1 TERMS AND CONDITIONS ALGEMENE VOORWAARDEN 1. INTRODUCTION INTRODUCTIE Watcherenterprises B.V. ( Watcher Enterprises ) is a technology company based in Amsterdam, the Netherlands. With our team, we build a localisation platform to which self-developed devices may be linked. The first service and products that we have developed are the Loox app, the Vlinder and the KiGO. Other solutions will follow. Watcherenterprises B.V. ( Watcher Enterprises ) is een technologie bedrijf uit Amsterdam. Met ons team bouwen wij aan een lokalisatieplatform waaraan eigen ontwikkelde, apparaten gekoppeld worden die gelokaliseerd kunnen worden. De eerste dienst en producten die wij ontwikkeld hebben zijn de Loox app, de Vlinder en de KiGO. Andere toepassingen zullen volgen. 2. APPLICABILITY REIKWIJDTE If you use any of our products/services (via the website, via one of our devices or via the app), the following terms and conditions shall apply. PURCHASE, DELIVERY AND INSPECTION OF DEVICES KOOP, AFLEVERING EN INSPECTIE If you purchase a device via our webshop, you give Watcher Enterprises the order to arrange the transportation of the product to the delivery address for your own account and risk. You will receive a Track & Trace code when the delivery process starts. From delivery onwards, you will be the owner and, hence, responsible for the device itself and for your correct care and use of the device. We ship outside the European Union DDU (Delivery Duty Unpaid). In that case our product prices displayed are exclusive of all taxes and duties. Wij verschepen buiten de Europese Unie producten DDU (Delivery Duty Unpaid). In dat geval zijn onze productprijzen exclusief BTW en andere kosten. Als ontvanger ben je zelf verantwoordelijk voor alle invoerrechten,

RIGHT TO RETURN RECHT VAN RETOUR If you are a consumer or household customer, you may always return a product within 14 days and you will get your money back. You may unpack the product, just like you might unpack it in a shop. If you damage the product during the 14 day return period, your refund may be less. The procedure for returning the product can be found on the website or you can contact us via support@watcherenterprises.com. Als je een consument bent, mag je het product altijd terugzenden binnen 14 dagen. Dan krijg je het geld terug. Je mag het product uitpakken, zodat je het net zoals in een winkel kunt bekijken. Als het product beschadigd is, dan kan het zijn dat je minder terugkrijgt. USE OF THE DEVICE: SAFETY & HEALTH GEBRUIK VAN HET APPARAAT: VEILIGHEID & GEZONDHEID 6.1. BEFORE USING THE DEVICE THAT YOU HAVE PURCHASED, YOU ARE STRONGLY RECOMMENDED TO READ THE SAFETY INFORMATION PROVIDED IN THE BOX WITH THE DEVICE. If there is any part of the Safety Information that you do not understand, please do not hesitate to contact us via support@watcherenterprises.com Our devices use radio transmission. If you use a medical device such as a pacemaker, please check the manual for such a medical device to make sure that you can use it safely together with a radio transmitting device. Als je een medisch apparaat gebruikt (zoals een pacemaker), controleer dan de gebruiksaanwijzing van dat apparaat of het veilig gebruikt kan worden met een apparaat met zendapparatuur

If there is something wrong with your device (and it is not your fault), please let us know at support@watcherenterprises.com. IN GEEN ENKEL GEVAL IS WATCHER ENTERPRISES AANSPRAKELIJK VOOR WERKELIJKE OF VERMEENDE SCHADE IN VERBAND MET DOOD, LETSEL, SCHADE AAN EIGENDOMMEN, OF GEVOLGSCHADE / INDIRECTE SCHADE DAT VOORTVLOEIT UIT HET DIRECT OF INDIRECT GEBRUIK VAN HET APPARAAT. 8. COMPLAINTS KLACHTEN If you have a complaint about the device, please let us know at support@watcherenterprises.com. The right to use includes the right to download and install the necessary software and/or our app YOU MAY ONLY USE THE PRODUCTS AND SERVICES OF WATCHER ENTERPRISES, IF YOU ARE 18 OR OLDER. MINORS AND/OR ELDERLY PEOPLE (if they are no longer capable to enter into legally binding agreements) MAY ONLY REGISTER AND USE OUR PRODUCTS/SERVICES WITH THE EXPRESS CONSENT OF THEIR PARENTS/GUARDIANS. Indien er een spreek-luister verbinding wordt opgezet vanaf de smartphone van de volger naar de Vlinder van de senior wordt er uitgebeld naar Zweden. Hiervoor kunnen extra kosten gelden voor de volger met de smartphone, afhankelijk van zijn/haar telefoonabonnement. 11. OWN RESPONSIBILITY EIGEN VERANTWOORDELIJKHEID It is the responsibility of the user to ensure that the battery is sufficiently charged and passwords are kept confidential]. DAAROM AANVAARDEN WIJ GEEN ENKELE AANSPRAKELIJKHEID VOOR HET GEVAL DAT ONZE PRODUCTEN/DIENSTEN NIET WERKEN VANWEGE ONBESCHIKBAARHEID VAN EEN NETWERK OF VANWEGE EEN LEGE BATTERIJ. 13. DATA PROTECTION PERSOONSGEGEVENS The use of your personal data is set forth in our Privacy Policy 1 (which is a part of these terms). TERMINATION OPZEGGING If you have a paid subscription, you may cancel your subscription at any time via support@watcherenterprises.com and it will end automatically at the end of the current contract period or, if you are out of contract, at the end of a month. Als je een abonnement hebt, mag je dit op ieder moment opzeggen via support@watcherenterprises.com. 5 We may terminate the services at any time, if our company ceases its business activities. In individual cases, we may also terminate your subscription for reasons, such as a flagrant misuse of the device and/or violation of these Terms & Conditions. If you choose to (temporarily) stop your subscription we are allowed to fully deactivate your subscription after 6 months. In case you would like to re-activate you subscription after 6 months please contact us at support@watcherenterprises.com. Re-activating costs may apply. Wij mogen de diensten op ieder moment opzeggen als wij onze bedrijfsactiviteiten staken. In individuele gevallen mogen we je abonnement ook opzeggen vanwege gewichtige redenen, bijvoorbeeld flagrant misbruik van het apparaat of schending van onze Algemene Voorwaarden. Indien u ervoor kiest om uw abonnement (tijdelijk) stop te zetten, mogen wij na 6 maanden uw abonnement volledig deactiveren. Indien u na 6 maanden uw abonnement weer wilt activeren neem dan contact met ons op via support@watcherenterprises.com. Hieraan kunnen re-activatiekosten zijn verbonden. 15. INTELLECTUAL PROPERTY RIGHTS INTELLECTUELE EIGENDOMSRECHTEN Watcher Enterprises owns any and all present and future intellectual property rights into its products and services. You may not copy, modify or hack any product/service, nor use any product/service for commercial purposes (such as reselling). Watcher Enterprises is eigenaar van huidige en toekomstige intellectuele eigendomsrechten op haar producten/diensten. Je mag de producten/diensten niet namaken, wijzigen of hacken. Verder mag je de producten/diensten niet gebruiken voor commerciële doeleinden (zoals wederverkoop). 16. MISCELLANEOUS DIVERSE BEPALINGEN We may change these Terms & Conditions at any time We may freely transfer our rights and obligations to a third party (whether a group company or a third party acquiring our business) If all or part of these Terms & Conditions is not valid or enforceable (for whatever reason), it shall be automatically replaced with (a) valid term(s) that most closely resemble(s) the original term(s) These Terms & Conditions are available in multiple languages. In case of inconsistency, the Dutch version shall prevail. Wij mogen deze Algemene Voorwaarden op ieder moment wijzigen. Wij mogen onze rechten en verplichtingen vrij overdragen aan een derde (een groepsmaatschappij of, bij een overname, aan de koper). Als deze Algemene Voorwaarden, of een deel ervan, niet geldig of afdwingbaar zijn, dan worden zij geacht te zijn vervangen door geldige voorwaarden die het meest overeenkomen met de oorspronkelijke voorwaard(en). Deze Algemene Voorwaarden zijn beschikbaar in meerdere talen. Als er een tegenstrijdigheid is tussen de versies, dan geldt de Nederlandse versie. 17. APPLICABLE LAW, COMPLAINTS AND DISPUTES TOEPASSELIJK RECHT, KLACHTEN EN GESCHILLEN Dutch law is applicable.
