10 Statuut Illegaal verblijven in België is strafbaar. De overheid kan je een bevel geven om het land te verlaten. Ze kan je ook opsluiten en repatriëren. Je hebt basisrechten. Ook als je illegaal verblijft. 8

11 Status Illegally residing in Belgium is punishable by law. The authorities can issue an order to leave the territory. You may also be detained and repatriated. You do have basic rights, even if you illegally reside in Belgium. 9

12 Medische hulp Mensen zonder wettig verblijf kunnen beroep doen op de procedure voor dringende medische hulp. Contacteer hiervoor het OCMW van je verblijfsplaats. Je kan dus medische hulp krijgen. Bijvoorbeeld bij een huisdokter of in een ziekenhuis. Het gaat niet alleen om spoedgevallen. Ook curatieve en preventieve zorgen, residentieel en ambulant. Ook zorgverstrekkers kunnen met hun vragen terecht bij het plaatselijk OCMW. 10

13 Medical care Illegal residents can rely on a procedure in order to obtain urgent medical care. Contact the Centre for Social Welfare (OCMW) of your place of residence. You are entitled to medical care. For instance, medical care by a general practitioner or in a hospital. Medical care is not limited to emergencies. It also includes curative and preventive care, residential and ambulatory care. Also, health care providers can always consult the local Centre for Social Welfare (OCMW). 11

14 Onderwijs Kinderen hebben recht op onderwijs. Kinderen zonder wettig verblijf zijn verplicht om naar school te gaan, net zoals alle kinderen in België. Ze kunnen een diploma behalen. Scholen moeten kinderen zonder wettig verblijf inschrijven. Ze krijgen subsidies voor deze leerlingen. De schoolverzekering geldt. 12

15 Education Children have a right to education. Children who are illegally residing in Belgium are obliged to attend school, like any other child in Belgium. They can obtain a diploma. Schools must enrol children who are illegally residing in Belgium. The schools receive subsidies for these children. The school insurance is applicable. 13

16 Werken Mensen zonder wettig verblijf mogen niet werken. Als je toch werkt, kan je werkgever een zware boete krijgen. Jij kan uit het land gezet worden. Je werkgever mag je niet misbruiken of uitbuiten. Je hebt recht op een eerlijk loon. Bij een arbeidsongeval moet de werkgever je vergoeden. Zorg dat je altijd kan bewijzen dat je tewerkgesteld was. Je kan aansluiten bij een vakbond. 14

17 Work Illegal residents are not allowed to work. Should you work anyway, then your employer can be heavily fined. You can be expulsed from the country. Your employer may not abuse or exploit you. You have a right to a just remuneration for your work. In case of an accident at work your employer must indemnify you. See to it that you can always prove that you were employed. You can join a union. 15

18 Hulpverlening Humanitaire hulp aan een persoon zonder wettig verblijf is niet strafbaar. Advocaten, medische hulpdiensten, onderwijspersoneel, professionele hulpverleners of vrijwilligers. Ze mogen uit humanitaire overwegingen hulp bieden. Ze hebben geen meldingsplicht. 16

19 Assistance Humanitarian assistance to an illegal resident is not punishable by law. Lawyers, medical caretakers, teachers, professional caretakers or volunteers are allowed to provide assistance out of humanitarian considerations. They have no obligation to notify the authorities. 17

20 Juridische bijstand Voor juridische bijstand kan je naar een advocaat of een gespecialiseerde juridische dienst. Onder bepaalde voorwaarden kan je beroep doen op een pro-deo advocaat. 18

21 Legal assistance You can obtain legal assistance from a lawyer or from a specialized legal service. Under certain conditions you can obtain legal aid. 19

22 Vrijwillige terugkeer Je kan er zelf voor kiezen om terug te keren naar je land van herkomst of een ander land. Dat kan kosteloos, via het zogeheten REAB-programma. Je krijgt een basispremie en een vliegtuigticket. Het Reïntegratiefonds biedt extra ondersteuning voor het opbouwen van een nieuwe toekomst in het land van herkomst. Info vind je bij het OCMW of een sociale dienst. 20

23 Voluntary return You may decide to return to your country of origin or to another country. This can be done free of charge through the REAB-programme. You will receive a basic payment and a plane ticket. The Reintegration fund gives a special support for rebuilding your future in the land of origin. You will find more information at the Centre for Social Welfare (OCMW) or at a social service. 21

24 Regularisatie In buitengewone omstandigheden kan je een regularisatie van je verblijf aanvragen. Regularisatie vraag je aan via de gemeente. Het is geen recht. De minister van Binnenlandse Zaken beslist. Het kan lang duren vooraleer je de beslissing kent. Veel aanvragen worden afgekeurd. Info vind je bij een advocaat, een juridische dienst of bij het OCMW. 22

25 Regularisation In exceptional circumstances you can apply for the regularisation of your residency. You must apply for regularisation to the municipality. This is not a right. The Minister of the Interior decides. It can take a long time before you know the decision. Many applications are rejected. You will get more information from a lawyer, a legal service or from the Centre for Social Welfare (OCMW). 23

26 Contracten afsluiten Je kan contracten afsluiten. Bijvoorbeeld een huurcontract, verzekeringsovereenkomst, schuldverbintenis. Je kan ook een bankrekening openen. Beide partijen kunnen erop rekenen dat deze contracten legaal zijn. De andere partij mag geen misbruik maken van je kwetsbare positie als persoon zonder wettig verblijf. Dat is strafbaar. Een voorbeeld: huisjesmelkerij mag niet. 24

27 Entering into contracts You are allowed to enter into contracts. For instance a lease contract, an insurance contract, an agreement. You may also open a bank account. Both parties can count on the legality of these contracts. The other party may not take advantage of your vulnerable position as an illegal resident. This is punishable by law. An example: sleep dealing, meaning housing exploitation is not allowed. 25

28 Belang van documenten Documenten zijn belangrijk in de Belgische maatschappij. Ze maken het contact met officiële diensten gemakkelijker. - Documenten van dienst vreemdelingenzaken, Commissariaat generaal voor de Vluchtelingen en Staatlozen, gemeente, politie, OCMW,... - Huurcontract, schoolattest en medische documenten 26

29 Lees documenten zorgvuldig en hou ze bij. Let goed op termijnen en datums voor afspraken. Zet duidelijk je naam op je brievenbus, zodat documenten zeker toekomen. 27

30 Importance of documents Documents are important in Belgian society. Contact with the authorities becomes easier if one has documents. - Documents of the Aliens Office, Commissioner General for Refugees and Stateless Persons, municipality, police, Centre for Social Welfare (OCMW),... - Lease contract, school certificate and medical documents 28

31 Carefully read the documents and keep them in a safe place. Carefully pay attention to the time limits and dates of appointments. Clearly write your name on your letterbox to make sure that documents arrive. 29
