2 Vraagstelling en aanpak 2 In het eerste deel van deze bijlage geven we een overzicht van de onderzoeksvragen en de aanpak die de deelnemende rekenkamers hebben afgesproken voor de coordinated audit. We merken daarbij op dat niet alle vragen in gelijke mate terugkomen in de nationale rapportages. In het tweede deel van deze bijlage lichten we de aanpak en de uitvoering toe van ons onderzoek naar de handhaving van de EVOA in Nederland. Doelstelling coordinated audit The audit s objective is to improve the enforcement of the EU Waste Shipment Regulation (EWSR) by providing insight into (differences in) enforcement strategies and performance (in terms of results and the achievement of intended effects) among member states and countries that are party to the European Economic Area (EEA). Probleemstelling coordinated audit How are the obligations arising from the EWSR being met? What results and intended effects are being achieved by enforcing the EWSR? And what differences exists between countries with respect to the enforcement of the EWSR? Onderzoeksvragen en aanpak coordinated audit Question 1 How much waste is imported and exported each year (from/to EU and EEA countries as well as non-european countries; mode of transport)? What are the main types of waste? What are the major countries of origin and destination? How does the amount of imported and exported waste relates to the national production of waste and to the capacity of recycling and processing facilities? How much illegal waste transports are intercepted by the authorities each year (number of transports and tonnage)? Are there estimates available of the total amount of waste that is illegally imported or exported each year? The information must be clear and of good quality

3 Question 2 When and how were the provisions of the EWSR incorporated into national legislation? 3 Question 3 Question 4 Question 5 Question 6 Question 7 In accordance with the EWSR, in good time and with a clear clause on enforceability How can those infringing the EWSR be punished? How many and what kind of penalties have been imposed during the last two years? EWSR: article 50.1: Member States shall lay down the rules on penalties applicable for infringement of the provisions of this Regulation and shall take all measures necessary to ensure that they are implemented. The penalties provided for must be effective, proportionate and dissuasive. Or phrased in less legal terms: the legal set of penalties should provide (assure, guarantee) for an effective correction in offenders behaviour. Which organisations are charged with enforcement of the EWSR and with issuing permits for and clearance of international waste transports? What are their tasks and responsibilities? Do they have enough powers (legal framework) to fulfil their responsibilities? What are their objectives for the enforcement of the EWSR? And do they have an adequate organizational structure for the enforcement of the EWSR? A clear division of responsibilities (between and within organisations). Enough powers and an adequate organizational structure to fulfil their responsibility. What agreements have been reached on cooperation between the organisations that are charged with the enforcement? To what extent do the organisations concerned comply with agreements on cooperation? And to what extent is that cooperation adequate for the proper enforcement of the EWSR? Agreements on communications and coordination at various levels. Compliance to the agreed upon procedures. Information necessary for the proper enforcement is exchanged. Do the organisations concerned have enough funding, time, staff, information, equipment and other resources to fulfil their responsibilities? Enough capacity in terms of funding, time, staff and other resources to carry out enforcement tasks. What sort of enforcement strategy do the organisations concerned follow? How does this strategy differentiates between compliance to EWSRprocedures and measures to counter illegal waste transport? How did this strategy come about? How is the strategy put into practice? Which guidelines are used to define waste, disposal, recovery and other waste terms and how are these guidelines used within the context of enforcement actions? What are the results of the enforcement activities? And how do the organisations concerned account for their enforcement performance? See below.

4 Question 8 Question 9 What kind of information do the organisations concerned exchange with environmental authorities in other countries? How is this exchange of information organised? And is it adequate for the proper enforcement of the EWSR? Agreements on communication and reliable information. Compliance to the agreed upon procedures. What obstacles do enforcers of the EWSR have to deal with? And what factors contribute to the effectiveness of enforcement? None 4

5 Aanpak en uitvoering van het onderzoek naar handhaving EVOA in Nederland 5 Gesprekken en observaties Voor het onderzoek zijn gesprekken gevoerd met (verschillende) medewerkers van de volgende organisaties: Ministerie van Infrastructuur en Milieu, Directie Duurzaamheid. Inspectie Leefomgeving en Transport (zowel voormalig IVW als voormalig VI en de VROM-IOD). Agentschap NL. Politie (KLPD: Verkeerspolitie en Waterpolitie; Regionaal Milieuteam Rotterdam Rijnmond). OM (Functioneel Parket). Douane (Regio Rotterdam Haven, Regio Amsterdam, Douane Landelijk Kantoor, Custom Control Centre Rotterdam Rijnmond). DG-Milieu en DG-Taxud van de Europese Commissie. World Customs Organization. IMPEL. Om een beter beeld te krijgen zijn drie handhavingsacties bijgewoond (haven Amsterdam, transportcontrole bij Zaandam en Kreekkraksluizen). Documenten Voor het onderzoek zijn (interne) evaluaties en procedurebeschrijvingen en andersoortige documenten bestudeerd van de verschillende actoren. Cijfermatige overzichten Om de reeds aanwezige cijfermatige overzichten aan te vullen hebben wij bij de Douane, KLPD en ILT cijfers uit de interne registratiesystemen opgevraagd, geanalyseerd en vergeleken met cijfers uit andere bronnen. Onze analyse heeft de nodige verschillen aan het licht gebracht tussen de rapportages van de drie handhavingspartners (zie bijlage 2 van het rapport). De (achtergrond van de) verschillen is besproken met de direct betrokken analisten. Van het Functioneel Parket van het Openbaar Ministerie te Rotterdam hebben we een overzicht ontvangen van alle afdoeningen van EVOAzaken voor de periode 2008 tot en met Het gaat hierbij om zaken die uit heel Nederland bij het OM terecht zijn gekomen, dus niet alleen zaken die bij Rotterdam zijn aangedragen.

6 Dossieronderzoek Om een beeld te krijgen van de (administratieve) uitvoering zijn 30 (digitale) dossiers van het KLPD en 24 dossiers van de Douane (Amsterdam en Rotterdam beoordeeld). Voor 9 van deze dossiers, alle overgedragen aan het OM of de ILT, is nagegaan of de afloop van de zaak kon worden achterhaald. 6 Kwaliteitswaarborgen Om de kwaliteit te waarborgen zijn de volgende vormen toegepast: Gespreksverslagen en bevindingen van het dossieronderzoek zijn afgestemd. Eerste bevindingen zijn tijdens een ronde tafelgesprek besproken met de belangrijkste actoren. Een nota met de feitelijke bevindingen is voor commentaar voorgelegd aan de betrokken ministeries en diensten. Cijfermatige overzichten zijn doorgesproken met analisten van de ILT, KLPD en Douane. Cijfers over het sepotpercentage zijn besproken met het Functioneel Parket in Rotterdam. De nota van bevindingen en het conceptrapport zijn onderworpen aan een interne peer review.
