Regulation - article 4 ethical review The ethical review shall be performed by an ethics committee in accordance with the law of the Member State concerned. The review by the ethics committee may encompass aspects addressed in Part I of the assessment report for the authorisation of a clinical trial as referred to in Article 6 and in Part II of that assessment report as referred to in Article 7 as appropriate for each Member State concerned. Member States shall ensure that the timelines and procedures for the review by the ethics committees are compatible with the timelines and procedures set out in this Regulation for the assessment of the application for authorisation of a clinical trial. Het Ethisch comité bestaat minstens uit: - een deskundige inzake farmacologie, farmacotherapie en farmacokinetiek; - een lid met deskundigheid in de methodologie van het klinisch onderzoek; - een huisarts; - een arts houder van de bijzondere beroepstitel van geneesheerspecialist in de pediatrie; - een psycholoog; - twee verpleegkundigen; - een ziekenhuisapotheker; - een filosoof of vertegenwoordiger van de menswetenschappen, onderlegd of gevormd inzake medische ethiek; - een jurist; - een vertegenwoordiger van de patiënten De Koning kan nadere regels bepalen betreffende de samenstelling van het Ethisch comité. Het Ethisch comité moet bestaan uit een meerderheid van artsen. Main articles in proposition of law 3. Het Ethisch comité moet voldoen aan de erkenningsnormen vastgelegd door de Koning. Deze normen betreffen met name: 1 de implementatie van een kwaliteitssysteem; 2 de implementatie van een registratie- en beheersysteem voor belangenconflicten van de leden; 3 de vaardigheden en deskundigheid van de leden. De Koning kan bijkomende erkenningsnormen uitvaardigen met betrekking tot de beoordeling van proeven van fase I. 15
Main articles in proposition of law Art. 9, 1. Er wordt een onafhankelijk College ingesteld in de schoot van de FOD Volksgezondheid. De leden worden benoemd door de Minister overeenkomstig de bepalingen van artikel 2 en 2bis van de wet van 20 juli 1990 ter bevordering van de evenwichtige aanwezigheid van mannen en vrouwen in organen met adviserende bevoegdheid. Op dezelfde wijze duidt de Minister onder de leden een voorzitter en een ondervoorzitter aan. De Minister duidt minstens twee leden aan op basis van hun ervaring met proeven van fase I. De Koning bepaalt de nadere regelen voor de toepassing van dit artikel. Inzonderheid bepaalt Hij de vereiste ervaring van de leden hetzij met kwaliteitsbeheer, hetzij met klinisch onderzoek. Het College heeft als opdracht: 1 de communicatie met de Ethische comités als uniek contactpunt van het FAGG; 2 de aanduiding, overeenkomstig artikel 7, van het Ethisch comité gemachtigd voor elke aanvraag tot toelating, aanvraag tot latere toevoeging of tot substantiële wijziging van een klinische proef; 3 waken over de coherente toepassing van deze wet door de Ethische comités. Hiertoe kan het College aanbevelingen richten aan de Ethische comités; 4 het formuleren, op eigen initiatief of op verzoek van de Minister, van adviezen betreffende de toepassing van de Verordening, deze wet en haar uitvoeringsbesluiten; 5 het coördineren, harmoniseren, ondersteunen, evalueren en opvolgen van de kwaliteitscontrole verricht door de Ethische comités. Het College kan hiertoe aanbevelingen uitvaardigen; 6 de administratieve ondersteuning van de Ethische comités, m.b.t. de opvolging van de overeenkomstig artikel 7 toegewezen aanvragen. Het College zendt jaarlijks een activiteitenverslag van de Ethische comités en het College aan de Minister en het Parlement. 16
Main articles in proposition of law 6. Het College wordt bijgestaan door een coördinator, die daartoe door de Minister wordt aangewezen onder de ambtenaren van de FOD Volksgezondheid. De FOD Volksgezondheid is belast met de logistieke en administratieve ondersteuning van het College opdat zij haar opdrachten volledig en doeltreffend kan verrichten. De klinische proef mag enkel onder voorwaarden worden toegelaten indien het FAGG en het Ethisch comité een of meerdere voorwaarden hebben uitgebracht. Gesteld dat de voorwaarden, na afloop van het onderzoek, respectievelijk uitgebracht door het FAGG en het Ethisch comité onverenigbaar zijn met elkaar, informeer het FAGG de Minister hiervan in het rapport bedoeld in artikel 17, 1. In dit geval kan de proef niet worden toegelaten. De Minister mag niet afwijken van de gezamenlijke conclusies van het FAGG en het Ethisch comité, uitgegeven door middel van het in artikel 17, 1 bedoelde rapport. 17

De Koning kan de specifieke voorwaarden bepalen in termen van geschiktheid van de klinische proeflocaties, aangepast aan de aard en het gebruik van het geneesmiddel voor onderzoek en met inbegrip van een beschrijving van de geschiktheid van de faciliteiten, de apparatuur en het personeel. 2. Het indienen van een aanvraag tot accreditatie zoals bedoeld in artikel 36 is onderworpen aan het betalen van een bijdrage aan het FAGG van 16.996 euro. 18
