1 Nieuwsbrief (see below for English version) De laatste weetjes, aangekondigde maatregelen en nieuwsfeiten Deze nieuwsbrief bevat de volgende onderwerpen: 1. Nu beschikbaar: gratis Client Online app! 5. So VAR so good Vrijgevigheid: Leeftijdsgrens extra belastingvrije schenking van 35 naar 40 jaar Jaarlijks mag u uw kind een bedrag belastingvrij schenken. In 2013 is dat aan ieder van uw kinderen, aan de echtgenote(n) van uw kind(eren) en aan ieder van uw kleinkinderen. Eenmalig mag u een verhoogd bedrag belastingvrij schenken. De leeftijdsgrens voor deze eenmalige vrijstelling is verhoogd, en geldt vanaf 1 januari 2013 voor kinderen tussen de 18 en 40 jaar. Aan hen kunt u in 2013 eenmalig een bedrag van belastingvrij schenken. Bijdrage werkgever ziektekostenverzekeringswet In voorgaande jaren betaalden werknemers via de werkgever loonbelasting over de bijdrage van de werkgever ten behoeve van de ziektekostenverzekeringswet. Werkgevers betaalden deze bijdrage vervolgens direct aan de belastingdienst. Vanaf 2013 betaalt de werkgever nog steeds mee aan de belastingdienst echter deze bijdrage is niet langer belast. Dit is voordelig voor u als werknemer. De regering heeft besloten dit voordeel te neutraliseren door het belastingpercentage over de eerste schijf van de loonbelasting te verhogen naar 37%. Zelf betaalt de werknemer, buiten de werkgever om, rechtstreeks zijn eigen nominale premie voor de ziektekostenverzekeringswet op maandbasis. Die eigen premie bedraagt circa 100 per maand voor het basispakket naast de premie die daarboven op wordt betaald voor eventuele aanvullende ziektekostenverzekeringspakketten. Bent u er klaar voor: Werkkostenregeling Sinds 1 januari 2011 geldt een nieuwe regeling: de werkkostenregeling (WKR). Door deze regeling kunnen werkgevers maximaal 1,4% van hun totale fiscale loon (de 'vrije ruimte') van alle werknemers tezamen besteden aan onbelaste vergoedingen en verstrekkingen voor de werknemers. Daarnaast kunnen werkgevers bepaalde zaken onbelast blijven vergoeden of verstrekken door gerichte vrijstellingen toe te passen. Over het bedrag boven de vrije ruimte betaalt de werkgever loonbelasting in de vorm van een eindheffing van 80%. In 2013 is het belastingvrije percentage van 1,4% verhoogd naar 1,5%. In 2013 zijn werkgevers nog niet verplicht om de WKR in te voeren. Dat moet pas per In oktober 2012 hebben wij onze klanten een gezonden inzake de WKR. Indien u vragen heeft of indien u advies wenst of het zinvol is om al in 2013 de WKR toe te passen, neemt u dan snel contact met ons op. In principe kan in 2013 al worden overgegaan op de WKR zolang de eerste vergoeding nog niet aan uw werknemer is betaald!

2 Nu beschikbaar: gratis Client Online app! In de Apple Appstore of Google Play Store kunt u gratis de Client Online app downloaden. Met deze app kunt u direct uw belastingaangiften online bekijken en accorderen (goed- of afkeuren) met uw pincode. De belastingaangiften worden vervolgens automatisch naar de belastingdienst gestuurd. So VAR so good Werkt u als zelfstandige? Of huurt u als opdrachtgever een zelfstandige in? Dan verdient het aanbeveling om van de zelfstandige te eisen dat hij een VAR aan u overlegt. Een Verklaring Arbeidsrelatie (VAR) is een document dat op verzoek van de zelfstandige wordt afgegeven door de Belastingdienst, waarin vermeld wordt wat de status van een zelfstandige is. Een ZZP er, freelancer of zelfstandig ondernemer is voor de Belastingdienst overigens hetzelfde. Voor alle duidelijkheid:een VAR is niet verplicht, het is echter raadzaam een VAR in uw administratie te hebben van iedere ZZP'er die u inhuurt. Opdrachtgevers die ZZP ers inhuren die beschikken over een VAR WUO (winst uit onderneming) zijn hierdoor gevrijwaard van mogelijke aanspraken van de Belastingdienst ten aanzien van loonbelasting en sociale premies (let wel op dat de informatie die de ZZP'er op het aanvraagformulier zet dan wel klopt, zoals het tijdvak van aanvraag, de werkzaamheden die hij gaat verrichten, hoeveel opdrachtgevers hij heeft in een jaar en hoeveel uren hij werkt). Als uw opdrachtgever een VAR WUO eist, zal de ZZP-er deze dus moeten aanvragen. Nadat de Belastingdienst de VAR aanvraag heeft bekeken zullen zij een verklaring afgeven. Afhankelijk van de antwoorden op de gestelde vragen wordt een passende VAR afgegeven. Er zijn 4 mogelijkheden: VAR WUO Met een VAR WUO ziet de Belastingdienst u 100% als zelfstandig ondernemer en dan hoeft de opdrachtgever over deze inkomsten geen loonbelasting/premie volksverzekeringen in te houden. Ook niet als achteraf blijkt dat de verklaring niet juist was. Dit is slechts anders als de antwoorden op de gestelde vragen onjuist waren. Als opdrachtgever is het daarom van belang dat u naast de door de belastingdienst afgegeven VAR verklaring een kopie heeft van het aanvraagformulier. Daarmee kunt u checken of de antwoorden overeen komen met de feiten. VAR ROW en VAR Loon Als in de verklaring staat 'Resultaat uit Overige Werkzaamheden' of 'Loon', dan zijn aan deze kwalificaties geen rechten te ontlenen. De opdrachtgever moet in beide gevallen zelf beoordelen of er wel of niet sprake is van een dienstbetrekking op basis waarvan hij loonheffingen moet inhouden en afdragen. VAR DGA De VAR DGA geldt voor een eigenaar van een BV of van een buitenlandse entiteit. De verklaring 'werkzaamheden voor rekening en risico van uw vennootschap' geldt niet voor het loon dat u als directeur-grootaandeelhouder ontvangt van uw vennootschap zelf. Daarover moet uw vennootschap loonheffingen berekenen en afdragen. In

3 sommige gevallen is de directeur-grootaandeelhouder niet verzekerd voor de premies werknemersverzekeringen. Voor de opdrachtgever betekent een VAR DGA dezelfde vrijwaring als een VAR WUO. So VAR so good Generosity: Age limit additional tax-free donations from 35 to 40 years Each year you may give your child a tax free amount. In 2013 you can give to each of your children, to the spouse(s)/husband(s) of your child(ren) and to your grandchildren. Once you may give an increased tax free amount to your children. The age limit for this exemption is increased, and applies from 1 January 2013 for children between 18 and 40 years. It is allowed to give them an amount tax free of Contribution employer Health Insurance Act In previous years employees paid wage tax via the employer's payroll on the contribution of the employer on behalf of the Health Insurance Act. Employers paid this contribution plus the wage tax to the Dutch tax office. From 2013 the employer still contributes to the Health Insurance Act, however, this contribution is no longer taxed. This is beneficial for you as an employee. The government has decided to neutralize this advantage by increasing the tax rate over the first taxable income to 37%. The employee him/herself pays, beyond the scope of the payroll, his/her own nominal premium for Health Insurance on a monthly basis. The own premium amounts to approximately 100

4 for the basic package. In addition to that employees pay an amount per month for any supplementary health insurance packages. Are you ready: Labour Cost Ruling Since 1 January 2011 a new tax regime was introduced: the labour cost ruling (WKR). Under the WKR employers can reimburse/pay costs and expenses tax free up to 1.4% of the accumulated annual taxable wages (the 'free space') to their employees. On top of that employers are permitted to continue to reimburse/pay tax free certain selected costs and expenses. Over the amount exceeding the free space employers are forced to pay an employer tax at a flat rate of 80%. In 2013, the tax-free rate of 1.4% increased to 1.5%. Employers are not obliged to apply the WKR in In 2014 however all employers are forced to apply the WKR. In October 2012 we sent an to all of our clients informing them about the WKR. If you have any questions or if you require advice whether it is useful to apply the WKR in 2013 yet, please do not hesitate to contact us. As a general rule, employers can postpone the moment to step in the WKR until the first reimbursement or first payment on an employee's behalf needs to be administered. If that very first reimbursement/ payment has been booked under the WKR regime or under the "old" regime, one cannot decide later in the calendar year to step back! With this app you can instantly look into your tax returns online and approve (or reject) them with your PIN code. Upon your approval your tax returns will be automatically sent to the Dutch tax authorities. So VAR so good Do you work as self-employed? Or do you hire a self employed person? It is strongly recommended that the hirer demands a so called VAR from the self employed person. A VAR is a Declaration of Independent Contractor Status and can be applied by self employed persons with the tax office. The tax office issues the VAR and confirms the status of a self-employed persons' business relationship with the hirer. A self employed person, a freelancer and an entrepreneur are, though operating under different names, considered equal for the tax authorities. To avoid any confusion: A VAR is not mandatory, however, it is recommended for hirers to have a copy of the VAR statement of each freelancer that works for the hirer. Hirers of self-employed persons who have a so-called VAR WUO (profits from business) are safeguarded against potential tax and social security claims from the tax office with regard to the payment to the self employed person (please check if the information provided on the VAR application form submitted by the self employed person is correct, such as the period of application, the work that the self employed person will perform,

5 how many clients he has in a year and how many hours he works). If you are a self employed person and the hirer requires your VAR, you need to apply. Depending on the self-employed persons answers to the questions raised on the VAR application form, the tax office will issue a VAR statement. There are 4 options: VAR WUO The VAR WUO rules that the tax office is considering the self-employed person s business as operating through an own business; consequently, the hirer does not have to withhold and pay wage tax/social security contributions on the self employed person s behalf. Even if it subsequently appears that the statement was not correct. This is different if the answers to the questions were incorrect. For hirers it is therefore important to get a copy of both the VAR statement and the VAR application form. This enables the hirer to check whether the answers match with the factual circumstances. VAR ROW (result other activities) and VAR LOON (wage) A VAR ROW or VAR "Loon" does not safeguard the hirer from withholding of wage tax/social security contributions on the payment to the self employed person. The hirer has got to check if the business relationship with the self employed person should be considered an employment relationship. If so, the hirer is forced to withhold and pay wage tax/social security contributions. VAR DGA (substantial shareholders of their own company) The VAR DGA applies for an owner of a limited liability company (BV) or a foreign entity. The statement DGA" does not apply to the salary that the self employed person receives himself as a director and major shareholder of his own company. The self employed person has got to withhold and pay wage tax/social security contributions over his own earnings himself via his own company. For the hirer, a VAR DGA guarantees the same as set out under VAR WUO. If you need any further advice or assistance regarding the above, please do not hesitate to contact us.
