The Committee recommends that the State party take all necessary measures to prevent drug and alcohol abuse. - Nood aan bijkomende aandacht aan alcoholgebruik bij jongeren en aan verslavingen in het algemeen.(alternatief rapport KiReCo) - Plus d informations doivent être proposées aux jeunes concernant les risques liés à certaines consommations notamment dans le cadre scolaire et via les médias. Ouders nemen een voorbeeldfunctie, ook zij dienen gestimuleerd te worden om verstandig om te aan met alcohol. (Vlaamse jeugdraad) - Geen voorstander verbod op verkoop van alcohol aan -16jarigen. Vraag tot aanvulling van deze wetgeving met meer doelgroepgerichte preventie en informatie. (Vlaamse jeugdraad) 1

2 C.O. n The Committee urges State party to: a) Continue to develop all components of a mental health care system for children and young people, including prevention, treatment of mental disorders in primary health care and specialized outreach services, so that demand for inpatient psychiatric facilities is reduced and children could receive needed services without separation from their families; b) Allocate human and financial resources at all levels of the mental health care system in order to shorten the long waiting list and ensure that children have access to the services they need; c) Ensure that children, when placed in inpatient mental health care institutions, are provided with appropriate information about their situation, including duration of their stay in psychiatric care, that they remain in contact with their families and the outside world, and that their views are heard and respected; d) Implement the mechanism of independent monitoring of rights of children in psychiatric care, in partnership with representatives of civil society, and investigate in transparent way all complaints and allegations of ill-treatment of children; and e) Investigate the phenomenon of over-prescription of psycho-stimulants to children and take initiatives to provide children diagnosed with ADHD, as well as their parents and teachers, with access to a wide range of psychological, educational and social measures and therapies. - Uitbreiding thuisopvang en ander opvangmodaliteiten. (KiReCo) - Nood aan holistische aanpak vanuit de rechten van het kind van de kinderpsychiatrie. (KiReCo alternatief rapport) - Transparanter, sterker gecontroleerd beleid mbt medicatiegebruik bij minderjarigen. (KRC/DGDE). - L accord du médecin conseil devrait être obligatoire sur base d un rapport médical pluridisciplinaire pour autoriser la délivrance de méthylphénidate. (alternatief rapport KRC/DGDE) - Beleid vormgeven vanuit multidisciplinair perspectief. (KRC/DGDE). - Nécessité d une augmentation du nombre des services spécialisés dans la prise en charge des enfants et de leur capacité. Certains mineurs ayant des problèmes psychiatriques ne reçoivent pas l aide adéquate et se retrouvent dans des institutions fermées en compagnie de jeunes délinquants et vice versa. (KRC/DGDE). C.O. n The Committee recommends that the State party review its legal framework to prevent the placement of children in institutions and to this aim, provide families with social and economical assistance for parenting and legal aid, if necessary. The Committee also recommends that the State party prioritize family-type care settings over institutionalized placements and periodically review placements as required under article 25 of the Convention. The Committee further draws attention to the Guidelines for the Alternative Care of Children contained in General Assembly resolution 64/142 adopted on 20 November

Pleegouders: geen juridische bevoegdheid omtrent dagelijkse opvoeding, worden niet altijd gehoord bij beslissingen omtrent pleegkind, geen contactrecht als pleegzorg stopt. Onkostenvergoeding wordt soms als inkomen beschouwd, wat het niet is. (Pleegzorg vlaanderen) - Nood aan alternatieven voor residentiële plaatsing met aandacht voor de meest kwestbare groepen en voor hun specifieke behoeften aangepast aan hun leeftijd. In geval van een armoedesituatie in het gezin krijgen tijdelijke plaatsingen vaak een langdurig karakter. hulp verandert in gedwongen interventie om financiële redenen. (KiReCo) - Oneigenlijke plaatsing van minderjarigen door een tekort aan opvangplaatsen. (Gezinsbond) C.O. n 45 The Committee recommends that the State party conduct comprehensive research on the reasons behind the long waiting lists to obtain appropriate social services. The Committee also calls upon the State party to promptly establish more childcare services and to ensure accessibility to all children regardless of their special educational needs or the socio economic status of their families. The Committee calls upon the State party to provide children with disabilities in childcare structures with the special assistance they need, and to ensure that childcare services are provided by trained staff and promote early childhood development, in light of principles and provisions of CRC. - Geestelijke gezondheidszorg: het aantal en de capaciteit van de gespecialiseerde zorgcentra verhogen. (KRC en DGDE) - Geestelijke gezondheidszorg: het aanbod gelijkmatig over het grondgebied verspreiden. (KRC en DGDE) - Tekort aan opvangplaatsen bij kinderopvang waardoor vooral de armsten getroffen worden. (KiReCo) - Dans la pratique les places d accueil pour la petite enfance réservées aux parents demandeurs d emploi ou en CDD, sont souvent attribuées aux enfants des travailleurs. 4 C.O. n 63 The Committee urges the State party to: a) Take all the necessary measures to implement the law prohibiting female genital mutilation; b) Undertake a study on the extent and nature of female genital mutilation practiced in Belgium or abroad on girls who live in Belgium and involve in this work NGOs that are active in this field; c) Organize information and awareness-raising programs, taking into account results of the study, to prevent this practice; and d) Strengthen its international cooperation towards the eradication of harmful traditional practices. - Il importe de disposer de données fiables concernant les pratiques telles que les MGF (mutilations génitales féminines) pour mieux identifier le problème, accentuer la prévention. Il importe également de renforcer la sensibilisation auprès des professionnels de la santé. (Alternatief rapport KRC/DGDE) C.O. n 65 The Committee recommends that the State party: a) Continue to focus on child poverty as a priority under its forthcoming European Union presidency; b) Conduct in-depth analysis of the complex determinants of poverty affecting children, its extent and impact, in order to develop evidence-based comprehensive poverty strategy underpinned by human rights. c) Adopt a multidimensional approach to strengthen the system of family benefits and child allowances, especially for disadvantaged families such as single-parent and families with many children and/or with unemployed parents; and d) Include homeless women and children as well as unaccompanied children of foreign origin as priority beneficiaries of its poverty strategy, including taking urgent and sustainable measures to provide them with appropriate housing and other services. Lutte contre la pauvreté en général: - Meer onderzoek naar omvang, beleving en impact van kinderen in armoede waarop beleidsaanbevelingen gebaseerd kunnen worden.(krc/dgde) - Topprioriteiten overheid: volwaardig levensniveau en degelijke huisvesting voor alle families. (KiReCo) - De façon générale, la lutte contre la pauvreté devrait être intensifiée par : un soutien financier et alimentaire plus important aux plus démunis, via des restaurants sociaux, plus de lieux d hébergement et la réquisition de bâtiments inoccupés, l accès à l énergie à moindre prix, une redistribution des richesses, l accès à la mobilité, la création d emploi, une réelle gratuité de l école et l égalité des chances. (alternatief rapport WDYTh) - Meer afstemming federaal beleid en beleid gemeenschappen en gewesten, met betrekking tot gezondheidszorg, huisvesting, aanpak thuisloosheid, energiebeleid. 4

5 - Toegankelijker en automatisch ondersteuningsbeleid (toelagen en tussenkomsten) voor gezinnen. Hiertoe: coördinatie tussen de bevoegdheidsniveaus. (Gezinsbond) - Verhogen laagste inkomens (ook leefloon) opdat ieder een inkomen boven de armoededrempel zou genieten (OCMW s nationaal) + verhoging federale tussenkomst in leefloon tot 90% voor alle OCMW s. - Kinderbijslag verhogen en welvaartsvast maken en gelijkstellen voor elk kind, ongeacht beroepsstatuut rechtgevende ouder of gezinssamenstelling in nieuw samengestelde gezinnen (eerste fase); basisbijslag eerste kind gelijkschakelen met huidig bedrag tweede kind (tweede fase); leeftijdsbijslag op 18 jaar verhogen tot 100 EUR. (Gezinsbond) - Kraamgeld optrekken: elk kind evenveel als eerste kind. (Gezinsbond) - De kinderbijslag niet meerekenen voor schuldafbouw, voor gezinnen in schuldbemiddeling. (Gezinsbond) - In alle overheidstussenkomsten een gezinsmodulering inbouwen, zodat alle toelagen en andere tussenkomsten (bv ook oppervlakte sociale woning) worden bepaald in functie van het aantal kinderen. (Gezinsbond) - In alle bijdragen en belastingen eveneens een gezinsmodulering inbouwen met kortingen in functie van het aantal kinderen. (Gezinsbond) - Wettelijke beperking en betere controle op toestaan van kredieten, om overmatige schuldenlast tegen te gaan. (OCMW s nationaal en Gezinsbond) - Fiscale maatregelen: aanpassing huwelijksquotiënt, door de maximale overheveling uit te breiden in functie van het aantal kinderen of zorgbehoevende familieleden; ook bedrijfsvoorheffing en belastingvrije sommen moduleren. (Gezinsbond) - Voor gezinnen die hun belastingvoordeel voor kinderen ten laste niet volledig kunnen uitputten omdat hun inkomen te laag is: maximaal terugbetaalbare belastingkrediet verdubbelen. - Maandbedrag voor leefloners met gezinslast optrekken én gezinsmodulering toepassen (voorgestelde stijging: 269, 70 EUR per kind jonger dan 14 jaar; 449,50 EUR per kind ouder dan 14 jaar). (Gezinsbond) Armoede multidisciplinaire benadering, rekening houden met eenoudergezinnen - Objectieve huurprijsbepaling in functie van aard en kwaliteit woning. (OCMW s nationaal) - Centraal huurwaarborgfonds oprichten. (OCMW s nationaal). - Steun en snellere informatie aan OCMW s mbt hun begeleidingstaak t.a.v. dak- en thuislozen en hun bemiddelingstaak bij dreigende uithuiszetting. (OCMW s nationaal). - Harmonisering van de verschillende energiefondsen tot één stelsel dat de OCMW s ondersteunt in hun begeleidingsopdracht ter zake en ter stimulering van rationeler energieverbruik (OCMW s nationaal). Zie ook: idem + transparante prijsregulator voor gas, elektriciteit en water aan 6% BTW-regime (Gezinsbond) - Verplichting kredietinstellingen om transparante kredietaflossingstabellen aan de klant te bezorgen (mét, in geval van variabele rente, berekening van het worst case scenario), zodat die met kennis van zaken offertes kan vergelijken. (Gezinsbond) - Suppression de la TVA sur les redevances intervenant dans le prix de la fourniture d énergie, afin de limiter les conséquences sur les finances locales et donc in fine sur le contribuable. 6 C.O. n 57 The Committee urges the State party to take urgent targeted measures to monitor the health status of children from the most disadvantaged families in their first year of life, ensure access to health services to all children and encourage parents to seek health services that are available for their children. The Committee also recommends that the State party review health insurance systems in order to lower cost of health services for the most disadvantaged families. The Committee further recommends the State party to strengthen enforcement of the International Code of Marketing of Breastmilk Substitutes in all parts of State. - Automatische toepassing recht op derdebetalersregeling bij ambulante medische zorg voor < 25j. ten laste via ouders verzekerd.(dgde en KRC) - Invoeren van derdebetalersregeling in de ambulante gezondheidszorg als een recht op vraag van de patiënt (en niet langer vrije keuze arts) (OCMW s nationaal = Gezinsbond) - Sensibilisering met betrekking tot medische zorg. (DGDE en KRC) - Leefloon moet verder aangevuld kunnen worden in functie van het aantal kinderen ten laste (gezinsmodulering). (KRC/DGDE) - Automatisch toekennen en verhogen van kinderbijslagen die minimumkosten dekken. (DGDE en KRC) - Een procedure rond een collectieve schuldregeling die voor kinderen concrete garanties voorziet rond hun recht op een menswaardig bestaan en hun recht op ontwikkeling. (KRC en DGDE) - Nood aan een betere coördinatie van de verschillende beleidsdomeinen die een impact hebben op gezondheidsindicatoren. (alternatief rapport KiReCo) - Overleg en nauwe samenwerking met de verzekeringssector is nodig om te streven naar een goede uitvoering van de wet van 21 januari 2010 tot wijziging van de wet van 25 juni 1992 op de landverzekeringsovereenkomst wat de schuldsaldoverzekeringen voor personen met een verhoogd gezondheidsrisico betreft en naar een meer gelijkwaardige toegankelijkheid tot andere levensverzekeringen bv. hospitalisatieverzekering. (Centrum voor gelijkheid van kansen en racismebestrijding) - Remgeld inkomensafhankelijk en gezinsgemoduleerd maken. (Gezinsbond) - Kostenloze eerstelijnsgezondheidszorg tot 18 jaar. (Gezinsbond) - Automatisch toekennen OMNIO-statuut aan rechthebbenden. (OCMW s nationaal en Gezinsbond) - OMNIO-statuut voor alle gezinnen in armoede of in schuldoverlast. (Gezinsbond) - Meer medische kosten opnemen in maximumfactuur + verlaging maximumplafond voor kinderen. (Gezinsbond) - Transparante ziekenhuisfactuur. (OCMW s nationaal) - Rem zetten op aanrekenen supplementen. (OCMW s nationaal) - Zorgverlof: anciënniteitsvoorwaarde verlagen van 1 jaar naar 6 maanden, flexibler opneembaar maken (op 1/3 of ¼ basis), bij acute ziekte zelfs opname van zorgverlof van week tot week toelaten, vergoeding verhogen tot minstens hoogte gewaarborgd minimumloon (en toeslag voor eenoudergezinnen). (Gezinsbond) - Toegang tot verzekeringen verbeteren door het systeem van een tariferingsbureau toe te passen op (schuldsaldoverzekeringen en) hospitalisatieverzekeringen voor personen met een ziekte of handicap + rem op ongecontroleerde stijgingen. (Gezinsbond) - NAP milieu en gezondheid voor kinderen, met o.m. aandacht voor pesticiden en chemische stoffen in huis en chemicaliën in speelgoed. 6
