5 Bureau KLB, 8 juli 2013 Monitoronderzoek EU-GHS/CLP 2013 Monitoronderzoek EU-GHS 2013 Samenvatting Op 20 januari 2009 is de Europese verordening voor de indeling, etikettering en verpakking van stoffen en mengsels (1272/2008/EG) 1 gefaseerd in werking getreden. De regels voor stoffen gelden vanaf 1 december Per 1 juni 2015 worden verplichtingen voor mengsels van kracht. Het ministerie van VWS is verantwoordelijk voor de invoering van de verordening in Nederland. De NVWA coördineert de voorlichting over de verordening en heeft de uitvoering daarvan neergelegd bij de Kenniscentrum InfoMil van Rijkswaterstaat (RWS) Leefomgeving. De tot dusver gehanteerde voorlichtingsstrategie gaat uit van een gedeelde verantwoordelijkheid van overheid en intermediaire organisaties. De overheid voorziet daarbij, in afstemming met intermediairs, in voorlichtingsmateriaal en ondersteuning. Vervolgens nemen deze intermediairs in het bijzonder de brancheorganisaties de voorlichting en ondersteuning van bedrijven voor hun rekening en verstrekken zij branchespecifieke informatie. Dit vanuit de gedachte dat zij zelf beter de behoefte van hun achterban kunnen beoordelen. Om het voorlichtingstraject verder en onderbouwd vorm te kunnen geven, heeft RWS Leefomgeving Bureau KLB gevraagd een monitoronderzoek bij branches en bedrijven uit te voeren naar de stand van zaken met betrekking tot de invoering van EU-GHS/CLP. Dit rapport beschrijft de resultaten van het onderzoek, uitgevoerd in de lente van In deze samenvatting geven we de bevindingen, conclusies en aanbevelingen 2 op hoofdlijnen weer. Het monitoronderzoek Doel- en vraagstelling Doel van het onderzoek is om zicht te krijgen op: de mate waarin branches en bedrijven die per 1 juni 2015 met de EU-GHS / CLP verplichtingen te maken krijgen, hiervan op de hoogte zijn, wat zij in verband hiermee hebben ondernomen, en wat hieruit af te leiden is qua eventueel benodigde verbetering van de voorlichtingstrategie. Het onderzoek heeft zich in het bijzonder gericht op de nieuwe verplichtingen met betrekking tot mengsels, voor bedrijven die in de keten de rol vervullen van importeur, formuleerder en distributeur. Verder zijn in de beschouwing meegenomen de indirecte met EU-GHS samenhangende verplichtingen voor bedrijven in hun werkgeverrol, die voortvloeien uit de Arbowet. In verband met dat laatste zijn ook bedrijven in het onderzoek betrokken die in de keten de rol van eindgebruiker vervullen. Voor de goede orde: voor veel bedrijven geldt dat ze simultaan meerdere van deze rollen vervullen. 1 In het Engels aangeduid met Classification, Labelling and Packaging, CLP; in Nederland aangeduid met de werktitel EU-GHS. 2 In dit rapport worden aanbevelingen aan de overheid gedaan. 6 Monitoronderzoek EU-GHS/CLP 2013 Bureau KLB, 8 juli 2013 Werkwijze en verantwoording Het onderzoek is uitgevoerd door middel van interviews met brancheorganisaties (in totaal 16) en telefonische enquêtes bij bedrijven (in totaal 301) in de sectoren waar in het bijzonder de nieuwe verplichtingen gaan gelden. De steekproeftrekking onder bedrijven was erop gericht een gelijkmatige verdeling te verkrijgen over de verschillende rollen en over wel- en niet-leden van brancheorganisaties. Daarnaast was het doel een wat kleinere groep eindgebruikers te betrekken, gezien de beperktere hoeveelheid nieuwe verplichtingen voor deze groep. Om dit te realiseren zijn bedrijven langs verschillende wegen geselecteerd: vanuit sectoren waarin de verschillende rollen relatief vaak voorkomen, via de ledenlijsten van brancheorganisaties, via bij de Kamer van Koophandel aangeschafte adreslijsten en langs andere wegen (o.m. mystery shopping, suggesties van experts). Omdat bedrijven simultaan meerdere rollen kunnen vervullen, zijn er in de uiteindelijke steekproef beduidend meer rollen vertegenwoordigd dan de 301 bedrijven waar het feitelijk om gaat. Alleen al het overzicht van het aantal vertegenwoordigde rollen laat zien dat de beoogde verscheidenheid goed is gerealiseerd: 63 bedrijven vervullen de rol van importeur, 135 de rol van formuleerder, 189 de rol van distributeur en 195 de rol van werkgever. Voor een scherper beeld van de steekproef zijn de bedrijven in vier groepen onderscheiden: (1) de groep bedrijven die formuleert, (2) de groep (niet-formulerende) bedrijven die importeert, (3) de groep (niet-importerende) distributeurs, en (4) de groep bedrijven die alleen mengsels gebruikt en die werkgeversverplichtingen heeft. Binnen de groep niet-importerende distributeurs kunnen we nog de omverpakkers en de groothandels onderscheiden (waarvoor verschillende verplichtingen gelden). Tabel 1 laat zien dat een goed gespreide groep is bevraagd. Tabel 1. Daarvan waren er 125 (technisch) onbereikbaar, zodat de bruto non-respons 250 bedrijven 6

Voorts was bij 105 bedrijven sprake van een reden om de vragenlijst niet af te nemen, waarvan de belangrijkste (bij 90 bedrijven) was dat men van mening was dat EU-GHS voor het betreffende bedrijf niet van toepassing was. Zodoende bedroeg de netto non-respons (weigering) 145 bedrijven, ofwel 26% van het totaal. Er kan zodoende gesproken worden van een goede random steekproef met weinig verstoring op grond van zelfselectie. Dit wekt de indruk dat EU-GHS bedrijven niet onverschillig laat. De brancheorganisaties De bekendheid van de brancheorganisaties met de aankomende EU-GHS wetgeving verschilt per sector maar volgt op grote lijnen de onderstaande driedeling. Een aantal brancheorganisaties is directe deelnemer aan diverse stoffenbeleidstafels. Voor een groot deel vertegenwoordigen zij formulerende branches met stoffen als core business, maar ook de handel en een enkele gebruikersbranche is vertegenwoordigd. Deze organisaties hebben veel inhoudelijke kennis, voorlichting naar de leden (waaronder over EU-GHS) is een standaard onderdeel van de activiteiten. Een tweede groep brancheorganisaties is vooral indirect aangesloten bij het beleidsnetwerk rondom stoffen. Stoffenwetgeving is één van de aspecten die de brancheorganisatie behartigt. Het gaat hier veelal om branches waar de focus op de handel en/of het gebruik ligt. De kennis bij de brancheorganisatie is globaler van karakter. Deze brancheorganisaties zijn minder of nog niet actief met voorlichting, maar zijn wel bezig deze concreet voor te bereiden. Een derde groep brancheorganisaties houdt zich terzijde met stoffenregelgeving bezig. Deze organisaties zijn aan te treffen in branches waar de kernactiviteit handel of het toepassen van producten is. Voorlichting wordt te gelegener tijd overwogen. De door de branches gevraagde ondersteuning van de overheid is divers en sluit in het algemeen aan bij de lopende strategie en het beschikbare materiaal. Opvallend is dat een aantal branches niet op de hoogte is van de verschillende ondersteunende instrumenten waarin de overheid nu al voorziet, zoals de helpdesk en specifiek communicatiemateriaal. Bedrijven en EU-GHS /CLP De enquêtes onder de bedrijven waren er in het bijzonder op gericht vast te stellen wat zij anno april 2013 weten van hun verplichtingen onder EU-GHS/CLP. Dit kennisniveau is als volgt vastgesteld. Om te beginnen is de geënquêteerde bedrijven gevraagd naar hun concrete activiteiten. Aan de hand daarvan is door de interviewer vastgesteld welke rollen zij precies vervullen voor EU-GHS. Vervolgens is bedrijven gevraagd of ze weten wat EU- GHS is, en zo ja, of ze kunnen vertellen welke verplichtingen EU-GHS voor hen met zich meebrengt gezien de rollen die zij zoals eerder vastgesteld in de keten spelen. Nagegaan is of ze hier spontaan kennis van hebben. Zo nee, dan volgde nog een geholpen vraag (wist u dat ). Op deze manier is voor de maximaal negen verplichtingen die EU-GHS resp. de Arbo-wet met zich meebrengen (zie tekstkader hieronder), per bedrijf in kaart gebracht of deze (1) überhaupt geen kennis heeft van EU-GHS; (2) de betreffende verplichting op het bedrijf van toepassing is; (3) het bedrijf spontane, dan wel (4) geholpen kennis heeft van deze verplichting, (5) of niet. 7

Controle van juistheid werkplek opslag De figuur op de volgende pagina geeft dit kennispeil over de gehele steekproef weer. In het oog springt dat één derde van alle bedrijven onbekend is met EU-GHS. Minder dan de helft van de bedrijven op wie dit van toepassing is, kan spontaan de verplichtingen noemen om producten opnieuw in te delen, de etikettering te herzien en de werknemers daarover te informeren. De overige verplichtingen zijn minder bekend. De verplichtingen om informatie 10 jaar te bewaren en aan het NVIC aan te leveren, zijn het minst bekend. Slechts enkele procenten van de bevraagde bedrijven kunnen dit spontaan noemen. 3 De verplichting om stoffen te melden aan ECHA geldt ook voor stoffen geproduceerd in de Economische ruimte (EER), maar is voor dit onderzoek niet relevant. 8

10 Monitoronderzoek EU-GHS/CLP 2013 Bureau KLB, 8 juli 2013 Nadere analyse van deze bevindingen levert het volgende op: Formuleerders zijn het best op de hoogte van hun verplichtingen, op de hielen gevolgd door importeurs. Distributeurs zijn beduidend minder goed op de hoogte. Eindgebruikers zijn relatief slecht op de hoogte van EU-GHS, maar zij die dat wel zijn kunnen relatief goed aangeven hoe deze in de verplichtingen van de Arbowetgeving doorwerken. Leden van brancheorganisaties zijn relatief beter op de hoogte dan niet-leden. Bedrijven die actief zijn op de business to business markt, zijn gemiddeld beter op de hoogte dan bedrijven die (ook) op de consumentenmarkt actief zijn. Al met al is de indruk dat bedrijven beter van hun EU-GHS verplichtingen op de hoogte zijn naarmate ze de omgang met stoffen meer als kernactiviteit hebben en bij een brancheorganisatie zijn aangesloten. Een vergelijking op sectorniveau bevestigt deze algemene bevindingen, zoals te zien is in onderstaande figuur. Zichtbaar is dat het kennispeil het laagst is in sectoren waar bedrijven actief zijn in de handel van chemische producten voor eindgebruikers en waar deze bedrijven zich niet in een brancheorganisatie verenigd hebben. EU-GHS/CLP Ook hebben we bedrijven gevraagd naar hun huidige activiteiten in relatie tot EU-GHS, hun belangrijkste informatiebronnen en hun behoefte aan ondersteuning. 10

11 Bureau KLB, 8 juli 2013 Monitoronderzoek EU-GHS/CLP 2013 Huidige inzet bedrijven Driekwart van de bedrijven die bekend zijn met de EU-GHS regelgeving, zegt op dit moment bezig te zijn om op tijd aan de nieuwe verplichtingen te voldoen. De activiteiten zijn divers, van voorbereidende activiteiten tot implementatie. Informatiebronnen Voor bedrijven die bekend zijn met EU-GHS is de brancheorganisatie veruit de belangrijkste informatiebron over deze wetgeving. Men noemt zowel de organisatie zèlf alsook de bijeenkomsten, het voorlichtingsmateriaal en de vakbladen waarin door de brancheorganisatie wordt voorzien. Op het web noemt men de ECHA website als belangrijke bron. Bedrijven die niet bekend zijn met EU-GHS, noemen leveranciers vaak als informatiebron over nieuwe wetgeving. Maar ook de brancheorganisatie wordt vaak door hen genoemd. Nieuwsbrieven, voorlichtingsmateriaal en vakbladen spelen voor deze bedrijven minder een rol. Ondersteuningsbehoefte Veertig procent van alle bedrijven geeft aan behoefte te hebben aan verdere ondersteuning; deze wens is het grootst bij bedrijven die nu nog onbekend zijn met EU-GHS. Bij het gewenste type ondersteuning ligt de nadruk sterk op een goede website en goede uitleg op papier. Conclusies en aanbevelingen De bekendheid met EU-GHS en de aanstaande verplichtingen is wisselend. Naarmate bedrijven de omgang met stoffen meer als core business hebben en aangesloten zijn bij een brancheorganisatie, zijn ze gemiddeld beter op de hoogte. De meeste brancheorganisaties zijn bewust bezig met voorlichting over EU-GHS. In een aantal gevallen betekent dit dat ze bedrijven al lange tijd actief aan het informeren zijn (en bedrijven dus bewust bekend zijn). In andere gevallen treffen ze concrete voorbereidingen om binnenkort met voorlichting te beginnen. En weer andere brancheorganisaties zijn nadrukkelijk aan het kijken naar het goede moment en de precieze toegevoegde waarde van voorlichting (in deze gevallen zijn bedrijven dus bewust onbekend ). De meeste brancheorganisaties zetten dus gericht in op bij de sector passende maatvoering in de communicatie. De conclusie is dan ook dat voor deze sectoren de gehanteerde getrapte voorlichtingsstrategie goed lijkt te werken. Daar staat tegenover dat in sectoren waar bedrijven niet bij een brancheorganisatie zijn aangesloten en het werken met stoffen niet core business is, het kennispeil bij bedrijven laag is. Er is daar ook geen reden om te verwachten dat die bekendheid de komende tijd gaat verbeteren (men is onbewust onbekend ). Een getrapte voorlichtingsstrategie gaat hier minder goed werken. Ook heeft de indirecte voorlichtingsstrategie tot gevolg dat bedrijven en branches die iets meer op afstand staan niet op de hoogte zijn van de voorlichtingsmiddelen die de overheid ter beschikking heeft gesteld, zoals de EU-GHS helpdesk, de website en de daarop aanwezige hulpmiddelen. 11

De eerste daarvan betreft de relatief sterke onbekendheid van bedrijven met de bewaarplicht van gegevens en de informatieverplichting aan het NVIC. De tweede betreft de interpretatieproblemen die sectoren en bedrijven kunnen hebben wanneer zij werken met verpakkingen die andere vormen aannemen dan de reguliere verpakkingen (zoals bijv. pallets, plasticfolie, betonmortelwagens) en die zij alleen in samenspraak met de overheid kunnen oplossen. Aanbevelingen Continueer de huidige succesvolle aanpak in samenspraak met actieve brancheorganisaties, met oog voor hun specifieke wensen Denk met de brancheorganisaties mee over timing en inhoud van de communicatie richting bewust onbekende bedrijven Voorzie in een aantal door de brancheorganisaties gewenste communicatieinstrumenten èn in (qua toepasbaarheid in ketencommunicatie en qua aard van de boodschap) strategisch gekozen communicatiehulpmiddelen Overweeg een aanvullende, waar nodig gedifferentieerde, communicatiestrategie om de onbewust onbekende bedrijven gericht te bereiken Stimuleer een goede ketencommunicatie om de onbewust onbekende bedrijven gericht te bereiken en faciliteer dit met een op de doelgroep gerichte strategie en middelen Besteed in de communicatie extra aandacht aan de verplichtingen tot het bewaren van gegevens en het verstrekken van informatie aan het NVIC Bevorder de bekendheid van de EU-GHS helpdesk, de betreffende website en de daarop aanwezige informatiemiddelen Ondersteun sectoren bij specifieke interpretatieproblemen van EU-GHS, bijvoorbeeld waar de verpakking afwijkt van de gebruikelijke verpakkingsmiddelen 12

13 Bureau KLB, 8 juli 2013 Monitoronderzoek EU-GHS/CLP 2013 Monitoring research project EU-GHS/CLP 2013 Executive summary On January 20 th 2009 the European Regulation for Classification, Labelling and Packaging (CLP) 4 has come into force in phases. The obligations concerning substances came into force on December 1 st On June 1 st 2015 the new obligations concerning mixtures will come into force. The Dutch Ministry of Health, Welfare and Sport is responsible for the implementation of this Regulation in the Netherlands. The Netherlands Food and Consumer Product Safety Authority coordinates the information about the Regulation. It has commissioned Kenniscentrum InfoMil at Rijkswaterstaat (RWS) Leefomgeving to carry out the information work. The information strategy that has been applied thus far is based on a division of roles between the authorities and intermediary organizations. The authorities in coordination with the intermediary organizations provide information material, instruments and general support. The latter particularly the branch associations act as the direct information point and support their member companies by providing them with sector specific information. This is based on the idea that branch associations have the best insights in the needs of their member companies. In order to further shape and underpin the information strategy, RWS Leefomgeving commissioned Bureau KLB to carry out a monitoring research project among branch associations and companies to provide insight into the state of affairs with respect to the introduction of EU-GHS/CLP. This report describes the outcome of this research, which was carried out in the spring of This executive summary outlines the main findings, conclusions and recommendations. 5 The monitoring research project Goal and questions The goal of this research project is to provide insight into: the extent to which branches and companies that are affected by the new EU-GHS/CLP obligations per June 1 st 2015, are aware of this upcoming regulation, the actions they have undertaken in this respect, and the implications of this in terms of required improvements in the information strategy. The research project focused in particular on the new obligation concerning mixtures, for companies that fulfill the roles of importers, formulators and distributors. Also the indirect obligations following from EU-GHS were included, directed at employers and originating from the Working Conditions Act. Therefore also companies were addressed in the research project that fulfill the role of professional end-user. To be clear: many companies fulfill several of these roles simultaneously. 4 In Dutch this regulation is referred to with to the working title EU-GHS. 5 The recommendations in this report are addressed to the authorities. 14 Monitoronderzoek EU-GHS/CLP 2013 Bureau KLB, 8 juli 2013 Method and response The research project has been carried out by means of interviews with 16 branch associations and telephone surveys among 301 companies, in sectors in which the new obligations are particularly relevant. The sampling among companies aimed at establishing an even distribution over the different roles within the product chain (with a slight under-representation of end-users) and over members and non-members of branch associations. In order to realize this even distribution, companies were selected through different routes: through sectors where these roles are often represented, through membership lists of branch associations, through address lists acquired through the Chamber of Commerce and through other means (like mystery shopping and expert advice). Since companies often fulfill different roles simultaneously, considerably more roles are represented in the final sample than the 301 companies that are actually involved. The number of represented roles already demonstrates that the variety that was aimed for has been well achieved: 63 companies fulfill the role of importer, 135 the role of formulator, 189 the role of distributor and 195 the role of employer. For a clear insight into the sample, the companies have been divided into four groups: (1) the group of companies that formulate; (2) the group of (not-formulating) companies that import; (3) the group of (not-importing) distributors, and (4) the group of companies that only use mixtures and that have employer obligations. Within the group of not-importing distributors a further distinction is made between repackagers and wholesalers (who have different obligations). Of these companies, 125 were (technically) unreachable. Therefore the gross non-response amounts to 250 companies (45%). 105 Companies argued that they shouldn t be part of the sample. The most heard argument (from 90 companies) was that EU-GHS was not applicable to the specific company and its activities. Therefore, the net non-response (refusals) amounts to 145 companies, which is 26% of total. So, we can conclude that a good and random sample has been achieved with hardly any bias caused by self-selection. Apparently EU-GHS does not leave companies disinterested. The branch associations The level of familiarity of the branch associations with the upcoming EU-GHS obligations differs per sector. It roughly follows the three-division that is described below: A number of branch associations is directly involved in different policy making processes in the field of chemical substances. Most of these organisations represent sectors where companies are formulators deal with chemical substances as their core business. However, there are also some who represent trade or end user sectors. These associations have a high level of expertise in the field of chemical substances regulation. Providing information of (about for instance EU-GHS) to their member companies is a standard element of their service towards members. A second group of branch associations is more indirectly connected to the policy networks around chemical substances. Substances regulation is one of the many elements that these associations deal with. The activities of the member companies of these associations mostly concern trade and end-use. The associations have knowledge of this Regulation on a more general level. They are not yet (very) active in informing their members, but they are preparing for this. A third group of branch associations only deals with substances regulation from a distance. These associations are to be found in sectors where the core business is trade or end use of products. Information activities around EU-GHS are only considered as a possible future activity. From the interviews we find that the support branch associations request from the authorities is diverse. Often it is in line with the type of support that is already given and the type of material that is already developed as part of the present strategy. It is striking that some branch associations are not aware of the different supportive instruments the authorities already provide, e.g. the helpdesk and specific information material. Companies and EU-GHS /CLP The survey among companies was particularly aimed at gaining insight into the level of their awareness anno April 2013 of the obligations under EU-GHS/CLP. This was established as follows. Firstly the companies were asked about the nature of their activities. On this basis the interviewer concluded which roles the companies play in relations to EU- GHS. Next the companies were asked whether they know what EU-GHS/CLP is, and if so, whether they re able to name the specific obligations that apply to the roles they fulfil in the product chain as was previously established. If they weren t able to name them spontaneously, a helped question followed (did you know that ). This way it was established for all, maximum nine applicable obligations following from EU-GHS and the 15

16 Monitoronderzoek EU-GHS/CLP 2013 Bureau KLB, 8 juli 2013 Working Conditions Act (see the text box below) and for each separate company, whether (1) it is or is not aware of EU-GHS at all, (2) whether the respective obligations apply, and if so, (3) whether the company has spontaneous knowledge of this or (4) after being helped, (5) or not. Information for employees 8. Renewed workplace labelling 9. Appropriate workplace storage The figure on the next page shows the knowledge level for the whole sample. It shows that one out of three companies does not know what EU-GHS is. Less than half of the concerned companies are spontaneously able to name the obligations to renew the classification and labelling and to inform employees. Other obligations are less known. Least known are the obligations to retain information for 10 years and to supply data to the national poison centre. Just a few percent of the companies are able to name these obligations spontaneously. 6 In this survey only the notification obligation of importers is taken into account. 16

Importers are second best informed. Distributors are clearly less informed, End-users know relatively little of EU- GHS, but those who know about it are relatively well able to indicate in what way it affects their obligations under the Working Conditions Act. Members of branch associations are relatively better informed than non-members. Companies that are active on the business-to-business market are on average better informed than companies that are (also) active on the consumer market. On the whole, those companies that deal with substances (more) as part their core business and are member of a branch association are generally better informed of their EU-GHS obligations. A comparison at sector level confirms these conclusions, as can be seen in the figure below. The level of knowledge is lowest in sectors where companies are active in trading chemical products for end-users and where they are not united in a branch association. Figuur 4. The activities are diverse, ranging from preparations to implementation. Information sources For companies that know about EU-GHS the branch associations are by far the most important sources of information about this regulation. Companies mention the associations themselves, as well as the meetings, the information material and the trade journals in which the associations provide. On the internet the ECHA website is named as the main source of information. Companies that do not know about EU-GHS often mention suppliers as a source of information about new legislation. Still, also the branch association is often referred to. Newsletters, information material and trade journals are less influential for these companies. Need for support Forty percent of all companies say they have a need for further support in complying with EU-GHS. Companies that do not know about EU-GHS state this need most often. The most favoured types of support are a good website and a good written explanation on paper. Conclusions and recommendations The level of knowledge about EU-GHS and the upcoming obligations among Dutch companies is varying. Companies that deal with substances (more) as part their core business and are member of branch associations, are on average more aware of their obligations. Most branch associations are consciously planning their information activities on EU-GHS. In some cases this means they have been informing their members already for a longer time (in which cases these companies are intentionally aware ). In other cases associations are taking measures to start information activities shortly. Yet other associations are carefully planning the most effective moment for, and the exact added value of providing information. In the latter cases the companies could be named intentionally unaware. It can be concluded that almost all branch associations are deliberately aiming for communication that is well-tailored to their sectors needs. For these sectors the indirect information strategy that was set out by the authorities and the intermediary organisations together, appears to be effective. On the other hand, however, there are numerous companies that do not deal with substances as their core business and that operate in sectors where no branch association is active. On average, these companies know little of EU-GHS. And there is no reason to expect that this knowledge will improve in the upcoming period. These companies are, so to speak, unintentionally unaware. This is where an indirect information strategy appears to be less effective. Another possible downside of an indirect information strategy is that individual companies, as well as branch associations that are less connected to the policy network, are hardly 19

20 Monitoronderzoek EU-GHS/CLP 2013 Bureau KLB, 8 juli 2013 aware of the availability of information material and support that the authorities provide, like the EU-GHS helpdesk, the website and all of its contents and instruments. Finally, there are two content related conclusions. The first one is that the overall level of familiarity of companies with their obligations to retain product information and to inform the National Poison Centre, is low. The second one is that some sectors and companies that work with means of packaging that differ from the regular material (and that do not use cans and bottles but, say, pallets, foils, concrete mortar mixers), are faced with interpretation problems concerning the applicability and consequences of EU-GHS. These issues need to be addressed in cooperation with the authorities. Recommendations Continue with the present successful approach in concertation with active branch associations, with an eye to their specific wishes Act as a sparring partner for branch associations that are considering and planning the timing and content of their communication towards intentionally unaware companies Provide the communication instruments that associations ask for. Also, develop some instruments with strategic potential (for application in product chain information; possibly with specific types of messages) Consider an added, if necessary differentiated, direct communication strategy for a targeted outreach to unintentionally unaware companies Stimulate an effective product chain information flow that also reaches unintentionally unaware companies. Facilitate this communication with a target group oriented strategy and means Place emphasis on the obligations to retain product information and to inform the national poison centre Make the existence more public of the EU-GHS helpdesk, the website and its content Provide support to sectors that have specific interpretation problems with EU-GHS, for instance where packaging means differ from the regular ones. 20
