1 Newsletter Legislative Amendment As of February this year, the Dutch government has adopted the Management Enforcement Legislative Act (Wet Versterking Besturing). This new act will, among others, affect the tuition fees (as of academic year ) and the dis-enrolment procedure (as of academic year ). In this newsletter, the most significant changes will be explained. Tuition fees in Higher Education In the Higher Education sector, a distinction is made between statutory and institutional tuition fees. The statutory tuition fees are determined by the Minister; the institutional tuition fees are determined by the Governing Board of the institution. The Government has outlined specific conditions which help determine whether a student should pay either the statutory or institutional tuition fees. Conditions statutory and institutional tuition fees For each applicant/student, HAN University of Applied Sciences must determine whether they have to pay the statutory or institutional tuition fees. As of 1 September, the regulations concerning the tuition fees will change. The consequences this has for applicants/students will become apparent as of the academic year Whether an applicant or student must pay the statutory or institutional tuition fees is dependent on the following conditions: 1. A previously obtained degree attained at a Dutch institution for Higher Professional Education (HBO) or University Education (WO) 1 The main change in the law is that the Government will finance only one Bachelor s and one Master s degree (without distinguishing between professional (HBO) and academic (WO) degrees). This means that applicants/students who have already obtained a Bachelor s or Master s degree in the Netherlands (unless obtained before the academic year ) and who apply or are enrolled for a second Bachelor s or Master s degree programme, will have to pay the so-called institutional fees. The Government is making an exception for second degree programmes in the fields of Education or Health Care, but only if the first degree does not belong to either one of these fields. In addition there is another exception for students who have started their second Bachelor s or Master s degree programme before obtaining their first Bachelor s or Master s degree. These students may finish their second Bachelor s or Master s degree programme for the rate of the statutory tuition fees. 2. Residing outside the border region (residency requirement) An applicant or student who does not have an official residence address in the Netherlands, Belgium, Luxembourg or in one of the German federal states North Rhine-Westphalia (Nordrhein-Westfalen), Bremen or Lower Saxony (Niedersachsen) will have to pay the institutional tuition fees. 3. Having a nationality that does not belong to one of the European Economic Area (EEA) member states (nationality requirement) An applicant or student who does not belong to the group as specified under Article 2.2 of the Study Grant Act 2000 (this includes, among others, students with a Swiss or Surinamese nationality or a nationality of one of the/eea 2 member states and certain types of Dutch residence permits) will have to pay the institutional tuition fees. The nationality requirement 1 If the student was enrolled for a second study programme at the same time they completed their first study programme, the amount of the institutional tuition fees may differ. In this case, contact the Student Information Desk of the Faculty ( t Vraagpunt) or the HAN Information Centre (HVC). 2 EEA member states: Austria, Belgium, Bulgaria, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, the Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden or the United Kingdom.

2 was already a condition for obtaining a Government grant; this requirement is therefore not new in the legislative amendment. Applicants or students who have already obtained a degree from a Dutch institution for Higher Professional Education (HBO) or University Education (WO) and/or do not meet the residence and/or nationality requirements will have to pay the institutional tuition fees as of the academic year The other applicants/students will have to pay the statutory tuition fees. Amount institutional tuition fees The institutional tuition fees are considerably higher than the statutory tuition fees. Reason for this is that the institution will no longer be receiving a government grant for students who do not meet one or more of the abovementioned conditions. HAN University of Applied Sciences has set the institutional tuition fees at 7.000,00 for the academic year In order to prevent applicants and students, who (re)enrol for the academic year , unexpectedly having to face the much higher tuition fees, the Governing Board of HAN University of Applied Sciences has set up a transitional arrangement. - Applicants/students who will start or have started their study programme in or before the academic year , will have to pay the institutional tuition fees at the level of the statutory tuition fees (full-time/dual and part-time 1.400); - The academic year will be seen as a transitional year. Enrolled students as of the academic year or earlier will have to pay 4.250, which is approximately 60% of the institutional tuition fees that is applicable to students who will start their study programme in the academic year As of the academic year , the students will have to pay the full amount of the institutional tuition fees. This will be at least Note: this transitional arrangement does not apply to applicants/students who do not meet the nationality requirement. This group of students has already been paying for several years the full amount of institutional tuition fees. Possible grants The possibilities to apply for a grant in study costs will remain. Think for example of the teacher s grant, the teachers compensation or additional performance-linked compensation ( or the tax deduction of study costs ( If you work next to your study, you could ask your employer for the possibilities. Dis-enrolment procedure Contrary to previous years, a student may at any time submit a dis-enrolment request without providing a reason for their request. Dis-enrolment requests are to be submitted through one s Studielink account. Dis-enrolment always takes place at the first day of the next month (or a later indicated month) following the date at which the student has submitted their request through Studielink. Submitting a dis-enrolment request with a date that is in the past is not possible. In the legislative amendment that will take effect as of 1 September 2010, the institution has also been provided with a number of reasons allowing them to have certain students dis-enrolled. One of which is not paying one s tuition fees; the student may in that case, at the request of the institution, be disenrolled as of the second month following the date of the notice of tuition fees due. Other reasons for dis-enrolling students at the request of the institution are, among others, a negative binding recommendation and fraud. In case of dis-enrolment, the student is entitled to a refund (if they have paid the full amount in advance) or reduction of 1/12 th of the tuition fees for the months remaining. Students who are dis-

3 enrolled in July or August are not entitled to a refund or reduction of the tuition fees for that academic year. Dis-enrolment because of graduation When graduating, a student may request (through Studielink) to be dis-enrolled as of the first day of the month following one s graduation date (as indicated on the diploma). For example, if the date on one s graduation diploma is 7 May, the desired dis-enrolment date will then be 1 June.

4 Informatiebrief wetswijziging Begin februari is door de Eerste Kamer de wet Versterking Besturing aangenomen. Deze wet heeft gevolgen voor de hoogte van de collegegelden en het recht op tussentijds uitschrijven vanaf het studiejaar In deze informatiebrief worden de belangrijkste wijzigingen uitgelegd. Collegegelden binnen het Hoger Onderwijs In het Hoger Onderwijs wordt onderscheid gemaakt tussen wettelijk en instellingscollegegeld. Het wettelijk collegegeld wordt door de minister vastgesteld en het instellingscollegegeld wordt door het College van Bestuur van de instelling. De overheid heeft voorwaarden geformuleerd aan de hand waarvan wordt vastgesteld of een student het wettelijk vastgestelde of het instellingscollegegeld moet betalen. Bepaling wettelijk en instellingscollegegeld Voor elke (aankomende) student moet de HAN beoordelen of iemand het wettelijk of instellingscollegegeld moet betalen. Vanaf 1 september zijn hiervoor de regels veranderd, de consequenties voor de studenten zullen merkbaar zijn vanaf studiejaar De bepaling of een (aankomend) student het wettelijk of het instellingscollegegeld verschuldigd is afhankelijk van de onderstaande voorwaarden: 1. Een eerder behaalde graad in het Hoger Onderwijs in Nederland In de wet is bepaald dat nog maar één bachelor- en één masteropleiding wordt gefinancierd door de overheid (Rijksbijdrage). Dit betekent dat (aankomende) studenten die al eerder een bachelor- of mastergraad hebben behaald in Nederland (tenzij vóór studiejaar ) en zich inschrijven of ingeschreven staan voor een tweede bachelor- of masteropleiding het zogenaamde instellingscollegegeld moeten gaan betalen. De overheid maakt daarbij een uitzondering voor een tweede studie in de zorg of het onderwijs, maar alleen als de eerste studie buiten die sectoren valt. Daarnaast is er nog een uitzondering voor de studenten die aan een tweede bachelor- of masteropleiding zijn begonnen vòòr het behalen van hun eerste bachelor- of masteropleiding. Deze studenten kunnen hun tweede bachelor- of masteropleiding afmaken tegen het wettelijk collegegeld. 2. Woonachtig buiten het grensgebied (woonplaatsvereiste) Een (aankomend) student waarvan bij de instelling geen officieel woonadres in Nederland, België, Luxemburg of de Duitse deelstaten Nord-Rhein-Westfalen, Nedersaksen of Bremen bekend is, betaalt het instellingscollegegeld. 3. Een nationaliteit van buiten de Europese Economische Ruimte (EER) (nationaliteitsvereiste) Een (aankomend) student die niet behoort tot de groep als bedoeld in artikel 2.2 van de Wet Studiefinanciering 2000 (dit betreft onder andere studenten met een EER-nationaliteit Zwitserse of Surinaamse nationaliteit en bepaalde soorten verblijfsvergunningen) betalen het instellingscollegegeld. Nationaliteitsvereiste was eerder al een voorwaarde voor het verkrijgen van Rijksbijdrage; dit is geen nieuwe wijziging in de wetgeving.

5 Studenten die eerder een graad behaald hebben in het Hoger Onderwijs in Nederland en/of niet voldoen aan het woonplaats- en/of nationaliteitsvereiste betalen vanaf studiejaar het vastgestelde instellingscollegegeld. De overige studenten betalen het wettelijk collegegeld. Hoogte instellingscollegegeld Het instellingscollegegeld ligt aanzienlijk hoger dan het wettelijk vastgestelde collegegeld. Reden hiervoor is dat een instelling geen Rijksbijdrage meer ontvangt voor studenten die niet voldoen aan één van de eerder voorwaarden. De HAN heeft het instellingscollegegeld voor het studiejaar vastgesteld op Om studenten en aankomende studenten die (op)nieuw instromen in het studiejaar niet direct met dit hogere instellingscollegegeld te confronteren, heeft de HAN een overgangsperiode ingesteld. - Voor het studiejaar betalen studenten die óp of vóór studiejaar zijn gestart het instellingscollegegeld dat gelijk is gesteld aan het wettelijk collegegeld (voltijd/ duaal en deeltijd 1.400); - Studiejaar wordt gebruikt als overgangsjaar. Studenten betalen dan 4.250, wat neerkomt op ongeveer 60% van het instellingscollegegeld geldend voor studenten die in voor het eerst instromen; - Vanaf studiejaar betalen de studenten het volledige instellingscollegegeld. Dit komt neer op ten minste Let op: dit geldt niet voor de (aankomende) studenten die niet voldoen aan het nationaliteitsvereiste. Voor deze groep geldt bovenstaande overgangsregeling niet. Zij betalen, al meerdere jaren, het volledige instellingscollegegeld. Mogelijkheden voor tegemoetkomingen De mogelijkheden om beroep te doen op een tegemoetkoming in studiekosten blijven bestaan. Te denken valt aan de lerarenbeurs, de tegemoetkoming leraren- of extra prestatiebeurs (zie of de aftrek studiekosten ( Als je als student naast je studie werkt, kun je ook bij jouw werkgever naar de mogelijkheden informeren. Uitschrijven In tegenstelling tot voorgaande jaren heeft de student te allen tijde het recht om zonder opgaaf van reden zijn/haar studie tussentijds te beëindigingen. Een student kan een verzoek tot uitschrijving via Studielink indienen. Uitschrijving vindt altijd plaats per de eerste van de volgende maand of een later gewenste maand die de student in Studielink heeft aangegeven. Uitschrijven met terugwerkende kracht is niet mogelijk. In de wet die per 1 september 2010 ingaat, heeft ook de instelling een aantal redenen gekregen om een student uit te mogen schrijven. Eén daarvan is het niet betalen van het collegegeld; de student kan in dat geval op verzoek van de instelling in de tweede maand volgend op de aanmaning worden uitgeschreven. Andere redenen om studenten op verzoek van de instelling uit te schrijven zijn onder andere een negatief bindend studieadvies en fraude. Bij uitschrijven heeft de student recht op terugbetaling of vermindering van 1/12 de deel van het collegegeld voor elke niet ingeschreven maand. Studenten die worden uitgeschreven in juli of augustus hebben geen recht op restitutie van het collegegeld voor dat studiejaar. Uitschrijven bij afstuderen Bij afstuderen kan de student verzoeken te worden uitgeschreven (via Studielink) met ingang van de maand volgend op de diplomadatum. Bijvoorbeeld datum op het diploma is 7 mei, de gewenste uitschrijfdatum wordt dan 1 juni.
