Als de verdeling van het uitvoerbare programma of broncode wordt gedaan door middel van het verlenen van toegang om te kopiëren vanaf een bepaalde plek, dan wordt het aanbod van gelijkwaardige toegang om de broncode te kopiëren vanop dezelfde plaats als een verdeling van de broncode beschouwd, hoewel derden niet gedwongen zijn om de broncode samen met de objectcode te kopiëren. 4.
