Dan moeten beide partners zich inschrijven in de Basisregistratie Personen (BRP) in de gemeente waar zij gaan wonen. Ook het huwelijk moet door beide echtelieden in de BRP ingeschreven worden. Gebeurt dit niet door beide partners? Dan kan de vergunning van de huwelijkspartner

2 worden bezien op intrekking. Wel stelt de IND de partner die het huwelijk nog niet heeft ingeschreven in de gelegenheid om dit alsnog te doen. Zodra de inschrijving plaats heeft gevonden, kan de vergunning in stand blijven. Deze hele procedure levert de IND veel onnodig werk op. Hebt u als erkend referent een kennismigrant van wie de huwelijkspartner naar Nederland komt? Dan verzoeken wij u om de kennismigrant op de hoogte te brengen van bovenstaande procedure. Wanneer mag een kennismigrant werken? Op de machtiging tot voorlopig verblijf (mvv) van kennismigranten en wetenschappelijk onderzoekers wordt de arbeidsmarktaantekening 'arbeid als kennismigrant' geplaatst. Bezit de kennismigrant of wetenschappelijk onderzoeker een geldige mvv met voornoemde arbeidsmarktaantekening? Dan mag hij direct na aankomst in Nederland aan de slag als kennismigrant. Het is niet nodig om een verblijfsaantekening algemeen (VAA) bij het IND loket aan te vragen. Staat deze arbeidsaantekening niet op de mvv? Dan mag de kennismigrant of wetenschappelijk onderzoeker pas werken nadat: hij in het bezit is gesteld van het verblijfsdocument, óf na plaatsing van de VAA in zijn paspoort. De brief van de IND waarin staat dat de vergunning wordt toegekend is géén rechtmatig bewijs dat iemand mag werken. Deze brief is namelijk geen beschikking. Het verblijfsrecht gaat pas in nadat kennismigrant zijn verblijfsdocument in ontvangst heeft genomen. De uitreiking van het document wordt juridisch gezien als de beschikking / bekendmaking van het rechtmatig verblijf. Aanvraag om verlenging of wijziging van het verblijfsdoel Wordt de aanvraag om verlenging of wijziging van het verblijfsdoel tijdig ingediend? En heeft of had de vreemdeling een verblijfsvergunning met de aantekening 'arbeid vrij toegestaan, TWV niet vereist' als bedoeld in artikel 4, eerste lid van de Wav? Dan krijgt de vreemdeling bij een vervolgprocedure, in afwachting van de beslissing op de aanvraag, een VAA met de aantekening 'arbeid wel toegestaan. TWV niet vereist'. Wijzigingen nadat is beslist op de aanvraag De IND gaat er vanuit dat de (erkend) referent voor het indienen van de aanvraag alle gegevens heeft gecontroleerd en geverifieerd. In de praktijk doen werkgevers of hun gemachtigden echter regelmatig een verzoek voor het doorvoeren van wijzigingen in al ingediende aanvragen. Bijvoorbeeld: het wijzigen van de diplomatieke post waar de mvv wordt afgehaald, het wijzigen van de loketlocatie, wijzigingen in de periode van het dienstverband (ingangsdatum en/of einddatum arbeidscontract) of het annuleren van een afmelding. Vaak is er dan al een beslissing genomen op de aanvraag of de afmelding. Daarom is het, behalve in zeer bijzondere omstandigheden, niet mogelijk om wijzigingen door te voeren nadat op een aanvraag of melding is beslist. U moet een nieuwe aanvraag indienen.

3 Informeren over stand van zaken bij Ketenservice De Ketenservice krijgt regelmatig vragen van klanten over de stand van zaken (bijvoorbeeld: is de aanvraag ontvangen, is de aanvraag al ingedeeld en zo ja, wanneer en bij welke medewerker?). Vaak worden deze vragen gesteld, terwijl de streeftermijn van de beslissing nog niet is verlopen. Daarom het verzoek om eerst de streeftermijn van de beslissing af te wachten. Tot die datum is uw aanvraag nog in behandeling en kunnen wij u niet meer informatie geven. Hebt u de aanvraag via portaal Zakelijk ingediend? Dan kunt u in dit portaal de voortgang van uw aanvraag zelf volgen. Zelf de voortgang van uw aanvraag volgen Als zakelijke klant (werkgever van kennismigrant/wetenschappelijk onderzoeker, aupairbureau of uitwisselingorganisatie) kunt u de voortgang van uw ingediende aanvraag volgen in het Portaal Zakelijk. Een online aanvraag is in de meeste gevallen binnen enkele minuten tot één uur na indiening zichtbaar in het systeem. Om technische redenen verloopt het proces soms niet goed, waardoor de aanvraag niet automatisch wordt omgezet in een zaak. Wanneer de aanvraag niet automatisch is omgezet, wordt de zaak handmatig door een IND medewerker opgevoerd. Pas daarna is de aanvraag zichtbaar in het overzicht 'lopende zaken'. Handmatig opvoeren door een medewerker kan enkele dagen duren. Gegevens geïnde vorderingen De IND vermeldt bij het innen van de leges alleen een zaaknummer en de factuurgegevens. Dit heeft te maken met Algemene Wet Gegevensbescherming (AVG). De gegevensuitwisseling verloopt namelijk via een derde partij, in dit geval de bank. U ontvangt na het indienen van een aanvraag altijd een ontvangstbevestiging. In de colofon van deze ontvangstbevestiging vindt u het zaaknummer. Bewaar deze brief in uw administratie zodat u achteraf zelf kunt controleren voor wie de betaling is verricht. De IND verstrekt namelijk geen overzicht van betalingen. Vragen over 30%-regeling Belastingdienst Regelmatig krijgt de IND vragen van werkgevers en werknemers over de 30%-regeling. In het kort houdt de regeling het volgende in: Als een werknemer in Nederland komt werken, dan mag de werkgever een belastingvrije vergoeding aan de werknemer verstrekken van 30% van het loon, inclusief vergoeding. Deze regeling staat bekend als de 30%-regeling. Het is een fiscale regeling van de Belastingdienst.

Both partners must then be registered in the Personal Records Database (BRP) in the municipality where they are going to live. Both spouses must also register the marriage in the BRP. Have both partners not registered? The permit of the marriage partner can then be considered for revocation. The IND does, however, still give the partner who has not yet registered the marriage the opportunity to do so. As soon as registration has taken place, the permit can remain valid. The whole procedure saddles the IND with a lot of unnecessary work. Do you as a sponsor have a highly skilled migrant whose marriage partner is coming to the Netherlands? We then request you to inform the highly skilled migrant of the above-mentioned procedure. When may a highly skilled migrant work? The labour market sticker 'arbeid als kennismigrant' ('work as a highly skilled migrant') is placed on the temporary residence permits (mvv) of highly skilled migrants and researchers. Does the highly skilled migrant or researcher possess a valid temporary residence permit with the aforementioned sticker? He/she may then start working as a highly skilled migrant immediately after arrival in the Netherlands. It is not necessary to request a general residence sticker (VAA) at the IND desk. Has this labour market sticker not been place on the mvv? In that case, the highly skilled migrant or researcher may work only after: He/she has been put in possession of the residence document, or The VAA has been placed on his/her passport. The letter from the IND stating that the permit will be issued is not legal proof that someone may work. This letter is not an actual decision. The right of residence starts only after the highly skilled migrant has received his/her residence document. Issue of the document is viewed legally as the decision / notification of legal residence.

6 Application for extension or change of the purpose of stay Was the application for extension or change of the purpose of stay submitted in time? And does the foreign national have or did he/she have a residence permit with the sticker 'arbeid vrij toegestaan, TWV niet vereist ' (no employment restrictions, work permit (TWV) not required') as referred to in Section 4(1) of the Foreign Nationals (Employment) Act (Wav)? In a subsequent procedure, while awaiting the decision on the application, the foreign national will receive a VAA with the sticker 'arbeid vrij toegestaan, TWV niet vereist'('no employment restrictions, work permit (TWV) not required'). Changes after a decision has been made on the application The IND assumes that the (recognised) sponsor has checked and verified all information before submitting the application. In practice, however, employers often request us to make adjustments in applications that have already been submitted. For example: changes in the diplomatic post where the mvv has to be collected from, changes in the location of the IND office, changes with respect to the period of employment (starting date and/or end date employment contract) or withdrawing a cancellation. At that time, a decision has often already been made on the application or cancellation. It is for this reason that, unless in the event of exceptional circumstances, it is not possible to make adjustments after a decision has been made on an application or cancellation. You will have to submit a new application. Inquiry at the Cooperating Service about the state of affairs Clients regularly ask the Cooperating Service questions about the state of affairs (for example: Has the application been received, has the application already been classified and, if so, when and by which staff member?). These questions are often asked while the target period of the decision has not yet expired. We therefore request you first to wait until the end of the target period for the decision. Until that date, your application is still being processed and we cannot give you more information. Have you submitted the application via the Business portal? You can then monitor the progress of your application yourself in this portal. Follow the progress of your digital application As a business client (employer of a knowledge migrant/researcher, au-pair agency or exchange organization), you can follow the status and progress of your online application in the Business Portal. In most cases, an online application will be visible in the system within a few minutes to one hour after submission. Due to technical issues this process sometimes does not work well and the application is not automatically converted into a case. If the request has not been automatically converted, the case will be entered manually by an IND employee. Only after that, the application is visible in the 'current affairs' overview. Manually entering a request may take a few days.

7 Details of collected claims On collecting the fees, the IND only states a case number and the invoice details. This has to do with the General Data Protection Regulation (GDPR). The exchange of data actually runs via a third party, in this case the bank. After you submit an application, you always receive confirmation of receipt. In the masthead of this confirmation of receipt you will find the case number. Save this letter in your records so that you can check yourself for whom the payment was made. The IND does not in fact provide a list of payments. Questions about the 30% facility of the Tax and Customs Administration Employers and employees regularly ask the IND questions about the 30% facility. In short, the facility entails the following: If an employee comes to the Netherlands to work, the employer may provide the employee with a tax-free payment of 30% of the salary, including payment. This facility is known as the 30% facility. It is a tax facility of the Tax and Customs Administration. You need permission from the Tax and Customs Administration to use this facility.
