15 REACH bewijslast voor de industrie REACH Registration, Evaluation, Authorisation and restriction of CHemicals EC Regulation No 1907/2006 is op 30 dec gepubliceerd in the Official Journal of the EU (OJL/2006/396/1) Er bestaat een REACH Core Group binnen Orgalime voor - ontwikkeling van een guideline - overleg over REACH Implementation Project (RIP. 3.8) - interpretatie artikel 7.2. over "notificatie van substanties in artikelen" - standpunt over berekeningswijze van aanwezigheid van specifieke substanties (kankerverwekkend, mutageen etc ) in concentraties > 0,1 % W/W waarvoor meldingsplicht is (interpretatie Orgalime "gemiddelde concentratie van het artikel zoals geproduceerd of geïmporteerd" etc.. 19 IPPC Bedoeling IPPC Integrated Pollution Prevention and Control Directive 96/61/EC "The purpose of this Directive is to achieve integrated prevention and control of pollution arising from the activities listed in Anne I. It lays down measures designed to prevent or, where that is not practicable, to reduce emissions in the air, water and land from the abovementioned activities, including measures concerning waste, in order to achieve a high level of protection of the environment taken as a whole, without prejudice to Directive 85/337/EEC and other relevant Community provisions". 19

25 MD MD (New) Machinery Directive Guidelines voor implementatie van de nieuwe Directive 2006/42/EC zullen spoedig starten (na mid-maart 2007) Orgalime zal een task force opstarten om - industriestandpunten te kanaliseren - input leveren en mensen afvaardigen naar de werkgroep van de Commissie die de guidelines moet opstellen vb. impact pompen: "bouten moeten aan de machine verbonden worden om niet verloren te gaan" eind mei 2007 workshop hierover door EC DG Enterprise & Industry Reeds verschillende roadshows van Agoria bij leden (contact ook Agoria S. 26 LVD LVD Low Voltage Directive 2006/95/EC Vervangt vorige versie Directieve 73/23/ECC Geen transpositie nodig van de nieuwe directieve naar nationale wetgeving want bestaande maatregelen werden inhoudelijk niet gewijzigd gevolgen: géén voor producten op de markt vóór voor producten die na op de markt worden gebracht moet in de Declaration of Conformity verwezen worden naar deze nieuwe directieve. 26

28 PED PED Pressure Equipment Directive Toepasbaarheid van EC-Directieve 97/23/EC Toepassingsgebied - pressure equipment & assemblies >0,5 bar - vessels, piping, safety & pressure accessoires Europump standpunt: pompen uitgesloten van de scope van PED - EC-declaration of conformity en CE-markering niet van toepassing op pompen en pompsystemen - bevestiging EC working group "Pressure" (1999): pressurized equipment ecluded if - pressure is not the significant design factor (vb. dynamische & thermische belasting, stijfheid & vormbehoud, maar "overdimenionering" niet, ) - equipment designed to "move" and not just "contain" 28

Proposal for a directive on the protection of workers from risks arising from eposure to optical radiation at work (COD/92/0449/D) Interventie Orgalime: "asking employers to be responsible for the effects of sunlight and the protective measures which workers should take when working outdoors seems disproportionate, especially since it is impossible to separate eposure to sunlight occurring during leisure time from that occuring at work".."we recommend that the Commission should consider withdrawing the present proposal".
