Yes No If yes, please provide details of the measures taken: In het Landelijk afvalbeheerplan is aangegeven voor welke afvalstoffen Nederland zelfvoorziening nastreeft. Er is slechts zelfvoorziening voor het storten van afvalstoffen. Nederland verbiedt in beginsel zowel de uitvoer als de invoer van afvalstoffen waarvoor de beoogde verwerking een handeling is als vermeld onder D1. Het niet voldoen aan deze bepalingen is strafbaar. De wetgeving voorziet zowel in de mogelijkheid van administratief rechterlijke sancties als in strafrechterlijke sancties. 3

Het aantal illegale zaken dat in bijlage V is opgenomen is 213. Dit aantal is exclusief de overtredingen, zoals ontbreken bijlage VII, die door de diensten zelfstandig zijn afgehandeld (dit zijn enkele tientallen veelal door politie afgehandelde zaken). Art. 6 Art. 55 Information on a financial guarantee or equivalent insurance covering costs for transport, recovery or disposal and storage of waste, including cases referred to in Articles 22 and 24 Please provide details on the provisions of national law adopted pursuant to this Article: In Nederland is de Regeling EG-verordening overbrening afvalstoffen ingevoerd waarin de hoogte van de financiële zekerheid is geregeld. Voor diverse Euralcodes gelden vaste bedragen. Tevens gelden voor opslag en transport vaste bedragen. Kennisgevers kunnen onderbouwd verzoeken om verlaging van de te stellen zekerheid per ton in overbrenging zijnd afval als er voor dat afval geen vast bedrag is vastgesteld. Indien men om verlaging vraagt, wordt in een afzonderlijk besluit vermeld hoeveel zekerheid er per ton afval dient te worden gesteld. De kennisgever bepaalt zelf voor hoeveel ton afval hij een financiële zekerheid stelt. De financiële zekerheid kan in de vorm van een bankgarantie, een deposito of een verzekering. Verzekeringen zijn noch aangeboden noch geaccepteerd omdat de eis wordt gesteld dat op eerste verzoek van de autoriteit het verzekerde bedrag aan de autoriteit beschikbaar moet worden gesteld.
