Box 75200, 1117 ZT Schiphol Airport AIC-B 12/07 06 DEC RICHTLIJNEN VOOR HET MELDEN VAN ERNSTIGE INCIDENTEN EN ONGEVALLEN MET BURGER- LUCHTVAARTUIGEN GUIDELINES FOR THE REPORTING OF SERIOUS INCIDENTS AND ACCIDENTS WITH CIVIL AIR- CRAFT 1. INLEIDING Als gevolg van de invoering van de Rijkswet Onderzoeksraad voor Veiligheid is op 1 februari 2005 de Onderzoeksraad voor Veiligheid ingesteld. Met ingang van deze datum is de Wet Raad voor de Transportveiligheid ingetrokken en is de Raad voor de Transportveiligheid opgegaan in de Onderzoeksraad voor Veiligheid. Voor de burgerluchtvaart heeft dit tot gevolg dat het onderzoek van alle ernstige incidenten en ongevallen met ingang van 1 februari 2005 wordt uitgevoerd door de Onderzoeksraad voor Veiligheid. De Onderzoeksraad voor Veiligheid heeft, met het uitsluitende doel toekomstige voorvallen te voorkomen of de gevolgen daarvan te beperken, tot taak te onderzoeken en vast te stellen wat de oorzaken of vermoedelijke oorzaken van individuele of categorieën voorvallen zijn en wat de gevolgen hiervan zijn en daaraan zo nodig aanbevelingen te verbinden. Het onafhankelijk onderzoek richt zich nadrukkelijk niet op schuld en/of aansprakelijkheid. De Raad heeft de volgende elf aandachtsgebieden: binnenvaart, bouw en dienstverlening, crisisbeheersing en hulpverlening, defensie, gezondheidszorg, industrie, buisleidingen en netwerken, natuur en milieu, railverkeer, wegverkeer en luchtvaart. De Raad stelt een onderzoek in naar ernstige luchtvaartincidenten en luchtvaartongevallen, betreffende: a. een luchtvaartuig op of boven het grondgebied van Nederland met inbegrip van de territoriale wateren, b. een Nederlands luchtvaartuig boven volle zee of c. een Nederlands luchtvaartuig in het buitenland, indien de betrokken staat geen onderzoek instelt, indien deze het onderzoek aan de Nederlandse autoriteiten delegeert of indien niet kan worden vastgesteld dat de plaats van het voorval binnen het grondgebied van enige staat ligt en niet met een andere staat wordt overeengekomen dat deze het onderzoek verricht. Voor de definities van een ernstig incident en ongeval wordt verwezen naar paragraaf 5. INTRODUCTION As a consequence of the introduction of the Rijkswet Onderzoeksraad voor Veiligheid (Kingdom Act concerning Dutch Safety Board), the Onderzoeksraad voor Veiligheid (Dutch Safety Board) was created on the 1st of February As from this date the Wet Raad voor de Transportveiligheid (Kingdom Act concerning Dutch Transport Safety Board) was withdrawn and the Dutch Transport Safety Board merged into the Dutch Safety Board. Consequently, as from the 1st of February 2005, the investigation of all serious incidents and accidents with civil aircraft is handled by the Dutch Safety Board. The duty of the Dutch Safety Board is to investigate and determine the causes or suspected causes of individual occurrences, or categories of occurrences, as well as their consequences, and to make recommendations if necessary, with the sole objective of preventing future occurrences or limiting their effects. This independent investigation is explicitly not aimed at culpability or liability. The Board has the following eleven areas of focus: inland navigation, construction and services, crisis management and assistance, defence, health, industry, pipelines and networks, nature and environment, rail traffic, road traffic and aviation. The Board investigates serious aviation incidents and accidents regarding: a. aircraft on or above Dutch territory, including the territorial waters, b. Dutch aircraft over high seas, or c. Dutch aircraft abroad, if the state concerned does not initiate an investigation or delegates the investigation to the Dutch authorities, or if the place of the incident cannot be determined to be in the territory of any state and no other state has agreed to conduct the investigation. Definitions of serious incident and accident can be found in paragraph 5.

MELDINGSPLICHT Een ernstig incident of een ongeval dient zo spoedig mogelijk telefonisch gemeld te worden bij de Onderzoeksraad voor Veiligheid door: de gezagvoerder van het luchtvaartuig, de eigenaar van het luchtvaartuig, de betrokken luchtverkeersdienst én de betrokken havenmeester. In geval van een luchtvaartongeval of een ernstig luchtvaartincident met een Nederlands luchtvaartuig boven volle zee of in het buitenland dient de melding te worden verricht door de gezagvoerder én de eigenaar van het luchtvaartuig. TELEFOONNUMMER: 0800 MELDOVV of (24 uur) Voor meldingen vanuit het buitenland is de Onderzoeksraad bereikbaar onder nummer: (24 uur). Voor de inhoud van de telefonische melding wordt verwezen naar paragraaf 6 van deze AIC-B. Deze gegevens dient degene die de melding doorgeeft bij voorkeur paraat te hebben, echter het (nog) niet hebben van alle gegevens mag niet leiden tot een vertraging van de melding zelf. Na de melding van een ongeval of ernstig incident zal (zullen) de betrokkene(n) een vragenlijst krijgen toegestuurd. Deze vragenlijst dient zo spoedig mogelijk en uiterlijk binnen 30 dagen te worden geretourneerd naar de Onderzoeksraad. De verstrekte gegevens vallen onder de bescherming van de Rijkswet Onderzoeksraad voor Veiligheid 1 en worden niet aan derden verstrekt, tenzij betrokkene daar uitdrukkelijk toestemming voor heeft gegeven. Sinds 4 januari 2007 geldt in Nederland de Europese verplichting om luchtvaartvoorvallen aan luchtvaartautoriteiten te melden (Richtlijn 2003/42/EG). Meldingen die niet aan de criteria van een ongeval of ernstig incident voldoen (zoals vermeld in paragraaf 5) vallen mogelijk onder deze richtlijn. De Inspectie Verkeer en Waterstaat is verantwoordelijk voor het verzamelen en beheren van de gemelde voorvallen. De Inspectie Verkeer en Waterstaat heeft daarvoor het Analysebureau Luchtvaartvoorvallen (ABL) opgericht. Meer informatie over de meldplicht, de bescherming en hoe u moet melden vindt u op de internetsite van het ABL ( 1.Krachtens artikel 69 van deze Rijkswet kunnen in het kader van het onderzoek verzamelde gegevens (o.a. verklaringen, vastgelegde medische of privé-informatie, gegevens ontleend aan een vluchtrecorder of een cockpit voice recorder, door de Raad opgestelde documenten) niet als bewijs worden gebruikt in een strafrechtelijke, tuchtrechtelijke of civielrechtelijke procedure, noch kan een disciplinaire maatregel, een bestuurlijke sanctie of een bestuurlijke maatregel op deze gegevens worden gebaseerd. De volledige Rijkswet is beschikbaar via de website van de Onderzoeksraad voor Veiligheid: REPORTING OBLIGATION A serious incident or accident shall be reported to the Dutch Safety Board by telephone and as soon as possible, by: the pilot in command of the aircraft the owner of the aircraft the air traffic control service concerned, and the airport manager concerned In case of an aviation accident or a serious aviation incident with a Dutch aircraft over high seas or abroad, the report shall be made by the pilot in command and the owner. TELEPHONE NUMBER: 0800 MELDOVV or (H24). For reports from abroad the Board can be reached at (H24). Details of what information should be given during the telephone report can be found in paragraph 6 of this AIC-B. Though it is preferred that the person making the report has this information available, (temporary) incompleteness of the information should not cause the report to be delayed. After the report of a serious incident or accident the person/people involved will be sent a questionnaire. This questionnaire must be returned to the Board as quickly as possible, but within 30 days at the latest. The reported data is protected by the Kingdom Act concerning Dutch Safety Board 1 and will not be communicated to third parties, unless the people involved have explicitly given their consent. As from the 4th of January 2007, the European obligation to report aviation occurrences to the aviation authorities is applicable to the Netherlands (European directive 2003/42/EG). Reports that do not conform to the criteria of an accident or serious incident (as described in paragraph 5) may possibly be covered by this directive. The Inspectorate for Transport, Public Works and Water Management is responsible for gathering and managing the incident reports, and has established the Analysebureau Luchtvaartvoorvallen (Occurrence Reporting Bureau) for this purpose. More information about the reporting obligation, data protection and how to report can be found on the office s website ( in Dutch language). 1.Under article 69 of this Kingdom Act collected data (including statements, recorded medical or private information, data derived from a flight data recorder or a cockpit voice recorder, documents drawn up by the Board) as part of the investigation can not be used as evidence in a criminal prosecution, disciplinary rules or a civil procedure, neither can a disciplinary measure, an administrative sanction or an administrative measure be based on these data. BUITENLANDSE VOORVALLEN Bij ieder voorval in het buitenland met een Nederlands geregistreerd luchtvaartuig dienen te allen tijde de onderzoeksautoriteiten van het betreffende land te worden ingelicht naast de Nederlandse onderzoeksautoriteit. Voor inlichtingen hierover kunt u terecht bij de Onderzoeksraad voor Veiligheid. 4. OVERIGE BETROKKEN INSTANTIES BIJ ONGE- VALLEN EN ERNSTIGE INCIDENTEN IN DE BUR- GERLUCHTVAART Bij een ernstig incident of ongeval met een burgerluchtvaartuig kan men te maken krijgen met onderstaande instanties die elk hun eigen taak en verantwoordelijkheid hebben. Bij het onderzoek van een ernstig incident of ongeval kunnen deze instanties onafhankelijk van de Onderzoeksraad verzoeken om inlichtingen te verstrekken. De instanties zijn: a. De Inspectie Verkeer en Waterstaat van het Ministerie van Verkeer en Waterstaat. De Inspectie Verkeer en Waterstaat houdt toezicht op de naleving van wet en regelgeving. De Toezichteenheid luchtvaartoperationele bedrijven van de Inspectie Verkeer en Waterstaat is gevestigd in Hoofddorp ( b. Het Ministerie van Justitie, dat zal nagaan of er strafbare feiten zijn gepleegd. Dit Ministerie wordt vertegenwoordigd door functionarissen van de Luchtvaartpolitie van het Korps landelijke politiediensten. De Luchtvaartpolitie is gevestigd op Schiphol-Oost ( 5. DEFINITIE ONGEVAL EN ERNSTIG INCIDENT Ongeval: een gebeurtenis die samenhangt met het gebruik van een luchtvaartuig en plaatsvindt tussen het tijdstip waarop een persoon zich aan boord begeeft met het voornemen een vlucht uit te voeren en het tijdstip waarop alle personen die zich met dit voornemen aan boord hebben begeven, zijn uitgestapt, en waarbij: 1. een persoon dodelijk of ernstig letsel heeft opgelopen als gevolg van het zich in het luchtvaartuig bevinden, direct contact met een onderdeel van het luchtvaartuig, inclusief de onderdelen die van het luchtvaartuig zijn losgeraakt of directe blootstelling aan de uitlaatstroom van de reactoren, behalve wanneer de letsels een natuurlijke oorzaak hebben, door de persoon zelf of door anderen zijn toegebracht, of wanneer de letsels verstekelingen treffen die zich buiten de normale voor passagiers en het personeel bedoelde ruimten ophouden, 2. het luchtvaartuig schade of een structureel defect oploopt, waardoor afbreuk wordt gedaan aan zijn soliditeit, prestaties of vluchtkenmerken en die normaliter ingrijpende herstelwerkzaamheden of vervanging van het getroffen onderdeel noodzakelijk zouden maken, behalve wanneer het gaat om OCCURRENCES ABROAD For each occurrence abroad with an aircraft registered in the Netherlands, both the Dutch investigation authority and the investigation authority of the country in question shall be notified. For more information please contact the Dutch Safety Board. OTHER AUTHORITIES INVOLVED WITH ACCI- DENTS AND SERIOUS INCIDENTS IN CIVIL AVIA- TION In case of a serious incident or accident with a civil aircraft it is possible that apart from representatives of the Dutch Safety Board one must deal with the following authorities, who each have their own tasks and responsibilities. In investigating serious incidents or accidents, these authorities may independently ask for information. a. The Inspectorate for Transport, Public Works and Water Management, of the Ministry of Transport, Public Works and Water Management. The Inspectorate for Transport, Public Works and Water Management monitors compliance with legislation. The Flight Operations Inspectorate, which is part of this organisation, is based in Hoofddorp ( b. The Ministry of Justice. This Ministry will determine if an offence has been committed, and is represented by staff of the Aviation Police, which is based at Schiphol-Oost ( dienst_luchtvaartpolitie/, in Dutch language). DEFINITION OF ACCIDENT AND SERIOUS INCI- DENT Accident: an occurrence associated with the operation of an aircraft which takes place between the time any person boards the aircraft with the intention of flight until such time as all such persons have disembarked, in which: 1. a person is fatally or seriously injured as a result of: being in the aircraft, or direct contact with any part of the aircraft, including parts which have become detached from the aircraft, or direct exposure to jet blast, except when the injuries are from natural causes, selfinflicted or inflicted by other persons, or when the injuries are to stowaways hiding outside the areas normally available to the passengers and crew; or 2. the aircraft sustains damage or structural failure which: adversely affects the structural strength, performance or flight characteristics of the aircraft, and would normally require major repair of replace-

4 AIC-B 12/07 page 4 of 5 motorstoring of motorschade en de schade beperkt is tot de motor, de motorkap of motoronderdelen, dan wel om schade die beperkt is tot de propellers, de vleugelpunten, de antennes, de banden, de remmen, de stroomlijnkappen of tot deukjes of gaatjes in de vliegtuighuid. 3. het luchtvaartuig vermist wordt of volledig onbereikbaar is. Ernstig incident: luchtvaartincident dat zich voordoet onder omstandigheden die erop wijzen dat bijna een luchtvaartongeval heeft plaatsgevonden. Hieronder is een opsomming gegeven van typische voorbeelden van ernstige luchtvaartincidenten. De lijst beoogt geen volledigheid en dient slechts als leidraad voor het definiëren van het begrip ernstig luchtvaartincident. Een bijna-botsing die een ontwijkingsmanoeuvre vereist om een botsing of een onveilige situatie te voorkomen. Een maar net voorkomen controlled flight into terrain (CFIT). Een voortijdig afgebroken startaanloop van een gesloten of bezette startbaan of een opstijgen vanaf een dergelijke startbaan met marginale separatie van een hindernis of hindernissen. Een landing of poging tot landing op een gesloten of bezette baan. Het duidelijk onder de verwachte prestaties blijven tijdens het opstijgen of in de eerste fase van stijgen. Brand of rook in de passagiersruimte, in laadruimten, of brand in de motoren, zelfs indien dergelijke branden worden geblust met blusapparaten. Alle voorvallen die het voor noodgevallen bedoelde gebruik van zuurstof door het stuurhutpersoneel vereisen. Structurele gebreken van het vliegtuig of motorweigering die niet als ongeval wordt geclassificeerd. Meervoudige storingen in een of meer boordsystemen waardoor de besturing van het vliegtuig ernstig wordt bemoeilijkt. Elke situatie tijdens de vlucht waarin een lid van het stuurhutpersoneel niet is staat is te functioneren. Elke brandstofsituatie die melding van een noodsituatie door de piloot vereist. Incidenten tijdens het opstijgen of het landen, zoals te kort binnenkomen, te ver binnenkomen of het buiten start- of landingsbanen geraken. Systeemdefecten, weersomstandigheden, het vliegen buiten de goedgekeurde vluchtzone of andere gebeurtenissen die het besturen van het vliegtuig kunnen hebben bemoeilijkt. Het uitvallen van meer dan een systeem in een redundantiesysteem dat verplicht is voor vluchtleiding en navigatie. 6. DE MELDING De onderstaande gegevens dienen te worden geleverd bij een telefonische melding: Datum van het voorval (dag, maand, jaar) ment of the affected component, except for engine failure or damage, when the damage is limited to the engine, its cowlings or accessories; or for damage limited to propellers, wing tips, antennas, tires, brakes, fairings, small dents or puncture holes in the aircraft skin; or 3. the aircraft is missing or is completely inaccessible. Serious incident: An incident involving circumstances indicating that an accident nearly occurred. The incidents listed below are typical examples of incidents that are likely to be serious incidents. The list is not exhaustive and only serves as guidance to the definition of serious incident. Near collisions requiring an avoidance manoeuvre to avoid a collision or an unsafe situation or when an avoidance action would have been appropriate. Controlled flight into terrain (CFIT) only marginally avoided. Aborted take-offs on a closed or engaged runway or take-offs from a closed or engaged runway with marginal separation from obstacle(s). Landings or attempted landings on a closed or engaged runway. Gross failures to achieve predicted performance during take-off or initial climb. Fires and smoke in the passenger compartment, in cargo compartments or engine fires, even though such fires were extinguished by the use of extinguishing agents. Events requiring the emergency use of oxygen by the flight crew. Aircraft structural failures or engine disintegrations not classified as an accident. Multiple malfunctions of one or more aircraft systems seriously affecting the operation of the aircraft. Flight crew incapacitation in flight. Fuel quantity requiring the declaration of an emergency by the pilot. Take-off or landing incidents. Incidents such as undershooting, overrunning or running off the side of runways. System failures, weather phenomena, operations outside the approved flight envelope or other occurrences which could have caused difficulties controlling the aircraft. Failures of more than one system in a redundancy system mandatory for flight guidance and navigation.
