1 Supplement 0o. jj to Cije $ale0tme (0a$ette $o of 29ty august, DEFENCE (FINANCE) (AMENDMENT) REGULATIONS (No. 2), MADE UNDER THE EMERGENCY POWERS (COLONIAL DEFENCE) ORDER IN COUNCIL, 1939, AND THE EMERGENCY POWERS (DEFENCE) ACT, IN EXERCISE of the powers vested in him by Article 3 of the Emergency Powers (Colonial Defence) Order in Council, 1939, and the Emergency Powers (Defence) Act, 1939, the High Commissioner has made the following Defence Regulations : 1. These regulations may be cited as the Defence (Finance) (Amendment) Regulations (No. 2), 1940, and shall be read as one with the Defence (Finance') Regulations., 1940, hereinafter referred to as the principal regulations. 2. (1) Regulation 4 of the principal regulations shall be amended as follows, that is to say : (a) sub-paragraph (aa) of paragraph (1) thereof shall be deleted; (b) in sub-paragraph (ab) of paragraph (1) thereof the words "transfer any security" shall be deleted; and (c) at the end of sub-para graph (6) of paragraph (6) thereof there shall be inserted the words "a unit or sub-unit of a unit trust and a coupon representing dividends or interest". (2) Proceedings in respect of a contravention, before the date of coming into force of this regulation, of any provision of regulation 4 of the principal regulations may be instituted, and any punishment imposed in any such proceedings may be enforced, as if this regulation had not been made. 3. After regulation 4 of the principal regulations there shall be inserted the following regulations as regulations 4A and 4B : 1147

2 1148 "Restrictions 4A. (1) Subject to any exemptions which may be granted by upon transfer order of the High Commissioner, no person shall, either on his own behalf or on behalf of any other person, agree to transfer or acquire, or transfer, or acquire otherwise than by operation of law or inheritance, any securities or any interest in securities, unless the High Commissioner or a person designated by the High Commissioner for the purposes of this regulation is satisfied that no person resident outside Palestine has, immediately before the transfer, acquisition, or agreement, any interest in the securities : Provided that nothing in this paragraph shall prohibit (a) any agreement, transfer, or acquisition which is effected (b) with permission granted by the High Commissioner or by a person authorised by him or on his behalf, the transfer or acquisition of securities or any interest in securities in pursuance of a contract made before the date of coming into force of this regulation. (2) Subject to any exemptions which may be granted by order of the High Commissioner, no person shall, except with permission granted by the High Commissioner or by a person authorised by him or on his behalf - (a) (b) (c) transfer any security or create or transfer any interest in a security to or in favour of a person resident outside Palestine ; transfer any security from a register in Palestine to a register outside Palestine, or do any act which is calculated to secure, or forms part of a series of acts which together calculated to secure, the substitution for any security which is either in or registered in Palestine of any security which is either outside or registered outside Palestine; procure that, in any register or book in which securities are registered or inscribed, an address outside Palestine shall, except by way of substitution for another such address, registered in respect of any security. In this paragraph the expression "security" includes a coupon representing dividends or interest. (3) Subject to any exemptions which may be granted by order of the High Commissioner, no person who holds any securities as trustee or agent shall, except with permission granted by the or or by are be High Commissioner, or by a person authorised by him or on his behalf, do any act whereby he recognises or gives effect to the transfer of those securities or the creation or transfer of any interest therein by, to, or in favour of a person resident outside Palestine : Provided that nothing in this paragraph shall restrict the doing of any act for the doing of which permission has been granted to any person by the High Commissioner or by a person authorised

3 1149 by him or on his behalf under any other paragraph of this regulation, or the doing of any act recognising or giving effect to any transaction for which permission has been so granted or which has been entered into before the date of coming into force of this regulation. (4) Subject to any exemptions which may be granted by order of the High Commissioner, no person shall, except with permission granted by the High Commissioner or by a person authorised by him or on his behalf, enter any transfer of securities in any register or book in which those securities are registered or inscribed unless there has been produced to him such evidence that the transfer does not involve a contravention of this regulation as may be prescribed by instructions issued by or on behalf of the High Commissioner. (5) In this regulation the following expressions have the meanings hereby respectively assigned to them, that is to say : "acquire by inheritance" means acquire in the capacity of beneficiary under a will or intestacy, or in the capacity a personal representative of a deceased person; and a of "security" includes a deposit receipt in respect of the of securities; deposit and for the purposes of this regulation an interest in securities does not include an interest in expectancy on the determination of a life, or any interest merely as a trustee. 4B. Subject to any exemptions which may be granted by order of the High Commissioner, no person shall, except with permission granted by the High Commissioner or by a person authorised by him or on his behalf, issue any bearer bond, share warrant to bearer, or other document of title by the delivery of which the title to securities or to any interest in securities is transferable : Restriction upon issue.of documents of title relating to securities. Provided that nothing in this regulation shall restrict the issue of any such document of title for the purpose of replacing any such document which has been lost or destroyed." 4. The principal regulations are hereby amended by the addition thereto of the following regulation as regulation 14 : "Interpretation.!4. The Interpretation Ordinance (Cap. 69) shall apply to the interpretation of these regulations and of any Orders made thereunder, as it applies to the interpretation of an Ordinance." IT IS HEREBY NOTIFIED that, in exercise of the powers vested in the High Commissioner by section 2 of the Land (Expropriation) Ordinance, the High Commissioner has certified that the construction of a Coast Guard Station at Al Jura in the Sub-District of Gaza is an undertaking of a public nature within the meaning of section 2 of the Land (Expropriation) Ordinance. A plan of the land affected may be inspected at the offices of the District Commissioner, Gaza, and the Director of Land Registration, Jerusalem. By His Excellency's Command, J. S. IT IS HEREBY NOTIFIED that, in exercise of the powers vested in him by section 2 of the Land (Expropriation) Ordinance, the High Commissioner has certified that the establishment by the Municipal Corporation of Haifa of a public park in the Eastern Quarter of Haifa between the Salah-ed-Diri Road and Neveh Shaanan Road is an undertaking of a public nature within the meaning of the Land (Expropriation) Ordinance. These rules may be cited as the Workmen's Compensation (Amendment) Rules, 1940, and shall be read as one with the Workmen's Compensation Rules, hereinafter referred to as the principal rules. 2. Sub-rule (1) of rule 4 of the principal rules is hereby revoked and replaced as follows : "4. (1) Every employer who is engaged in (a) building operations as defined in paragraph 1 of the First Schedule to the Ordinance, or (b) transport by railway and motor vehicles, or (c) mining and quarrying, or (d) manufacturing operations in which mechanically driven machinery is used, or (e) the generation or distribution of electricity, or any works connected with public supply of water, and public drainage schemes, or (/) construction and maintenance of roads, or (g) handling of goods at docks and quays, or (h) handling of goods at lighters and on board ships, or

This Order may be cited as the Control of Timber (Haifa) Order, In this Order timber means all wood, whether cut or fashioned or hollowed out for any purpose. 3.. Not more than 3,000 cubic metres of timber shall be stacked at any one time within the Town Planning Area of Haifa. 4. Timber shall not be stacked in piles of more than 100 cubic metres in each pile.

16 Each pile of timber, not exceeding 100 cubic metres, shall be surrounded by a fire-resisting fence constructed to the satisfaction of the District Commissioner, Haifa. 6. IN EXERCISE of the powers vested in him by section 23 (p) and (q) Cap. 128, 0f the Road Transport Ordinance, the High Commissioner has made the following rules: 1_ v 1. These rules may be cited as the Road Transpor^^Damiya? Bridge) Rules, y ^ 2. In these rules "Damiya Bridge" means tfhe bridge crossing the Jordan River on the road leading from Nablus to Trans-Jordan. 3. No vehicle of which the laden weight exceeds 15 tons shall be driven over the Damiya Bridge. 4. No vehicle shall be driven across the Damiya Bridge at a speed in excess of 20 kilometres per hour. 5.
