5 RSPO certificering & de nationale overheid (voorbeelden) Criteria onder principe 2: Criterion 2.2 The right to use the land can be demonstrated, and is not legitimately contested by local communities with demonstrable rights. Criterion 2.3 Use of the land for oil palm does not diminish the legal rights, or customary rights, of other users, without their free, prior and informed consent. Criteria onder principe 7: Criterion 7.3: New plantings since November 2005 have not replaced primary forest or any area required to maintain or enhance one or more High Conservation Values. Criterion 7.5: No new plantings are established on local peoples land without free, prior and informed consent, dealt with through a documented system that enables indigenous peoples, local communities and other stakeholders to express their views through their own representative institutions. Ja: Door pragmatische samenwerking tussen private stakeholders en de civil society (NGOs) zijn er in korte tijd standaarden en certificeringssystemen met een hoge mate van acceptatie tot stand gekomen. Waren de overheden er van het begin bij betrokken geweest, had zo n resultaat nooit behaald kunnen worden. Nee: De effectieve implementatie van de resulterende certificeringssystemen staat of valt bij de aanwezigheid van een functionerend publiek bestuur, dat niet door private certificering te vervangen is. Een oplossing voor duurzame grondstoffen uit de landbouw? ja: voor een beperkt aantal global commodities zijn er goede standaarden uit voortgekomen. nee: het is geen duurzame oplossing om voor elke grondstof een ronde tafel op te zetten. Een alternatief voor traditionele vormen van publiek bestuur? ja: de ronde tafels zijn een goed mechanisme voor het snel tot stand brengen van breed gedragen standaarden. nee: tenslotte moeten deze standaarden weer deel worden van overheidsregulering in consumptieen productielanden.
