nederlandse nationaliteit beschikken; over de nationaliteit van een van de lidstaten van de Europese Unie beschikken; vreemdelingen zijn die onmiddellijk voorafgaand aan de dag van de kandidaatstelling gedurende een onafgebroken periode van ten minste vijf jaar rechtmatig in (Caribisch) Nederland verbleven op grond van artikel 3 of 6 van de Wet toelating en uitzetting BES danwel op grond van artikel 8 onder c van de Vreemdelingenwet 2000 in het Europese deel van Nederland. Voor allen geldt dat zij niet uitgesloten mogen zijn van het kiesrecht. Het openbaar lichaam leidt de kiesgerechtigheid af uit de bevolkingsadministratie. Bent u daarin opgenomen en voldoet u aan de bovengestelde criteria dan krijgt u automatisch een oproep (de stempas) voor de verkiezing toegezonden. U kunt zich tot Burgerzaken wenden om na te gaan of u als kiezer bent geregistreerd. Blijkt dat niet het geval te zijn en meent u toch aan de bovenstaande criteria te voldoen, dan kunt u een verzoek tot herziening van de registratie als kiesgerechtigde indienen, waarbij u bewijsmateriaal moet overleggen waaruit blijkt dat u aan de criteria voldoet. HOE STEM IK? Met uw stempas en identiteitsbewijs kunt u op uw eiland stemmen in een willekeurig stemlokaal. De stemlokalen zijn open op woensdag 2 maart 2011 van 7.30 tot uur. Let op: De verkiezing vindt plaats op woensdag en niet op vrijdag, zoals u gewend was. WAT IS EEN STEMPAS? De stempas is uw toegangsbewijs tot de verkiezing. Zonder stempas kunt u niet stemmen. De stempas is zowel een bewijs van uitnodiging als het exclusieve bewijs van uw kiesgerechtigdheid. Het bezit van deze pas vormt voor het stembureau het bewijs dat u uw stem nog niet bij een ander stembureau heeft uitgebracht. Met een stempas kunt u op uw eiland stemmen in een stemlokaal naar keuze, mits er meerdere stemlokalen in uw openbaar lichaam zijn. De stempas is voorzien van echtheidskenmerken en een uniek nummer. WAT MOET IK BIJ ME HEBBEN OM TE MOGEN STEMMEN? Om te kunnen stemmen, moet u uw stempas en een identiteitsbewijs meenemen. Zonder uw stempas en identiteitsbewijs mag u niet stemmen. Een identiteitsbewijs is een Nederlands paspoort, identiteitskaart (sédula) of een rijbewijs. Uw identiteitsbewijs mag maximaal vijf jaar verlopen zijn, oftewel geldig zijn tot 3 maart 2006 of later. Wanneer u voor de verkiezing ontdekt dat uw identiteitsbewijs meer dan vijf jaar is verlopen, kunt u een nieuw identiteitsbewijs aanvragen bij Burgerzaken. Wanneer u op 2 maart ontdekt dat uw identiteitsbewijs meer dan vijf jaar is verlopen, dan kunt u niet stemmen. Zonder identiteitsbewijs is stemmen niet mogelijk. Speciale uitgave Wijzigingen regels Eilandsraadsverkiezingen Woensdag 2 maart 2011 WAT MOET IK DOEN ALS IK GEEN STEMPAS (MEER) HEB? Wanneer u uw stempas kwijtraakt, u geen stempas heeft ontvangen, of als deze is stukgegaan, vraag dan zo snel mogelijk een nieuwe stempas aan op uw eiland. De uiterste datum waarop u een vervangende pas kunt aanvragen is woensdag 16 februari voor Saba en Sint-Eustatius en maandag 28 februari voor Bonaire. WAT MOET IK DOEN ALS IK NIET ZELF KAN GAAN STEMMEN? Als u op de dag van de verkiezing niet zelf kunt stemmen, kunt u iemand anders voor u laten stemmen (een volmacht verlenen). Dit kan op verschillende manieren: door middel van een schriftelijke volmacht door middel van een onderhandse volmacht Schriftelijke volmacht U kunt een schriftelijke volmacht verlenen aan iemand die op uw eiland woont, wanneer: u weet dat u op de verkiezingsdag niet in staat zal zijn om te stemmen u uw stempas nog niet heeft ontvangen u niet beschikt over een identiteitsbewijs of uw identiteitsbewijs meer dan vijf jaar is verlopen Wanneer u gebruik wilt maken van een schriftelijke volmacht, moet u hiervoor uiterlijk woensdag 16 februari 2011 een formulier bij Burgerzaken ophalen. Op het formulier moet zowel uw handtekening als de handtekening van degene die u machtigt worden geplaatst.

2 Het openbaar lichaam controleert uw identiteit aan de hand van de gegevens in de basisadministratie persoonsgegevens. Uw stempas wordt direct aan uw gemachtigde toegestuurd. Onderhandse volmacht U kunt een schriftelijke volmacht verlenen aan iemand die op uw eiland woont, wanneer: u weet dat u op de verkiezingsdag niet in staat zal zijn om te stemmen u uw stempas al heeft ontvangen u beschikt over een identiteitsbewijs Een onderhandse volmacht verleent u door het formulier aan de achterzijde van de stempas die u heeft ontvangen, in te vullen en uw handtekening te zetten. Hiermee bent u volmachtgever. De kiezer die voor u gaat stemmen, is de gemachtigde. De gemachtigde moet op hetzelfde eiland wonen als uzelf! Aan de gemachtigde geeft u uw stempas en (een kopie van) uw identiteitsbewijs. Dit is vereist, anders mag de gemachtigde uw (volmacht)stem niet uitbrengen! Belangrijk: voorkom misbruik van uw identiteitsbewijs door de kopie terug te vragen en/of op de kopie te schrijven dat deze alleen bestemd is voor gebruik bij het uitbrengen van uw volmachtstem degene die voor u een stem uitbrengt, kan dit alleen doen op het moment waarop hij of zij zelf stemt een gemachtigde mag maximaal twee stemmen uitbrengen voor anderen Waarschuwing: geef alleen een volmacht als u niet in staat bent zelf te gaan stemmen de Kieswet verbiedt het door gift of belofte omkopen van kiezers om een volmacht af te geven ook degene die zich laat omkopen is op grond van de Kieswet strafbaar OP WIE KAN IK STEMMEN? U stemt op één kandidaat op een lijst van een politieke partij. U vindt de namen van de kandidaten op de kandidatenlijsten van de politieke partijen. Het nummer één op de lijst is de lijsttrekker. Het stembiljet waarmee u op 2 maart 2011 uw stem uitbrengt, ziet er anders uit dan u gewend bent. Het is in zwart/wit en er staan geen foto s van de kandidaten op. Elke partij heeft een eigen nummer. Het stembiljet wordt zo dicht gevouwen dat de kandidatenlijst niet zichtbaar is. IN WELK STEMLOKAAL KAN IK STEMMEN? Model J20 Kandidaat 1 Kandidaat 2 Kandidaat 3 Kandidaat 4 Kandidaat 5 Kandidaat 6 Kandidaat 7 Kandidaat 8 Kandidaat 9 Om het u gemakkelijker te maken, kunt u op 2 maart 2011 in elk stemlokaal stemmen. Om te kunnen stemmen, moet u wel uw stempas en identiteitsbewijs meenemen. Om in een ander stemlokaal op uw eiland te stemmen, hoeft u dus niets te regelen. Een stemlokaal bij u in de buurt staat op uw stempas. WAT MOET IK DOEN IN HET STEM- HOKJE? houdt u uw stempas en ID-bewijs klaar zorgt u ervoor dat de stembureauleden het stemhokje kunnen zien houdt u voldoende afstand tot het stemhokje u stemt alleen. U gaat niet met meerdere personen in het stemhokje u stemt door het witte vakje voor de kandidaat van uw keuze rood te maken heeft u een fout gemaakt, Vraag dan een nieuw stembiljet. Dat kan één keer u vouwt het biljet na het invullen dicht, zodat de lijst niet zichtbaar is u werpt het stembiljet in de stembus KAN IK BLANCO STEMMEN? U mag blanco stemmen. Dat doet u door geen enkel vakje rood te maken. Het biljet blijft dan dus leeg. Als u toch iets op het biljet schrijft of tekent, stemt u niet blanco maar ongeldig. WANNEER WORDT MIJN STEM ALS ONGELDIG AANGEMERKT? Wanneer u het vakje voor de kandidaat van uw keuze met het potlood rood maakt, schrijf dan verder niet op het stembiljet. Een stem is ongeldig: wanneer uw stem is uitgebracht op een ander stembiljet dan u is uitgereikt in het stembureau wanneer u niet duidelijk maakt op wie u stemt (bijvoorbeeld doordat u meerdere vakjes heeft roodgemaakt, of alleen een pijltje bij de naam van de kandidaat van uw keuze heeft gezet) WAT KAN IK DOEN ALS IK MIJN STEM PER ONGELUK ONGELDIG HEB GEMAAKT? Mocht u uw biljet per ongeluk ongeldig hebben gemaakt, of u heeft zich vergist, dan kunt u eenmalig een nieuw stembiljet vragen aan één van de stembureauleden in het stemlokaal. WAT GEBEURT ER MET MIJN STEM? U stemt op 2 maart 2011 voor de leden van de Eilandsraad van uw eiland. Op Bonaire heeft de Eilandsraad negen zetels, op Sint-Eustatius en Saba vijf zetels. De Eilandsraad vormt de volksvertegenwoordiging op lokaal niveau op uw eiland en is het algemeen bestuur. De Eilandsraad controleert het bestuurscollege. Door te stemmen, bepaalt u samen met de andere kiezers welke partijen in de Eilandsraad zitting nemen. U oefent daarmee invloed uit op de besluitvorming van uw openbaar lichaam voor de komende vier jaren.

Ook degene die zich laat omkopen is op grond van de Kieswet strafbaar. E U S T A T I U S A N D S A B A YOU LL BE VOTING TOO, RIGHT? On Wednesday, March 2nd, 2011 you will elect the members of the Island Council of the public entity where you reside. For these Island Council elections some existing rules will be changed. It is important that you as a voter are aware of these changes. Below are the principal changes. This way you will know what awaits you on March 2nd. CAN I VOTE? On January 10th, 2011, the Common Court of Justice pronounced the verdict in the case of Santana versus the executive council of Bonaire. The result of this verdict is that not only the Dutch will be able to vote in the elections of the island council on March 2nd, The people with voting right for this election who on the date of the nomination (January 18th, 2011) are inhabitants of the public entity who on the date of the election (March 2nd, 2011) are 18 years of age or older and: have the Dutch nationality; have the nationality of one of the country members of the European Union; foreigners who immediately prior to the date of the nomination during an uninterrupted period of at least five years resided in the (Caribbean) Netherlands based on article 3 or 6 of the Law on admission or expulsion BES or based on article 8 of the Aliens act in the European part of the Netherlands. For all it is required that they are not excluded of their voting rights. The public entity derives the voting right from the administration of the civil registry. If you are registered in this register and you comply with all the aforementioned criteria, you will automatically receive convocation for the election (the voting pass). You may turn to civil registration office to find out whether you are registered as a voter. If this is not the case and in your opinion you do comply with aforementioned criteria, then you can request a revision of the registration as a voter, whereby you should hand over proof that shows that you do comply with the requirements. HOW DO I VOTE? You can vote with your voting pass and a proof of identification at any polling station on your island. The polling stations are open on Wednesday from 7.30 am to 9.00 pm. Beware: the elections will take place on a Wednesday rather than on a Friday as you were used to. WHAT IS A VOTING PASS? The voting pass is your proof of admission to the elections. You cannot vote without a voting pass. The voting pass functions both as a proof of invitation as well as an exclusive proof of your right to vote. Your possession of this pass will be a proof for the polling station that you have not cast your vote at any other voting station. You can use your voting pass to vote at any polling station of your choice, provided that there are more polling stations on your public entity. The voting pass is foreseen of authenticity features and a unique number. WHAT SHOULD I CARRY WITH ME IN ORDER TO BE ALLOWED TO VOTE? To be allowed to vote, you should bring with you your voting pass and your identification. You will not be allowed to vote without your voting pass or your identification. You can use a Dutch passport, an identification card or a driver s license as identification. Your identification card may be expired for a maximum of five years. Thus, it should have been valid till at least March 3rd In case you discover before the elections that your identification card is expired for more than five years, you can apply for a new identification card at the civil registration office. Voting is not possible without a proof of identification. WHAT SHOULD I DO IF I DO NOT HAVE A VOTING PASS (ANYMORE)? In case you lost your voting pass, you haven t received it or it is torn, you can place a request for a new voting pass as soon as possible on your island. The latest date to request a replacement for your voting pass is Wednesday February 16th 2011 for Saba and St. Eustatius and Monday February 28th 2011 for Bonaire. WHAT SHOULD I DO IF CANNOT GO TO THE VOTING STATION TO VOTE? If you cannot vote on the day of the elections, you can let someone else vote on your behalf (give proxy). You can do this: through a written proxy through a private proxy Written proxy You can give a written proxy to someone who lives on your island, when: you know you will not be able to vote on the election day; you have not received your voting pass; or you do not have an identification; or your identification has expired for more than 5 years. If you want to use the written proxy, you will have to collect a form at the civil registration office the latest Wednesday February 16th Both the signatures of you and the person you are authorizing to vote for you should be on the form.

10 The public entity will verify your identity based on the personal records database. Your voting pass will be sent directly to your representative. Private proxy You can give a private proxy to another voter on your island, when: you know you will not be able to vote on the election day; you have already received your voting pass; you dispose of identification. You can give a private proxy by completing the form on the back of the voting pass you received and by signing it. By doing this you become the warrantor. The voter that will be voting for you is the representative. The representative should be living on the same island as you do! You should give to the representative your voting pass and (a copy of ) proof of your identification. This is necessary; otherwise your representative will not be allowed to cast your proxy vote for you. Important: avoid misuse of your identification by requesting back the copy and/or by marking it as destined to use only for the proxy voting the person that is voting on your behalf, can do so only when he or she is casting a his/her vote a representative is allowed to vote for a maximum of two other persons Warning: only give the proxy when you are not able to vote yourself the Electoral Law prohibits the bribe of voters, through gifts and promises, to give the proxy also the person who accepts bribery is prosecutable by the Electoral Law WHO CAN I VOTE ON? You will vote on one candidate on a list of a political party. You will find the names of the candidates on the list of candidates of the political parties. The first person on the list is the party leader. The ballot sheet, on which you will cast your vote on March 2nd 2011, will be different from what you are accustomed to. It will be printed in black and white and there will be no pictures of the candidates. Each party will have its own number. In order to facilitate your voting, on March 2nd 2011, you can vote at a polling station of your choice. To vote you should take with you your voting pass and identification. You do not have to arrange anything to vote at another polling station. Your voting pass will give an indication of a polling station in your neighborhood. WHAT DO I HAVE TO DO AT THE POLLING STATION? keep your voting pass and identification at hand. make sure the members of the polling station can see the polling booth. keep distance of the polling booth. you should vote alone. You will not enter the polling booth with more people. you will vote by marking the white box in front of the candidate with red. if you made a mistake, request a new ballot sheet. you can do this only once. fold your ballot sheet after casting your vote. This makes your list invisible. deposit your ballot sheet in the ballot box. CAN I CAST A BLANK VOTE? You can choose to vote blank. You do this when you choose not to mark any white box with red. The ballot sheet will remain empty. Yet, if you choose to write or draw on the ballot sheet, your vote will be considered invalid instead of blank. WHEN WILL MY VOTE BE CONSI- DERED INVALID? When you mark the white box in front of the candidate of your choice with red, do not write anything else on the ballot sheet. A vote is invalid: when you vote on another ballot sheet than the one handed to you at the polling station. when you do not clearly indicate who you are voting for. (For instance because you marked more than one box with red, or you put only a pointer on the name of the candidate of your choice) WHAT CAN I DO IF I MISTAKENLY MADE MY VOTE INVALID? In case you made your ballot sheet invalid unintentionally or you made a mistake, you can request only once, a new ballot sheet from the members of the polling station. WHAT HAPPENS WITH MY VOTE? You are voting on March 2nd 2011 for the members of the Island Council of your island. On Bonaire the Island Council has nine seats, the Island Council in St. Eustatius and Saba has five seats. The Island Council is the representation of the people on local level on your island and functions as the general management. The Island Council controls the Executive Council. By voting, you together with other voters are determining which parties will take seat in the Island Council. With your vote you will influence the decision making of your public entity for the coming four years.
