2010/63/EU legal requirements Article 24 : Specific requirements for personnel 1. Member States shall ensure that each breeder, supplier and user has one or several persons on site who shall: (a) be responsible for overseeing the welfare and care of the animals in the establishment; (b) ensure that the staff dealing with animals have access to information specific to the species housed in the establishment; (c) be responsible for ensuring that the staff are adequately educated, competent and continuously trained and that they are supervised until they have demonstrated the requisite competence.
Gewijzigde Wod Artikel 13f. 3 de en 4 de lid Artikel 13f 3. De fokker, leverancier en de gebruiker beschikken ter plaatse over een of meer personen die: a. verantwoordelijk zijn voor het toezicht op het welzijn en de verzorging van de dieren in de inrichting*; b. ervoor zorgen dat personeelsleden die met de dieren omgaan, toegang hebben tot specifieke informatie betreffende de in de inrichting gehuisveste soorten; c. ervoor zorgen dat personeelsleden voldoende geschoold en bekwaam zijn, voortdurend worden opgeleid en onder toezicht staan totdat zij het bewijs van de vereiste bekwaamheid hebben geleverd. 4. De gebruiker beschikt over personen als bedoeld in artikel 10a1, eerste lid, die verzekeren dat: a. een eind wordt gemaakt aan onnodige pijn, lijden, angst of blijvende schade die tijdens een dierproef bij een dier worden veroorzaakt; en b. een project wordt uitgevoerd in overeenstemming met het projectvoorstel op basis waarvan een projectvergunning is verleend en indien dat niet het geval is, passende maatregelen worden getroffen om dit te corrigeren en deze maatregelen worden geregistreerd. * Art 14b(1): IvD samenstelling 13.f.3.a. vormt minimale IvD
Gewijzigde Wod Artikel 10a1. 1 ste lid Artikel 10a1 1. In de projectvergunning, bedoeld in artikel 10a, eerste lid, wordt vermeld: a. de gebruiker die het project uitvoert; b. de personen die verantwoordelijk zijn voor de algemene uitvoering van het project en voor de overeenstemming daarvan met verleende projectvergunning;
EC Guidance to arrive at a common understanding art 24(1) Question: Could the person responsible for the welfare and care of the animals in an establishment be the same person as the designated veterinarian or expert? Answer: Yes. However, it is important to note in this context that the requirement for the person responsible for the welfare and care of animals in establishment requires the person to be on-site in the establishment whereas the veterinarian or other qualified expert can be designated and thus not need to be present on-site.
EC Guidance to arrive at a common understanding art 24 Question: Who is ultimately responsible for ensuring that the staff is adequately and continuously trained? Article 24 specifies that there can be one or several persons on site responsible for this task. Is it acceptable and up to the institution to e.g. allow the project applicant having technicians working for him/her, the animalwelfare body or someone from that structure and/or the designated veterinarian to fulfil this role?
EC Guidance to arrive at a common understanding art 24 Answer: Article 20(2) provides that the authorisation shall specify the person/persons referred to in Article 24(1). Hence, every breeder, supplier and user has to have at least one person on site who is specified in the authorisation and who is responsible for the education, competency and continuous training as well as ensuring the supervision of the staff. It is this person, named in the authorisation, who is responsible for the compliance with the provisions of Article 24(1)(c). It is up to the institution, i.e. the breeder, supplier or user to determine the person(s) responsible under Article 24(1) and to include this(these) person(s) in the authorisation. It is important to note that persons under Article 24(1) need to be on site in the establishment, which is not necessarily required for e.g. a designated veterinarian. Furthermore, the animal-welfare body as described in Article 26 is not a 'person' and thus cannot be made responsible for the activities under 24(1)(c).
2010/63/EU legal requirements Article 25: Designated veterinarian Member States shall ensure that each breeder, supplier and user has a designated veterinarian with expertise in laboratory animal medicine, or a suitably qualified expert where more appropriate, charged with advisory duties in relation to the well-being and treatment of the animals.

Iedere fokker, leverancier en gebruiker beschikt over een op het gebied van proefdiergeneeskunde deskundige dierenarts of, indien opportuun, een andere voldoende gekwalificeerde deskundige, die is belast met adviestaken met betrekking tot het welzijn en de behandeling van de dieren. 2. Bij of krachtens algemene maatregel van bestuur kunnen regels worden gesteld met betrekking tot de in het eerste lid bedoelde dierenarts of andere deskundige.
EC Guidance to arrive at a common understanding art 25 Question: What is meant by "or a suitably qualified expert where more appropriate" in Article 25. Can an establishment choose freely whether to designate a veterinarian or another expert? Answer: The decision has to be made on a case-by-case basis and with the agreement of the authorities when the establishment is authorised as per Article 21. It requires the designated veterinarian or a suitably qualified expert to be named in the authorisation. The provision lays out two conditions, the expert has to be: 1) 'suitably qualified' and 2) 'more appropriate' than the use of a designated veterinarian. The provision was drafted with the intention to allow in some specific cases to use experts when e.g. the user/breeder/supplier is dealing with more rare species such as cephalopods or amphibians and veterinarians specialised in these specific species are not available, making such specialised expert more appropriate. The proposed approach is in line with the rest of the provisions as well as the spirit of the Directive. The justifications used elsewhere in the Directive are systematically linked to a scientific reasoning.
2010/63/EU legal requirements Article 26: Animal-welfare body 1. Member States shall ensure that each breeder, supplier and user sets up an animal-welfare body. 2. The animal-welfare body shall include at least the person or persons responsible for the welfare and care of the animals and, in the case of a user, a scientific member. The animal- welfare body shall also receive input from the designated veterinarian or the expert referred to in Article 25. 3. Member States may allow small breeders, suppliers and users to fulfil the tasks laid down in Article 27(1) by other means.
Gewijzigde Wod Artikel 14a Artikel 14a 1. De fokker, de leverancier en de gebruiker stellen een instantie voor dierenwelzijn in. 2. In afwijking van het eerste lid kunnen bij of krachtens algemene maatregel van bestuur categorieën van fokkers, leveranciers en gebruikers worden aangewezen die niet gehouden zijn een instantie voor dierenwelzijn in te richten. Indien zij geen instantie voor dierenwelzijn inrichten, dragen zij er zorg voor dat de taken van de instantie voor dierenwelzijn op een in de algemene maatregel van bestuur aangegeven wijze worden verricht.
Gewijzigde Wod Artikel 14b Artikel 14b 1. De instantie voor dierenwelzijn bestaat ten minste uit de in artikel 13f, derde lid, onderdeel a, bedoelde persoon of personen. Bij of krachtens algemene maatregel van bestuur kunnen categorieën van deskundigen worden aangewezen die daarnaast zitting hebben in de instantie voor dierenwelzijn. 2. In de instantie voor dierenwelzijn van de gebruiker* heeft naast de in het eerste lid bedoelde personen een wetenschapper zitting. 3. De persoon bedoeld in artikel 14 brengt zijn inzichten in bij de instantie voor dierenwelzijn. * Gebruiker: een natuurlijk persoon of een rechtspersoon die, al dan niet met winstoogmerk, dieren in procedures gebruikt.
