1 Toelatingsnummer HET COLLEGE VOOR DE TOELATING VAN GEWASBESCHERMINGSMIDDELEN EN BIOCIDEN 1 UITBREIDING TOELATING Gelet op de aanvraag d.d. 6 januari 2014 ( UB) van Flybusters De Grift EP NIEUWLEUSEN tot uitbreiding van de gebruiksdoeleinden van de toelating als bedoeld in artikel 49, eerste lid, Wet gewasbeschermingsmiddelen en biociden voor de biocide, op basis van de werkzame stoffen piperonylbutoxide en pyrethrinen gelet op artikel 44, eerste lid, Wet gewasbeschermingsmiddelen en biociden, BESLUIT HET COLLEGE als volgt: 1.1 Uitbreiding 1. Het gebruiksgebied van het middel wordt met ingang van datum dezes uitgebreid met de toepassing voor professioneel gebruik. Voor de gronden waarop dit besluit berust wordt verwezen naar bijlage II bij dit besluit. 2. De toelating geldt tot 1 januari Samenstelling, vorm en verpakking De toelating geldt uitsluitend voor het middel in de samenstelling, vorm en de verpakking als waarvoor de toelating is verleend. 1.3 Gebruik Het middel mag slechts worden gebruikt met inachtneming van hetgeen in bijlage I bij dit besluit is voorgeschreven. 1

2 1.4 Classificatie en etikettering Gelet op artikel 50 Wet gewasbeschermingsmiddelen en biociden worden voorschriften gegeven. Dit leidt tot de volgende voorschriften: De aanduidingen, welke moeten worden vermeld, worden hierbij vastgesteld als volgt: aard van het preparaat: Emulsie, olie in water werkzame stof: piperonylbutoxide pyrethrinen gehalte: 149 g/kg 15 g/l de identiteit van alle stoffen in het mengsel die bijdragen tot de indeling van het mengsel: - PICTOGRAM(MEN) pictogram: GHS09-milieu SIGNAALWOORD Waarschuwing Gevarenaanduidingen H410 Zeer giftig voor in het water levende organismen, met langdurige gevolgen. Voorzorgsmaatregelen P102 Buiten het bereik van kinderen houden. P262 Contact met de ogen, de huid of de kleding vermijden. P273 Voorkom lozing in het milieu. P305 + P351 + P338 BIJ CONTACT MET DE OGEN: voorzichtig afspoelen met water gedurende een aantal minuten; contactlenzen verwijderen, indien mogelijk. Blijven spoelen. P391 Gelekte/gemorste stof opruimen. P501 Inhoud/verpakking afvoeren naar inzamelpunt voor gevaarlijk of bijzonder afval. Behalve de voorgeschreven aanduidingen en vermeldingen moeten op de verpakking voorkomen: a. letterlijk en zonder enige aanvulling: het wettelijk gebruiksvoorschrift De tekst van het wettelijk gebruiksvoorschrift is opgenomen in Bijlage I, onder A. 2

3 b. hetzij letterlijk, hetzij naar zakelijke inhoud: de gebruiksaanwijzing De tekst van de gebruiksaanwijzing is opgenomen in Bijlage I, onder B. De tekst mag worden aangevuld met technische aanwijzingen voor een goede bestrijding mits deze niet met die tekst in strijd zijn. De nieuwe etikettering dient bij de eerstvolgende aanmaak op de verpakking te worden aangebracht. Oude verpakkingen mogen worden opgemaakt. 2 DETAILS VAN DE AANVRAAG 2.1 Aanvraag Het betreft een aanvraag tot uitbreiding van het gebruiksgebied van het middel (), een middel op basis van de werkzame stof(fen) piperonylbutoxide en pyrethrinen. Het middel is bij besluit van 10 januari 2014 reeds toegelaten als middel ter bestrijding van vliegen in verblijfplaatsen en bijbehorende ruimten van paarden die niet voor consumptie zijn bestemd, door middel van sproeien met een automatische spuitinstallatie.. Het middel is bij dit besluit toegelaten tot 1 januari 2024, en uitsluitend voor niet-professioneel gebruik. Met onderliggende aanvraag wordt toelating voor professioneel gebruik gevraagd. 2.2 Informatie met betrekking tot de stof De werkzame stoffen piperonylbutoxide en pyrethrinen zijn nog niet toegevoegd aan de Unielijst van goedgekeurde werkzame stoffen volgens EU verordening 528/ Karakterisering van het middel is een middel op basis van piperonylbutoxide en pyrethrinen. Pyrethrinen is de ISO-naam (ISO 765) voor een insecticide dat meestal uit zes verschillende pyrethrines bestaat. Pyrethrinen zijn neurotoxinen die op het zenuwstelsel van insecten inwerken. Piperonylbutoxide is een synergist voor een aantal insecticiden. In de insecten remt piperonylbutoxide de activiteit van het enzym cytochroom P450, en daarmee remt het de afbraak van het insecticide. Wanneer het samen met een insecticide gebruikt wordt kan het de doeltreffendheid ervan sterk verhogen. Het kan ook de periode verlengen waarin het middel werkt. 2.4 Voorgeschiedenis De aanvraag is op 7 januari 2014 ontvangen; op 7 februari 2014 zijn de verschuldigde aanvraagkosten ontvangen. Bij brief d.d. 25 februari 2014 is de aanvraag in behandeling genomen. 2.5 Eindconclusie Bij gebruik volgens het Wettelijk Gebruiksvoorschrift/Gebruiksaanwijzing is het middel op basis van de werkzame stof(fen) piperonylbutoxide en pyrethrinen voldoende werkzaam en heeft het geen schadelijke uitwerking op de gezondheid van de mens en het milieu. 3

4 Degene wiens belang rechtstreeks bij dit besluit is betrokken kan gelet op artikel 4 van Bijlage 2 bij de Algemene wet bestuursrecht en artikel 7:1, eerste lid, van de Algemene wet bestuursrecht, binnen zes weken na de dag waarop dit besluit bekend is gemaakt een bezwaarschrift indienen bij: het College voor de toelating van gewasbeschermingsmiddelen en biociden (Ctgb), Postbus 217, 6700 AE WAGENINGEN. Het Ctgb heeft niet de mogelijkheid van het elektronisch indienen van een bezwaarschrift opengesteld. WETTELIJK GEBRUIKSVOORSCHRIFT Toegestaan is uitsluitend het gebruik als middel ter bestrijding van vliegen in verblijfplaatsen en bijbehorende ruimten van paarden, die niet voor consumptie zijn bestemd, door middel van sproeien met een automatische spuitinstallatie. Om bodem- en in het water levende organismen te beschermen dienen resten (zoals vuil, afvalwater en strooisel) die het middel bevatten te worden afgevoerd naar de mestopslag. De gebruiksaanwijzing zoals opgenomen onder B. moet worden aangehouden. Het middel is bestemd voor professioneel en niet-professioneel gebruik B. GEBRUIKSAANWIJZING Algemeen is ontwikkeld voor de bestrijding van vliegen in verblijfplaatsen en bijbehorende ruimten van paarden, die niet voor consumptie zijn bestemd. Het middel is gevaarlijk voor waterorganismen. Middelresten mogen niet worden afgevoerd naar de riolering. Toepassing wordt toegepast met een hiervoor bestemde automatische spuitinstallatie. Vul het voorraadvat van de spuitinstallatie deels met water en voeg toe. Voeg vervolgens voorzichtig de resterende hoeveelheid water toe om schuimvorming te voorkomen. Dosering: 4% (4 L per 100 L water). Stel de regeling/timer van de spuitinstallatie zodanig in dat overdag iedere 2 uur gedurende periodes van ongeveer 30 seconden 25 ml spuitoplossing per nozzle verstoven wordt. Raadpleeg zo nodig de handleiding van de spuitinstallatie. Omvang spuitinstallatie: één nozzle is voldoende voor een oppervlak van 10 m 2 of ruimte van 30 m 3 De hoogte van de verstuivers van de spuitinstallatie is minimaal 4 meter. De behandeling moet worden uitgevoerd gedurende minimaal 14 uur per dag, d.w.z. 8 keer per dag sproeien. Resistentiemanagement In het kader van resistentiemanagement moet het middel worden afgewisseld met middelen die zijn gebaseerd op werkzame stoffen uit andere chemische groepen. 1

The applicant wishes to extend the field of use to professional use. H.1.6 Intended uses The proposed field of use of is the control of flies by automatic spraying in stables and annexes for horses that are not intended for consumption. Identity H.2. Efficacy 5.1 Function is an insecticide (PT18) based on the active substances piperonylbutoxide (15% w/w) and pyrethrins (1.5% w/w). Note that pyrethrins are a mixture of 6 individual compounds. 5.2 Field of use envisaged The proposed field of use of is the control of flies by automatic spraying in stables and annexes for horses that are not intended for consumption. This use is included in PT18 The product is intended for professional and non-professional use. This product is already authorised in the NL under registration number, with a restricted claim for non-professional use only. 2

8 5.3 Effects on target organisms and efficacy Efficacy data submitted and evaluation of data An extension of the authorisation is requested for the biocidal product. The applicant indicated that it is possible to make a comparative assessment with the reference product that is authorised () for the control of flies in animal housings by nonprofessionals. The requested extension concerns the application of for the control of flies in animal housings by professionals. No new efficacy data were provided. The use of this product by professionals does not have other efficacy demands for product authorisation as the use by non-professionals. Therefore the extension of the use of this product by professionals is acceptable Evaluation of the label (WG/GA) An adapted Dutch WG/GA was provided including the use by professionals. 5.4 Overall conclusions of efficacy Based on the data submitted and considering that the evaluation is done under article 121 of the WGB, it can be concluded that, when used in accordance with the proposed label (WG/GA) may be expected to be effective in controlling flies by automatic spraying in both professionally and non-professionally used stables and annexes for horses that are not intended for consumption. H.6. Human toxicology 6.1 Product application An application has been submitted for the extension of the authorisation of the biocidal product ECOBUSTER to professional use. The product is already authorised for non-professional use as insecticide in stables for horses (14332N). The formulation contains 1.5% pyrethrins and 15% piperonylbutoxide. 6.2 Toxicity of the formulated product The composition of the formulation remains unchanged, therefore the classification and labelling of the formulation do not change. 6.3 Risk characterisation for human health An application for the extension of authorization to professional use in the horse stables has been submitted by the applicant. In this risk assessment the expected exposure of professional users is compared to the exposure of non-professional users and workers under the current authorization 14332N. Based on the risk assessment for non-professional users and workers under the authorization 14332N, no adverse health effects are expected for the unprotected non-professional users and workers after dermal and respiratory exposure to pyrethrins and piperonylbutoxide as a result of automatic spraying with ECOBUSTER according to the WG/GA. Considering that the intended dose level, the application frequency and other directions for use (such as the spray volume, height of the nozzles) remain the same for professional users and workers, exposure to pyrethrins and piperonylbutoxide will be the same for the professional users and workers. Therefore this conclusion is also valid for the risk assessment for the professional users and workers. Based on the risk assessment for ECOBUSTER under authorization 14332N, no adverse health effects for the general public by indirect exposure to pyrethins and pyperonylbutoxide are expected as the horses from stables where ECOBUSTER is used are not allowed for consumption. Considering the intended dose level, application frequency and other directions 3

9 for use including the restriction that horses are not allowed for consumption remain unchanged, this conclusion can also be applied to the risk assessment for the current extension of authorization. 6.4 Overall conclusions for the aspect human health Based on the comparable risk assessment, it was concluded that no adverse health effects are expected for the unprotected professional users and workers after dermal and respiratory exposure to pyrethrins and piperonylbutoxide as a result of the use of ECOBUSTER to control flies in horse stables, when used in accordance to the WG/GA. Furthermore, when used according to the WG/GA, no adverse health effects are expected for the general public by indirect exposure to pyrethrins and piperonylbutoxide as a result of the application of ECOBUSTER to control flies in horse stables. H.7. Environment 7.1 Introduction An expansion of the authorisation is requested for the biocidal product containing the active substances pyrethrins (1.5%w/w) and piperonylbutoxide (15%w/w), hereafter referred to as PBO. The notifier indicated that it is possible to make a comparative assessment with the reference product that is authorised () for the control of flies in animal housings by non-professionals. The requested expansion concerns the application of for the control of flies in animal housings by professionals. The comparative assessment procedure prescribes that a simplified regime is accepted for the environmental aspect if the requested authorisation has a similar risk. It must be determined whether no additional risk for the environment is expected for the requested application in comparison with the already authorised application of the product. As part of the simplified procedure comparativeness of the referred and the requested application are tested for the following aspects: 1. The type and scale of the use; 2. Use concentrations; 3. Emission to air, STP, surface water and soil for the application phase, the in-service phase and the waste phase of the product; 4. Risk assessment (section 7.3); 5 Risk mitigating methods (section 7.4). 7.2 Evaluation is currently authorised () for the non-professional control of flies in animal housing.. An expansion of the authorised application is requested for the professional control of flies in animal housing. An overview of the use is listed in Table E.1. Table E.1. 10 The product is applied by spraying both automatically and manually. Manual spraying is only done occasionally when infestations occurs. Therefore, the risks were only assessed for the automatic spraying application, which was considered worst-case and therefore covers manual spraying as well. Although the product is intended to control flies in animal housings, the product is mainly used in stables for horses (applicant s information). However, risk assessment will be based on application in animal houses in general as it covers the intended use as described on the WG/GA. 1. The type and scale of the use Comparison of the scale of use is performed qualitatively only. Expansion of the nonprofessional use to professional use will increase the scale of use as a whole. The nonprofessional, however, has less animals compared to the professional. Subsequently the nonprofessional use will imply a relatively smaller area treated as compared to the professional use. The risk assessment performed for the non-professional use already covers the professional use of the product as it was based on numbers of animals kept by professional farmers because no exposure models for non-professional farmers are available (worst-case approach). Therefore it can be concluded that the type and scale of the use of the requested application in comparison with the authorised application is equal. 2. Use concentrations The use concentration of the active substances in the expanded application for the professional control of flies in animal housing is equal to the concentration of the active substances in the authorised application for the non-professional control of flies in animal housing. In the risk characterisation section is elaborated that this will not influence the outcome of the risk assessment. 3. Emission to air, STP, surface water and soil for the application phase, the in-service phase and the waste phase of the product Emission routes Various phases in the life cycle of a product may cause emissions and environmental exposure. In the risk assessment, emissions from the application phase, service life and waste phase of the product are considered. Emissions from a.i. production and product formulation are not part of the risk assessment. The foreseeable routes of entry into the environment during the application phase, service life and waste phase are listed in Table E.2. Therefore, exposure of soil and groundwater via STP surplus sludge application is not part of the risk assessment. Although the product is applied by spraying, the active substances eventually reach surfaces due to condensation. During cleaning of these surfaces the active substances are released to the sewer. Residues of the product will reach the sewage treatment plant (STP), resulting in an indirect expose of surface water and sediment. However, since the product is intended for the control of flies in animal housing, the active substances are discharged to the manure deposit 5

11 as well as the majority of the farms are not connected to the sewer. Therefore, the active substances enter the terrestrial environment when manure is subsequently applied as a fertilizer on grass and agricultural lands. The air compartment may be exposed as well as the product is automatically sprayed. No exposure to air and adjacent surface water is expected during fertilization as manure has to be directly injected in soils. Birds and mammals can be secondarily exposed through consumption of contaminated food resources. 7.3 Risk characterisation for the environment In the risk assessment of the authorised application for the non-professional control of flies in animal housings (), the risk has been assessed for aquatic and sediment organisms, micro-organisms in the STP, soil organisms, birds, mammals, bees and non-target arthropods which is based on a quantitative approach. It was concluded that the authorised product, when used in accordance with the proposed label (WG/GA), complies with the environmental standards and will not cause unacceptable effects on the environment provided that (residues of) the products are discharged to the slurry pit. In the table below an overview is presented of the risk assessment on basis of a comparison of the authorised application of for the non-professional control of flies in animal housing () and the potential risk of the requested extended application for the professional control of flies in animal housing. Dosage Yes Frequency Yes Air Emission Yes Direct emission to air is similar 7.4 Evaluation of precautionary and risk mitigation measures in the WGGA To prevent direct emission to STP, soil and water after indoor application the following risk mitigation measure is included in the proposed label (draft WG/GA): To protect water living organisms and soil organisms, residues containing the product (e.g. dirt, waste water and straw) need to be removed to the manure deposit when used in animal housing. It is not allowed to discharge residues containing the product to the 6

12 sewer, soil, and/or surface water [Om bodem- en in het water levende organismen te beschermen dienen resten (zoals vuil, afvalwater en strooisel) die het middel bevatten te worden afgevoerd naar de mestopslag]. No additional measures to protect the environment (risk mitigation measures) are required. 7.5 Overall conclusion Based on a comparable risk assessment, it can be concluded that the product, when used in accordance with the proposed Legal Instructions for Use (WG/GA), complies with the environmental standards and will not cause unacceptable effects on the environment provided that (residues of) the products are discharged to the slurry pit. Conclusion H.8. The applicant has proven that, under the proposed Legal Conditions for Use and the Directions for Use (WG/GA), is sufficiently effective and that no unacceptable risk is expected to human health, the person who uses the product and the environment (Art. 121 jo art. 49 first paragraph Dutch 2007 Plant Protection Products and Biocides Act).
