In het licht van de besprekingen in het Comité van permanente vertegenwoordigers op 11 mei en van de Groep zeescheepvaart op 15 juni heeft het voorzitterschap een herziene versie opgesteld van bijgaande ontwerp-brief inzake de kennisgeving aan de IMO van Verordening nr. 417/2002 betreffende het versneld invoeren van de vereisten inzake een dubbelwandige uitvoering of een gelijkwaardig ontwerp voor enkelwandige olietankschepen, alsmede inzake het besluit om wat de Europese wateren betreft geen gebruik te maken van de afwijkingen in voorschrift 13G (nieuwe nummering: voorschrift 20), punt 7, en voorschrift 13H (nieuwe nummering: voorschrift 21), punten 5, 6 en 7. Gelijktijdig met deze kennisgeving zullen ook de lidstaten 1 aan de IMO kennis geven van hun besluit om voor schepen die hun vlag voeren geen gebruik te maken van de afwijkingen als bepaald in voorschrift 13H (nieuwe nummering: voorschrift 21), punten 5, 6 en 7. 1 Met uitzondering van de Griekse delegatie, die zich tegen dit besluit heeft uitgesproken. 10199/05 ier/gra/dm 1 DG C III NL

In accordance with Article 211, paragraph 3 of the United Nations Convention on the Law of the Sea, the amended Regulation (EC) N 417/2002 introduces into Community Law certain provisions related to the accelerated phasing-in of double hull or equivalent design requirements for single hull oil tankers of 5 000 tonnes deadweight and above entering or leaving a port or offshore terminal or anchoring in an area under the jurisdiction of a EU Member State, irrespective of their flag, or flying the flag of a Member State; the prohibition to enter or leave ports or offshore terminals or to anchor in areas under the jurisdiction of a EU Member State of oil tankers of 600 tonnes deadweight and above carrying heavy grades of oil, irrespective of their flag, unless such tankers are double-hull oil tankers; the compliance with the Condition Assessment Scheme (CAS) for all single-hull oil tankers above 15 years of age. A category 2 and category 3 ship shall not be allowed to enter or leave ports or offshore terminals or anchor in areas under the jurisdiction of a EU Member State unless it complies with the Condition Assessment Scheme adopted by MEPC Resolution 112(50) of 4 December 2003 and with the subsequent amendments to the CAS that the Marine Environmental Protection Committee may adopt. Furthermore, the amended Regulation (EC) N 417/2002 adequately implements the revised Annex I to MARPOL 73/78, Regulations 13G and 13H (Regulations 20 and 21 new numbering), the consequential amendments to the IOPP Certificate and the amendments to the Condition Assessment Scheme adopted by resolutions MEPC 111(50) and MEPC 112(50) of 4 December 2003, for all EU Member States. Consequently, the 25 Member States of the EU have each decided to refrain from making use of the provisions of paragraph 7 of the amended regulation 13G (Regulation 20 new numbering) for oil tankers entitled to fly their flags, and are informing the IMO accordingly. 10199/05 ier/gra/dm 4
Moreover, the 25 Member States of the EU have each decided, and are informing the IMO accordingly, that they intend to make use of the provisions of - paragraph 8(b) of Regulation 13G (Regulation 20 new numbering) in order to deny entry into the ports or offshore terminals under its jurisdiction of oil tankers operating in accordance with the provisions of (i) Paragraph (5) of Regulation 13G (Regulation 20 new numbering) beyond the anniversary of the date of delivery of the ship in 2015 or (ii) Paragraph (7) of Regulation 13G. - paragraph 8(b) of Regulation 13H (Regulation 21 new numbering) in order to deny entry into the ports or offshore terminals under its jurisdiction, or deny ship-to-ship transfer of heavy grades of oil in areas under its jurisdiction, except when this is necessary for the purpose of securing the safety of a ship or saving life at sea, of oil tankers operating in accordance with the provisions of paragraph (5) or (6) of Regulation 13H (Regulation 21 new numbering).
