Groningensingel EA ARNHEM een nationale aanvraag ontvangen tot uitbreiding toelating met kleine toepassingen van een gewasbeschermingsmiddel dat geherregistreerd is voor het middel op basis van de werkzame stof chloormequat. HET COLLEGE BESLUIT tot uitbreiding van bovenstaand middel. Alle bijlagen vormen een onlosmakelijk onderdeel van dit besluit. Voor nadere gegevens over deze toelating wordt verwezen naar de bijlagen: - Bijlage I voor details van de aanvraag en toelating. - Bijlage II voor de etikettering. - Bijlage III voor wettelijk gebruik. - Bijlage IV voor de onderbouwing. 1.1 Samenstelling, vorm en verpakking De toelating geldt uitsluitend voor het middel in de samenstelling, vorm en de verpakking als waarvoor de toelating is verleend. 1.2 Gebruik Het middel mag slechts worden gebruikt met inachtneming van hetgeen in bijlage III bij dit besluit is voorgeschreven. 1.3 Classificatie en etikettering Mede gelet op de onder wettelijke grondslag vermelde wetsartikelen, dienen alle volgende aanduidingen en vermeldingen op de verpakking te worden vermeld:, NLKUGH 1

2 7938 N - De aanduidingen, letterlijk en zonder enige aanvulling, zoals vermeld onder verpakkingsinformatie in bijlage I bij dit besluit. - Het toelatingsnummer met een cirkel met daarin de aanduiding van de W-codering zoals vermeld onder toelatingsinformatie in bijlage I bij dit besluit. - De etikettering zoals opgenomen in bijlage II bij dit besluit. - Het wettelijk gebruiksvoorschrift, letterlijk en zonder enige aanvulling, zoals opgenomen in bijlage III bij dit besluit. - Overige bij wettelijk voorschrift voorgeschreven aanduidingen en vermeldingen. 1.4 Aflever- en opgebruiktermijn (respijtperiode) Het nieuwe gebruiksvoorschrift en de nieuwe etikettering dienen bij de eerstvolgende aanmaak op de verpakking te worden aangebracht. Oude verpakkingen mogen worden opgemaakt. 2 WETTELIJKE GRONDSLAG Besluit artikel 51 Verordening (EG) Nr. 1107/2009 van het Europees Parlement en de Raad Classificatie en etikettering artikel 31 en artikel 65 van de Verordening (EG) 1107/2009 Gebruikt toetsingskader RGB (Hoofdstuk 2) en de Evaluation Manual BEOORDELINGEN 3.1 Fysische en chemische eigenschappen De identiteit en de fysische en chemische eigenschappen van het middel en de werkzame stof wijzigen niet. 3.2 Analysemethoden De analysemethoden voor de werkzame stoffen en het middel wijzigen niet. Voor de toegelaten toepassingen voldoen de vereiste residuanalysemethoden. 3.3 Risico voor de mens Van het middel wordt voor de toegelaten toepassingen volgens de voorschriften geen onaanvaardbaar risico voor de mens verwacht. 3.4 Risico voor het milieu Van het middel wordt voor de toegelaten toepassingen volgens de voorschriften geen onaanvaardbaar risico voor het milieu verwacht. 3.5 Werkzaamheid Gelet op artikel 51 Verordening (EG) 1107/2009 is de aanvraag niet beoordeeld voor het aspect werkzaamheid (inclusief fytotoxiciteit)., NLKUGH 2

3 7938 N Bezwaarmogelijkheid Degene wiens belang rechtstreeks bij dit besluit is betrokken kan gelet op artikel 4 van Bijlage 2 bij de Algemene wet bestuursrecht en artikel 7:1, eerste lid, van de Algemene wet bestuursrecht, binnen zes weken na de dag waarop dit besluit bekend is gemaakt een bezwaarschrift indienen bij: het College voor de toelating van gewasbeschermingsmiddelen en biociden (Ctgb), Postbus 8030, 6710 AA, EDE. Het Ctgb heeft niet de mogelijkheid van het elektronisch indienen van een bezwaarschrift opengesteld. Er is voor deze toepassing geen werkzaamheids- en fytotoxiciteitonderzoek uitgevoerd. Er wordt daarom aangeraden een proefbespuiting uit te voeren voordat het middel gebruikt wordt. Het risico voor het gewas bij gebruik van dit middel in dit toepassingsgebied valt onder verantwoordelijkheid van de gebruiker. Om zoogdieren te beschermen is toepassing in de onbedekte teelt van bloemisterijgewassen alleen toegestaan indien er geen andere vegetatie dan het geteelde gewas aanwezig is. Let op: dit middel kan schadelijk zijn voor natuurlijke vijanden. Raadpleeg uw leverancier van natuurlijke vijanden over het gebruik van dit middel in combinatie met het gebruik van natuurlijke vijanden. Bij mislukking van de teelt, kunnen de volgende teelten gedurende 8 weken na toepassing niet worden geplant of gezaaid: zonnebloem, klaver en sla (Lactuca spp.).

Therefore, the residue analytical methods for food/feed of plant and animal origin do not need to be (re-)evaluated. The new uses are within the risk-envelope of the existing authorization Mammalian Toxicology Acute toxicity It is referred to the original authorisation. The formulation containing 750 g/l chlormequat has a moderate toxicity in respect to acute oral and dermal toxicity, but low toxicity in respect to inhalation toxcity. It is not irritating to the rabbit skin and eye and is not a skin sensitiser in the guinea pig (Maximisation test) Operator exposure Operator exposure was assessed using the EU-AOEL of 0.04 mg/kg bw/day and as a tier 2 assessment using a NL-AOEL (0.31 mg/kg bw/day), both based on the 1-year study in dog, also covering chronic exposure. The dermal absorption values as determined in the EU-review were used (4% for concentrate and dilution). For the field uses, operator exposure was assessed for mechanical downwards and upwards spraying in the field and manual downwards and upwards spraying in the field. In addition, manual up- and downward spraying in the greenhouse was assessed. It can be concluded that there is no unacceptable risk for the unprotected operator when spraying downwards in the field using a tractor boom sprayer and when spraying in the greenhouse. For the other scenario s PPE is required for the operator to have an acceptable risk: Field sprayer in high crops using a tractor: gloves during mixing/loading and application Handheld spraying in the field in low crops: gloves during mixing/loading and application Handheld spraying in the field in high crops: gloves during mixing/loading, gloves and coverall during application Bystander exposure An exposure assessment was performed for professional bystanders (EUROPOEM II), for nonprofessional bystanders and residents (DE and UK methods) and for residents living near greenhouses (Lee side turbulence model).

17 Page 13 of 24 It is concluded that there is no undue risk to any bystander or resident after accidental exposure to Worker exposure Worker exposure to was evaluated using EUROPOEMII/NL model for activities in ornamental crops. It is concluded that there is no unacceptable risk anticipated for the worker wearing adequate work clothing (but no PPE) when re-entering crops treated with Residues and Consumer Exposure The extension is requested for non-consumable crops only (floricultural crops, pot plants, cut flowers, forced shrubs, cut green). Therefore, the assessment of metabolism and residue data is not relevant for this application. The consumer risk assessment is not required Environmental fate and behaviour The new uses of applied for in floricultural crops have an equal (or lower) risk for persistence in soil, leaching to groundwater and emission to surface water and sediment as the already authorised uses. The drinking water criterion is met. The available and most recent monitoring data in groundwater and surface water have been reviewed and have no consequences for the proposed uses Ecotoxicology Effects on Terrestrial Vertebrates (Part B, Section 6, Points 10.1 and 10.3) Effects on birds The risk assessment for birds is carried out following the latest guidance document by EFSA (Anonymous 2009: Guidance Document on Risk Assessment for Birds & Mammals on request from EFSA. EFSA Journal 2009; 7(12):1438. European Food Safety Authority), hereafter cited as EFSA/2009/1438. For the indoor uses, the risk is coverd by the exsisting risk envelope. For the field uses a risk assessment is required. Dietary risk assessment See for calculations the tables below. Small insectivorous bird (non soil bound) The TER value calculated from the screening step is above the trigger value of 5, indicating an acceptable risk to birds from Chlormequat chloride, following application of BAS 062 W at the proposed use rate. Food chain behaviour (secondary poisoning) and bioaccumulation The log Pow for chlormequat chloride is < 3, therefore an assessment of a potential risk of secondary poisoning according to EFSA/2009/1438 is not triggered, and due to the low lipophilicity no risk of bioaccumulation is assumed. In addition, the bioaccumulation potential of chlormequat chloride was considered as low in the EU review and therefore further evaluation on biomagnification is not necessary. It can therefore be concluded that the application of does not raise concerns regarding food chain behaviour (secondary poisoning) or biomagnification. Drinking water risk assessment Following EFSA/2009/1438, the puddle scenario is the one relevant for birds. Since the ratio of the effective application rate to the relevant toxicity endpoints is below the value of 50, conducting a quantitative risk assessment for the proposed use pattern of is not necessary. In conclusion the proposed use pattern of does not pose a risk to birds via uptake of contaminated drinking water. Overall conclusion It can be concluded that the application of pose an acceptable risk to birds. Effects on terrestrial vertebrates other than birds The risk assessment for mammals is carried out following the latest guidance document by EFSA (Anonymous 2009: Guidance Document on Risk Assessment for Birds & Mammals on request from EFSA. EFSA Journal 2009; 7(12):1438. European Food Safety Authority), hereafter cited as EFSA/2009/1438. Dietary risk assessment According to the risk envelope analyses, the risk to mammals is coverd by the original authorization, for the uses in floricultural crops, indoor uses. For the soil bound outdoor use, a risk assessment is performed. In order to avoid exposure to small herbivorus mammals, the applicant proposed the following restriction sentence: Om de zoogdieren te beschermen is toepassing in onbedekte teelt van bloemisterijgewassen uitsluitend toegestaan tot en met BBCH 39 (einde rozetvorming en/of einde lengtegroei). 19 mammal Page 15 of 24 The TER value from the Tier 1 assessment is above the trigger value of 10, indicating an acceptable acute risk to mammals from chlormequat chloride, following application of BAS W at the proposed use rate. For early applications, before BBCH 40, the risk to mammals is considered to be acceptable. However, the proposed restriction sentence of the applicant: Om de zoogdieren te beschermen is toepassing in onbedekte teelt van bloemisterijgewassen uitsluitend toegestaan tot en met BBCH 39 (einde rozetvorming en/of einde lengtegroei). is not clear. The described stages differ between the different crops within the ornamental group. Furthermore it is questionable if users will recognize the described stages within their crop. Finally, this cannot be maintained by law enforcers. Another option from a restriction sentence that can be used is as follows: Om zoogdieren te beschermen is toepassing in de onbedekte teelt van bloemisterijgewassen alleen toegestaan indien er geen andere vegetatie dan het geteelde gewas aanwezig is. This option is stated on the label. The bioaccumulation potential of chlormequat chloride was considered as low in the EU review and therefore further evaluation on biomagnification is not necessary.
