1 Toelatingsnummer N HET COLLEGE VOOR DE TOELATING VAN GEWASBESCHERMINGSMIDDELEN EN BIOCIDEN 1 UITBREIDING TOELATING Gelet op de aanvraag d.d. 17 maart 2014 ( NLKUGB) van Stichting Trustee Bijzondere Toelatingen Hogeweg JD Den Haag tot uitbreiding van de gebruiksdoeleinden van de toelating van het gewasbeschermingsmiddel, op basis van de werkzame stof prosulfocarb Boxer gelet op artikel 51 (EG) nr 1107/2009 en artikel 2.2 Regeling gewasbescherming en biociden, BESLUIT HET COLLEGE als volgt: 1.1 Uitbreiding 1. Het gebruiksgebied van het middel Boxer wordt met ingang van datum dezes uitgebreid met de toepassing in de teelten van peulvruchten, lupine (voor levensmiddelen en diervoeding), vezelgewassen, wortelpeterselie, aromatische wortelgewassen en in de onbedekte teelten van pastinaak, aromatische kruidgewassen, medicinale kruidgewassen en zonnebloemen (snijbloemen). de gronden waarop dit besluit berust wordt verwezen naar bijlage II bij dit besluit. 2. De toelating geldt tot 1 september Samenstelling, vorm en verpakking De toelating geldt uitsluitend voor het middel in de samenstelling, vorm en de verpakking als waarvoor de toelating is verleend. 1.3 Gebruik Het middel mag slechts worden gebruikt met inachtneming van hetgeen in bijlage I bij dit besluit is voorgeschreven. 1.4 Classificatie en etikettering Boxer N 1

2 Gelet op artikel 80, vijfde lid Verordening (EG) 1107/2009 juncto artikel 29, eerste lid, sub d, Wet gewasbeschermingsmiddelen en biociden, 1. De aanduidingen, welke ingevolge artikelen en van de Wet milieubeheer en artikelen 14, 15a, 15b, 15c en 15e van de Nadere regels verpakking en aanduiding milieugevaarlijke stoffen en preparaten op de verpakking moeten worden vermeld, worden hierbij vastgesteld als volgt: aard van het preparaat: Emulgeerbaar concentraat werkzame stof: prosulfocarb gehalte: 800 g/l letterlijk en zonder enige aanvulling: andere zeer giftige, giftige, bijtende of schadelijke stof(fen): gevaarsymbool: Xi N aanduiding: Irriterend Milieugevaarlijk Waarschuwingszinnen: R38 Irriterend voor de huid. R43 Kan overgevoeligheid veroorzaken bij contact met de huid. R50/53 Zeer vergiftig voor in het water levende organismen; kan in het aquatisch milieu op lange termijn schadelijke effecten veroorzaken. Veiligheidsaanbevelingen: S36/37 Draag geschikte handschoenen en beschermende kleding. S46 In geval van inslikken onmiddellijk een arts raadplegen en verpakking of etiket tonen. S60 Deze stof en de verpakking als gevaarlijk afval afvoeren. S61 kom lozing in het milieu. Vraag om speciale instructies / veiligheidsgegevenskaart. SPo 2 Was alle beschermende kleding na gebruik. Specifieke vermeldingen: DPD01 Volg de gebruiksaanwijzing om gevaar voor mens en milieu te voorkomen. 2. Behalve de onder 1. bedoelde en de overige bij de Wet Milieugevaarlijke Stoffen en Nadere regels verpakking en aanduiding milieugevaarlijke stoffen en preparaten voorgeschreven aanduidingen en vermeldingen moeten op de verpakking voorkomen: Boxer N 2

3 a. letterlijk en zonder enige aanvulling: het wettelijk gebruiksvoorschrift De tekst van het wettelijk gebruiksvoorschrift is opgenomen in Bijlage I. b. bij het toelatingsnummer een cirkel met daarin de aanduiding W.9. De nieuwe etikettering dient bij de eerstvolgende aanmaak op de verpakking te worden aangebracht. Oude verpakkingen mogen worden opgemaakt. 2 DETAILS VAN DE AANVRAAG 2.1 Aanvraag Het betreft een aanvraag tot uitbreiding van het gebruiksgebied van het middel Boxer (10701 N), een middel op basis van de werkzame stof prosulfocarb. Het middel is bij besluit van 14 november 1990 reeds toegelaten als onkruidbestrijdingsmiddel in de teelten van pootaardappel, consumptieaardappel, zetmeelaardappel, wintergraan ( m.u.v. kanariezaad), wortelen, knolselderij ( onbedekt), uien, sjalotten, bosuien (onbedekt), bleekselderij (onbedekt), prei (onbedekt), en de kleine topeassingen in blauwmaanzaad en karwij. Het middel is bij dit besluit toegelaten tot 1 september Met onderliggende aanvraag wordt toelating als onkruidbestrijdingsmiddel voor de teelten van peulvruchten, lupine (voor levensmiddelen en diervoeding),, vezelgewassen, wortelpeterselie, aromatische wortelgewassen en de onbedekte teelten van pastinaak, aromatische kruidgewassen, medicinale kruidgewassen en zonnebloemen (snijbloemen) gevraagd. 2.2 Informatie met betrekking tot de stof De werkzame stof prosulfocarb is per 1 november 2008 geplaatst op Annex I van richtlijn 91/414/EEG (2007/76/EC d.d 20 december 2007.), welke is overgegaan in Uitvoeringsverordening (EU) No 540/2011 d.d. 25 mei 2011 behorende bij Verordening (EG) No 1107/2009, met expiratiedatum datum 31 oktober Geplaatst als stof nummer Karakterisering van het middel Boxer is een selectief bodemherbicide op basis van de werkzame stof prosulfocarb. Prosulfocarb behoort tot de chemische groep van de thiocarbamaten. Het wordt met name opgenomen door de wortels, maar ook door de bladeren. De werking berust op de verstoring van de lipidensynthese in de plant. 2.4 geschiedenis De aanvraag is op 20 maart 2014 ontvangen; op 13 maart 2014 zijn de verschuldigde aanvraagkosten ontvangen. Bij brief d.d. 29 juli 2014 is de aanvraag in behandeling genomen. 3 RISICOBEOORDELINGEN De beoordeling van deze aanvraag is conform RGB (hoofdstuk 2) en HTB Fysische en chemische eigenschappen De identiteit en de fysische en chemische eigenschappen van het middel en de werkzame stof wijzigen niet. 3.2 Analysemethoden De analysemethoden voor de werkzame stoffen en het middel wijzigen niet. de toegelaten toepassingen voldoen de vereiste residuanalysemethoden. 3.3 Risico voor de mens Van het middel wordt voor de toegelaten toepassingen volgens de voorschriften geen onaanvaardbaar risico voor de mens verwacht. 4 3.4 Risico voor het milieu Van het middel wordt voor de toegelaten toepassingen volgens de voorschriften geen onaanvaardbaar risico voor het milieu verwacht. 3.5 Werkzaamheid Het aspect werkzaamheid (inclusief fytotoxiciteit) is niet beoordeeld conform artikel 51 Verordening (EG) 1107/ Eindconclusie Bij gebruik volgens het Wettelijk Gebruiksvoorschrift heeft het middel Boxer op basis van de werkzame stof prosulfocarb geen schadelijke uitwerking op de gezondheid van de mens en het milieu. Degene wiens belang rechtstreeks bij dit besluit is betrokken kan gelet op artikel 4 van Bijlage 2 bij de Algemene wet bestuursrecht en artikel 7:1, eerste lid, van de Algemene wet bestuursrecht, binnen zes weken na de dag waarop dit besluit bekend is gemaakt een bezwaarschrift indienen bij: het College voor de toelating van gewasbeschermingsmiddelen en biociden (Ctgb), Postbus 217, 6700 AE WAGENINGEN. Het Ctgb heeft niet de mogelijkheid van het elektronisch indienen van een bezwaarschrift opengesteld. Deze derdenuitbreiding is aangevraagd door de Stichting Trustee Bijzondere Toelatingen. Er is voor deze uitbreiding geen werkzaamheids en fytotoxiciteitonderzoek uitgevoerd. Er wordt daarom aangeraden een proefbespuiting uit te voeren, voordat het middel gebruikt wordt. Gebruik van dit middel in dit/deze toepassingsgebied(en), komt voor risico en verantwoordelijkheid van de gebruiker. Het gebruik in de teelt van peulvruchten, lupine voor levensmiddelen en diervoeding, vezelgewassen, wortelpeterselie, pastinaak, aromatische kruidgewassen, medicinale kruidgewassen, aromatische wortelgewassen en bloemisterijgewassen is op basis van een derdenuitbreiding en beoordeeld conform artikel 51 EG 1107/2009. Deze derdenuitbreiding is aangevraagd door de Stichting Trustee Bijzondere Toelatingen. Er is voor deze uitbreiding geen werkzaamheids en fytotoxiciteitonderzoek uitgevoerd. Er wordt daarom aangeraden een proefbespuiting uit te voeren, voordat het middel gebruikt wordt. Gebruik van dit middel in dit/deze toepassingsgebied(en), komt voor risico en verantwoordelijkheid van de gebruiker. In winterrogge, triticale, wortelen, knolselderij, uien, sjalotten, bosuien, bleekselderij en prei kan enige fytotoxiciteit of groeivertraging optreden. In winterrogge kan dit leiden tot opbrengstderving. Als op een aangrenzend perceel bloeiende tulpen staan, kunnen bij contact met de werkzame stof de bloemstengels knikken (kiepers). Dit heeft geen invloed op opbrengst en nateelt.. Page 7

Methods of analysis 3.1 Analytical methods in technical material and plant protection product The analytical methods for the technical material and the plant protection product do not change. 3.2 Residue analytical methods The proposed extension for use involves application on crops that can be extrapolated from the current authorisation based on their crop group (matrix) and their MRL. Therefore, the proposed extension remains within the existing risk envelope for the section residue analytical methods for food/feed of plant and animal origin. The residue analytical methods for air, soil and water were accepted during the assessment which led to the original authorization of Boxer. This simplified extension does not give rise to reassess these residue analytical methods. 3.3 Conclusion The proposed extension for use is covered by the risk envelope of the existing authorisation for the section residue analytical methods. 3.4 Physicalchemical classification and labelling Proposal for the classification and labelling of the formulation concerning physical chemical properties Classification and labelling of the formulation do not change. 4. Mammalian toxicology The proposed extension for use involves an application on crops (pulses, lupin, fiber crops, parsley root, parsnips, aromatic herbs, medicinal herbs, aromatic root crops and sunflower) for which the risk assessment can be extrapolated from the current authorisation based on the method of application and dosage (mechanical and manual downward application of 5 L product/ha with a minimum spray volume of 200 L/ha). Therefore, the proposed extension remains within the existing risk envelope for the section mammalian toxicology (operator, bystander and worker). 4.8 Mammalian toxicology classification and labelling Proposal for the classification and labelling of the formulation concerning health Classification and labelling of the formulation do not change. No prosulfocarb and its metabolites were detected in mature plants or part of plants Metabolism in livestock The potential exposure of livestock to residues of prosulfocarb through consumption of treated commodities is very low. 13 A residue definition for animal products is not necessary Stability of residues The stability during storage at 18 C is reported for wheat (dry matrix, 25 months), potatoes (high water content, 18 months) and pea and dry beans (dry matrix, 18 months). The storage stability studies are sufficient to cover the application of prosulfocarb in requested crops Supervised residue trials Pulses (cgapnl: 1x 4 kg as/ha, BBCH 0009, PHI ) Lupin (cgapnl: 1x 4 kg as/ha, BBCH 0009, PHI ) There is a number of trials available with prosulfocarb in dry peas and dry beans. The trials were performed according to the cgapnl. The trials were evaluated by EFSA during the Article12 review of existing MRLs for prosulfocarb. In all the available trials the residue levels were below the LOQ of 0.01 mg/kg. The residue data of prosulfocarb in dry peas and dry beans can be extrapolated to the whole group of pulses, including lupin (Guidance document SANCO 7525/VI/95 rev.9). There is a sufficient number of trials available. The current EUMRL for prosulfocarb in pulses is 0.01* mg/kg and this is covered by the available data. According to the (Dutch) Definition list of areas of application for plant protection products (DTG list) (Definitielijst Toepassingsgebieden Gewasbeschermingsmiddelen), soya bean also belongs to the group of pulses. However, according to Annex I of Regulation (EC) No 396/2005, soya bean belongs to the oilseed group, where different extrapolations apply. Data from trials with sunflower seed can be extrapolated to soya bean. Ten trials in Northern Europe were conducted on sunflower at a comparable dose rate as the cgapnl for pulses (evaluated in the Article12 review), resulting in a noresidue situation in the seed. The current EUMRL for prosulfocarb in soya bean is 0.02 mg/kg and this is covered by the available trials in sunflower. Parsley root (cgapnl: 1 x 2.4 kg as/ha,bbch 0009, BBCH 1215, PHI) Parsnip (cgapnl: 1 x 2 kg as/ha, BBCH 1314, PHI) According to the Guidance document (SANCO 7525/VI/95 rev.9) data from trials with carrot can be extrapolated to parsley root and parsnip. There are trials available with medium/long cycle carrots. The trials were performed with a cgap comparable with the cgapnl for parsley root and parsnip. The studies were evaluated during the review of existing MRLs for prosulfocarb. The residues were in the range of: < mg/kg. The current EUMRL for prosulfocarb in parsley and in parsnip is 0.08 mg/kg and this is covered by the available trials in medium/long cycle carrots. Aromatic herbs (cgapnl: 1x 2.4 kg as/ha, BBCH 0009, PHI ) Extrapolation from parsley to fresh herbs is not acceptable for active substances used early in the growing season (Guidance document, SANCO 7525/VI/95 rev.9). However, in the EFSA Reasoned Opinion, such an extrapolation has been accepted: the extrapolation from parsley to the whole group of fresh herbs is possible when the active substance is used up to or close to harvest, which represents a worstcase situation. There are two trials with parsley available performed according to cgapnl. The trials were evaluated during the review of existing MRLs for prosulfocarb. In both trials the residues were <0.01 mg/kg. Herbs are minor crops, therefore, four trials are required, however, in the available trials there is a noresidue situation and two trials are considered acceptable. Page 13

14 According to the (Dutch) Definition list of areas of application for plant protection products (DTG list) (Definitielijst Toepassingsgebieden Gewasbeschermingsmiddelen), sorrel (veldzuring) belongs to the group of aromatic herbs. However, according to Annex I of Regulation (EC) No 396/2005, sorrel belongs to the group of spinach and similar (leaves), where different extrapolations apply. To authorise the use of prosulfocarb in sorrel, trials with sorrel itself, or lettuce or spinach for extrapolation are required. No trials with prosulfocarb in sorrel, lettuce and/or spinach are available, therefore, the use on sorrel cannot be authorised. However, as from January 1st 2015 a new Annex I to Regulation (EC) No 396/2005 is applicable, in which sorrel is classified as herbs like the other aromatic herbs, no exception is required and the whole group of aromatic herbs can be authorised. Medicinal herbs (cgapnl: 1x 2.4 kg as/ha, BBCH 0009, PHI ) Currently there are no MRLs required for the group of medicinal herbs, therefore, no residue trials are required, except for camomile. According to the (Dutch) Definition list of areas of application for plant protection products (DTG list) (Definitielijst Toepassingsgebieden Gewasbeschermingsmiddelen), camomile belongs to the group of medicinal herbs. However, according to Annex I of Regulation (EC) No 396/2005, camomile belongs to the herbal infusions group, where different extrapolations apply. Data from trials with caraway can be extrapolated to camomile. There are five trials available with prosulfocarb in caraway, with the application rate equivalent to the EU critical GAP (1x 3.2 kg as/ha, BBCH 0122). The trials were evaluated during the review of existing MRLs for prosulfocarb. The residues in the trials with caraway were in the range of < mg/kg. The current EUMRL for prosulfocarb in camomile is 2 mg/kg and this is covered by the available trials in caraway. Aromatic root crops (cgapnl: 1x 2.4 kg as/ha, BBCH 0009; BBCH 1215, PHI ) Extrapolation from carrot to aromatic root crops is currently not authorised for active substances used early in the growing season. However, the extrapolation from carrot to the whole group other root and vegetables except sugar beet (which contains most of the aromatic root crops) is possible when the active substance is used up to and close to harvest and this can be considered as a worstcase situation. Therefore the data available for the medium/long cycle carrots can be used to support the use of prosulfocarb in aromatic root crops. The studies were evaluated during the review of existing MRLs for prosulfocarb. The residues were in the range of: < mg/kg. The current EUMRL for prosulfocarb in some aromatic root crops is 0.08 mg/kg and this is covered by the available trials in medium/long cycle carrots. Fiber crops (cgapnl: 1x 2.4 kg as/ha, BBCH 0009, PHI ) Fiber crops are not used for human consumption. However, part of the crop can be used as feed for animals. Since no data on possible residues in (byproducts of) fiber crops are available and to prevent the possible exposure of animals to prosulfocarb residues via feed, a restriction should be included in the directions of use: Fiber crops (flax and linseed) may not be used as livestock feed Residues in succeeding crops During the peer review it was concluded that because of the low to moderate soil persistence of prosulfocarb and its breakdown products and considering the delay for planting rotational crops, the potential for residues in subsequent crops is considered minimal. Therefore rotational crops studies were not required Residues from livestock feeding studies The potential exposure of livestock to residues of prosulfocarb through consumption of treated commodities is very low. Therefore the livestock feeding studies are not required. Page 14

15 5.1.8 Processing factors Due to low residues in the raw commodities, studies on the effects of processing on the nature and magnitude of prosulfocarb are not required Calculation of the ADI and the ARfD Calculation of the ADI The ADI is based on the NOAEL of 0.5 mg/kg bw/d in the 2year oral rat study, supported by the multigeneration study in rat. Application of a safety factor for inter and intraspecies differences of 100 results in an ADI of mg/kg bw/day (see the List of Endpoints for mammalian toxicology). Calculation of the ARfD The ARfD is based on the NOAEL of 10 mg/kg bw/d in the acute developmental toxicity study in rat. Application of a safety factor for inter and intraspecies differences of 100 results in an ARfD of 0.1 mg/kg bw/day (see the List of Endpoints for mammalian toxicology). 5.2 Maximum Residue Levels Harmonised EUMRLs are present in Annex II of Regulation (EC) 396/2005. The product complies with the MRL Regulation. 5.3 Consumer risk assessment Risk assessment for chronic exposure through diet A calculation of the Theoretical Maximum Daily Intake (TMDI) was carried out using EFSA PRIMo rev. 2.0, containing all available Member State diets, and the harmonised EUMRLs. The maximum TMDI is 62.8% of the ADI for French toddler. The TMDI is 9.7% and 2.4% of the ADI for the Dutch general population and Dutch children ages 16, respectively. Risk assessment for acute exposure through diet A calculation of the Estimated Short Term Intake (ESTI) was carried out using EFSA PRIMo rev. 2.0 and the previously mentioned harmonised EUMRLs. The highest percentage of the ESTI is 2.9 % of the ARfD for parsnips for the UK infant. ESTI values for the other commodities in all other consumer diets are all lower. Conclusion Based on the assessment for residues, no risk for the consumer due to the exposure to prosulfocarb is currently expected. With respect to the use of the product on fiber crops the following restriction needs to be included in the directions of use: Fiber crops (flax and linseed) may not be used as livestock feed. 5.4 Data requirements No data requirements were identified. 6. Environmental fate and behaviour Conclusion for environmental aspects persistence in soil and leaching to groundwater, emission to surface water and sediment, drinking water criterion and monitoring data The new uses of Boxer applied for in pulses, lupin, fibre crops, parsley roots, parsnip, aromatic herbs, medicinal herbs, aromatic root crops and sunflower have an equal (or lower) risk for persistence in soil, leaching to groundwater, and emission to surface water and sediment compared to the already authorised uses. The drinking water criterion is met. The available and most recent monitoring data in groundwater and surface water have been reviewed and have no consequences for the proposed uses. Page 15

Ecotoxicology Conclusion with respect to comparability for ecotoxicological aspects The risk of the applied use in pulses, lupin, fibre crops, parsley roots, parsnip, aromatic herbs, medicinal herbs, aromatic root crops and sunflower is equal to or lower than the risk of the authorised uses with regard to the environment for the aspects birds and mammals, aquatic organisms, bees, nontarget arthropods, soil organisms, nontarget plants and activated sludge. 8. Efficacy The uses applied for are minor uses. According article 51 of Regulation no.1107/2009 no efficacy data is needed. 9. Conclusion The product complies with the Uniform Principles. 10. Classification and labelling Classification and labelling of the formulation does not change. Page 16
