Deze markt staat volledig in het teken van alles dat met veiligheid te maken hee. Een aantal deelnemers aan deze markt vertelt in deze krant alvast iets over hun werk. Wat doen bijvoorbeeld de Koninklijke Marechaussee en de Douane? Waar houdt het Openbaar Ministerie zich mee bezig en wat is JICN? Veiligheid op Bonaire: Welzijn en Harmonie voor allen als doel Als gezaghebber hecht ik grote waarde aan veiligheid in een samenleving. Daarbij hanteer ik het liefst een brede definitie van de terminologie: het gaat niet alleen om veiligheid ten aanzien van criminaliteit. Het gaat ook om veiligheid in de zin van bescherming van de menselijke waarde en grondrechten. Dus: veiligheid in de zin van het zich gewaardeerd en gerespecteerd voelen, ten aanzien van de eigen identiteit, eigen initiatieven, eigen cultuur en waarden. Veiligheid voor het individu, maar ook voor organisaties en de samenleving. Veiligheid voor allen: ook voor de kwetsbare groepen. Als gezaghebber zie ik het als mijn taak om aan deze breed gedefinieerde veiligheid een bijdrage te geven. In de eerste plaats als plaatselijk hoofd van politie en als degene belast met de verantwoordelijkheid voor handhaving en toezicht, en de openbare orde in het algemeen. Waarborging van veiligheid behoort ook tot de taak van de gezaghebber daar waar het de rampenbestrijding en rampenpreventie betre. Als voorzi er van de Eilandsraad, kan ik de volksvertegenwoordigers bij staan in hun verantwoordelijkheid om de kaders te creëren voor beter welzijn en gevoel van veiligheid in de samenleving. De gezaghebber kan als voorzi er en volwaardig lid van het Bestuurscollege erop toezien en ertoe bijdragen dat in het bestuur van het Openbaar Lichaam de veiligheid en het welzijn van de burger een centrale plaats innemen. Het bestuur moet voldoen aan alle eisen van deugdelijkheid van bestuur: alleen zo kan zij de burger de garantie geven dat verantwoordelijk wordt omgegaan met haar en zijn veiligheid. Het is daarom een voorname taak van de gezaghebber om zorg te dragen voor goed bestuur en een beroep doen op de leden van het College om transparantie, integriteit, rechtmatigheid, doelmatigheid in bestuurlijk handelen en openbare orde in de vergaderingen van het Bestuurscollege te bevorderen. Ik reken daarbij op de medewerking van het gehele BC, daar het BC veel invloed kan uitoefenen op de veiligheid in de samenleving. De bescherming van de veiligheid is echter niet alleen de verantwoordelijkheid van de gezaghebber en van de overige bestuursorganen van het Openbaar Lichaam of het Rijk, maar ook van de burger. De burger dient bewust te zijn van het recht op een veilige omgeving, in de voornoemde brede betekenis De Gezaghebber van Bonaire mevrouw dr. Lydia Emerencia van het woord, en hiertoe vanuit een eigen verantwoordelijkheid bij te dragen. De verantwoordelijkheid voor integrale veiligheid moeten we met z n allen dragen! De veiligheid van Statia De Gezaghebber van Sint Eustatius Gerald Berkel De veiligheid van elke gemeenschap is alleen haalbaar door middel van een collectieve inspanning van de gemeenschap. Traditioneel werden de rechtshandhavingsautoriteiten gezien als de verantwoordelijke entiteit voor onze veiligheid en beveiliging. Echter, dit voornamelijk repressieve aspect vormt een klein deel van de holistische benadering gericht op onze ervaring van veiligheid en beveiliging. In onze gemeenschap wordt primair veel nadruk gelegd op preventie. Als zodanig blij de overheid zich richten op verbetering van de infrastructuur, handhaving en bevordering van een schone en gastvrije omgeving. Ook richt de overheid zich op het geven van informatie met betrekking tot de belangrijke rol die iedere persoon moet spelen in het behoud van de veilige omgeving waarvan we mogen genieten. Veiligheid en beveiliging omva en alle aspecten van ons dagelijks leven. Een ander belangrijk aspect dat tot een verhoogd gevoel van veiligheid leidt in onze gemeenschap, is adequaat voorbereid zijn. Voorbereid zijn op gebeurtenissen die naar alle waarschijnlijkheid zullen plaatsvinden. In deze hee de overheid stappen ondernomen in samenwerking met andere partners binnen de regio, het Koninkrijk en de private sector op Sint Eustatius om een verhoogd niveau van paraatheid te garanderen in bijvoorbeeld medische, vuur- of andere natuurlijke of door mensen veroorzaakte rampen. Een veilige en beveiligde omgeving en reputatie behouden is erg belangrijk. Aangezien dit niet alleen een leefomgeving creëert die bevorderlijk is voor de persoonlijke groei, het stimuleert en bevordert ook de economische activiteit en interesse. Met gelijktijdige focus op paraatheid, preventie en repressie in combinatie met iedere sector van onze gemeenschap die haar steentje bijdraagt, kunnen wij de veiligheid die ons speciaal maakt voor onze gasten en waaraan we gewend zijn geraakt hier in Sint Eusatius, behouden en verder verbeteren. Elke burger heeft het recht op veiligheid De Gezaghebber van Saba Jonathan Johnson De veiligheid van haar burgers is één van de belangrijkste kenmerken van een democratie. Ons eiland houdt de trias politica met de scheiding der uitvoerende, wetgevende en rechterlijke machten hoog in het vaandel. Alhoewel ons eiland relatief veilig is, hebben we soms te maken met overvallen en huiselijk geweld. Als gemeenschap moeten we de vraag beantwoorden waarom dit gebeurt. Alcoholmisbruik en drugsgebruik is een realiteit waarvan we niet kunnen doen alsof het niet bestaat. Voorlichting en bewustwording zijn belangrijk om ervoor te zorgen dat onze burgers niet verstrikt raken in het web van gebruik en misbruik. Voor degenen die het slachtoffer zijn geworden, geldt dat ze rehabilitatie en hulp nodig zullen hebben. Elke burger hee het recht op veiligheid maar ook de gemeenschappelijke verantwoordelijkheid om ervoor te zorgen dat anderen ook veilig zijn. Soms zien we, horen en ervaren we dingen die niet maatschappelijk aanvaardbaar zijn. Sommigen vinden dat het uitsluitend de rol van de overheid, de politie of de scholen is om deze negatieve trend te veranderen. Als we de kwalen van de samenleving willen corrigeren, dan moeten wij die als samenleving samen corrigeren. Saba staat bekend als een schoon en vriendelijk eiland. Dit is van generatie op generatie meegegeven. We moeten deze eigenschappen blijven uitdragen. Dit kan alleen gedaan worden door het voorbeeld te geven. Ouders, familie leden en volwassenen in het algemeen dienen positieve voorbeelden te zijn voor onze jeugd. We kunnen onze jeugd niet de schuld geven en stellen dat ze verloren zijn als ze niet op een dwaalspoor waren gezet door degenenen die voor hen verantwoordelijk zijn.

2 Schema Justitiële keten Gezaghebber Politie KMAR Douane Samen werken aan veiligheid Waakzaam en dienstbaar staat de politie voor de waarden van onze rechtstaat Het Korps Politie Caribisch Nederland (KPCN) zet zich in voor lee are en veilige eilanden voor de mensen die er wonen, werken en als toerist verblijven. Dat is de missie waar de politie voor staat. Bij het verder bouwen aan ons korps met bovenstaande missie voor ogen, richt de politie zich op de uitvoering van operationele beleidsdoelstellingen die in samenspraak met de Openbare Lichamen en het Openbaar Ministerie tot stand zijn gekomen. Het Openbaar Ministerie besteedt in 2012 met voorrang aandacht aan het voorkomen en oplossen van geweldscriminaliteit, woning- en bedrijfsinbraken en jeugdcriminaliteit. Voor de eilandelijke besturen is de zichtbaarheid en bereikbaarheid van de politie van groot belang. Om dat te realiseren, is het voor de komende jaren van belang dat het KPCN voldoende capaciteit hee. Advocaat Officier van Justitie Rechter JICN Voogdijraad Reclassering Samen bouwen aan de toekomst van Caribisch Nederland De drie eilanden Bonaire, Saba en Sint Eustatius hebben alle drie een eigen karakter. Mede door de afstand tussen Bonaire en de bovenwindse eilanden vraagt dit extra inspanning met betrekking tot samenwerking in en buiten het korps. De politie wil `maatwerk leveren voor de mensen op onze eilanden. Kern van de politietaak is een gestructureerde aanpak van (de gevolgen van) problemen en achterliggende oorzaken, in nauwe samenspraak met ketenpartners en andere instanties. Ook u als burger kan daarbij helpen. U weet en ziet wat er gebeurt. De politie kan extra ogen en oren op straat goed gebruiken. Samen maken wij het veiliger! Samen maken wij het veiliger Bureau Slachtofferhulp: voor slachtoffers van een misdrijf of (verkeers) ongeluk Bureau Slachtofferhulp is er voor slachtoffers van een misdrijf of een (verkeers) ongeluk. Enkele voorbeelden van een misdrijf zijn woninginbraak, stalking, beroving, seksueel geweld, mishandeling en huiselijk geweld. Bureau Slachtofferhulp adviseert ouders en betrokkenen hoe ze het beste om kunnen gaan met kinderen of jongeren die een schokkende gebeurtenis hebben meegemaakt of daarbij betrokken zijn geweest. Het bureau is er niet alleen voor slachtoffers. Ook andere betrokkenen zoals nabestaanden, familie, getuigen en bekenden kunnen bij hen terecht. De hulp is gratis. Bureau Slachtofferhulp biedt praktische, juridische en emotionele hulp. Dit houdt onder meer in dat zij helpen bij het schrijven van brieven, informatie geven over juridische procedures en luisteren naar wat u is overkomen. Zij benaderen de slachtoffers persoonlijk, nodigen hen uit voor een gesprek en nemen de tijd om met de slachtoffers te praten. Alles wat wordt verteld, wordt vertrouwelijk behandeld. Bureau Slachtofferhulp is er voor slachtoffers van een misdrijf of een (verkeers) ongeluk. Bureau Slachtofferhulp is niet meer weg te denken uit de gemeenschap. In 2007 begon het bureau op Bonaire waarbij in dat jaar ruim 100 verzoeken werden behandeld. In 2011 was dit aantal al opgelopen tot 150. Belt u daarvoor met een van onderstaande telefoonnummers of met het nummer van de plaatselijke politie. Belt u gerust met een van de acht medewerkers die voor u klaar staan: Bonaire +(599) Saba +(599) St. Eustatius +(599) Wilt u schri elijk contact met het bureau Slachtofferhulp? Dan kunt u een sturen naar slachtofferhulp@politiecn. com of een brief schrijven naar het plaatselijke Bureau van Politie. De Koninklijke Marechaussee in Caribisch Nederland voert de grensbewaking en andere politietaken uit De behoe e aan veiligheid in de samenleving is groot en neemt nog altijd toe. Veiligheid is een kerntaak van de overheid. De burger verwacht van de overheid dat deze zijn veiligheid garandeert. Tegelijkertijd moeten ook de veiligheid en integriteit van de staat en de vitale belangen in het Koninkrijk worden geborgd. Waar de politie zich primair richt op de veiligheid van de burger en de lokale samenleving, is de Koninklijke Marechaussee bij uitstek in staat te zorgen voor de veiligheid van het nationale belang. Daartoe beschikt zij als politieorganisatie over een militaire status en algemene opsporingsbevoegdheid. De drie speerpunten van de Koninklijke Marechaussee zijn: 1. Grenspolitietaak; 2. Bewaken en Beveiligen; 3. Internationaal en (militair) politieoptreden. De Koninklijke Marechaussee in Caribisch Nederland voert, net als in Nederland, de grensbewaking en andere politietaken uit op de drie eilanden: Bonaire, Sint Eustatius en Saba. Het betre vooral de volgende taken: Ñ Grensbewaking en de bestrijding van identiteiten documentfraude Ñ Bestrijding van mensensmokkel Ñ Gemeenschappelijk Grenscontrole Team (GGCT) in het kader van 100 % controle verdovende middelen; Ñ Politietaken en de Beveiliging Burger Luchtvaart op de luchthavens; Ñ Samenwerking met en bijstand aan de politie. De Koninklijke Marechaussee wil overal ter wereld, een betrouwbare veiligheidspartner zijn in de veiligheidsketen en werkt daarom voor wat betre Caribisch Nederland nauw samen met het Openbaar Ministerie, het Korps Politie Caribisch Nederland, de Douane Caribisch Nederland, de Kustwacht, Stinapa Bonaire, Saba Marine Park, Stenapa Sint Eustatius. Het mo o van de brigade Koninklijke Marechaussee Caribisch Gebied is dan ook: Brigade Carib, sámen maken we het mogelijk

3 Douane en veiligheid Veel mensen denken dat de Douane alleen belastingen int. Maar de Douane hee ook belangrijke taken op het gebied van uw veiligheid, gezondheid en milieu. Wat doet de Douane dan aan uw veiligheid? De wereld om ons heen lijkt steeds gewelddadiger. Niemand wil dat criminelen met vuurwapens het pompstation overvallen. Niemand wil dat zijn kind overlijdt aan een overdosis heroïne. U wilt medicijnen die zijn goedgekeurd. Veiligheid is ook voorkomen dat de onderwereld via witwassen onze bovenwereld overneemt. De wereld is ook kleiner geworden; goederen gaan binnen een dag van de ene kant van de wereld naar de andere kant. Dat alles vraagt om een alerte controledienst aan de grenzen. De Douane is een onderdeel van de Belastingdienst Caribisch Nederland. Voor het uitvoeren van haar taken beschikt de Douane over moderne middelen zoals volledig uitgeruste auto s, scanapparatuur en speurhonden. De douanemedewerkers krijgen scholing in onder andere de wet- en regelgeving. Net zo belangrijk is de samenwerking met andere diensten, met bijvoorbeeld de Koninklijke Marechaussee, Politie en Kustwacht. Deze diensten wisselen onderling informatie uit en houden gezamenlijke acties. Ook wisselt de Douane via deze diensten internationaal informatie uit. De douaneambtenaar vraagt u bij aankomst aan de grens om uw tas in te mogen zien. Dat is niet alleen om te kijken of er dure apparatuur in zit. Gelijktijdig zoekt de Douanemedewerker naar vuurwapens, verdovende middelen en illegale medicijnen. Daarvoor onderzoekt de Douane ook containers en opslagplaatsen. In dagbladen kunt u regelmatig lezen over de resultaten die de Douane boekt. De taak van het Openbaar Ministerie Het Openbaar Ministerie (OM) BES is belast met de strafrechtelijke handhaving van de rechtsorde en met andere bij wet vastgestelde taken op Bonaire, Sint Eustatius en Saba. Deze hoofdtaak van het OM is te verdelen in drie deeltaken: de opsporing van stra are feiten, de vervolging van stra are feiten en het toezicht op de uitvoering van strafvonnissen. Het Openbaar Ministerie bepaalt òf en voor welke stra are feiten iemand voor de strafrechter moet verschijnen. De lokale Driehoeken Bonaire, Sint. Eustatius en Saba Elk eiland kent zijn eigen Driehoek. Deze bestaat uit de betreffende Gezaghebber, de Hoofdofficier van Justitie van het Openbaar Ministerie BES en de Korpschef van het Korps Politie Caribisch Nederland. Zowel de politie, het OM als de gezaghebber hebben elk hun eigen taken, bevoegdheden en verantwoordelijkheden. Gezamenlijk zijn ze verantwoordelijk voor de integrale veiligheid van het betreffende eiland. De leden van de Driehoek overleggen geregeld met elkaar (driehoeksoverleg). Wie het bevoegd gezag is voor de politie verschilt per politietaak. Als het gaat om handhaven van de openbare orde of om hulpverlening, hee de Gezaghebber het gezag over de politie. Als de politie (of de Koninklijke Marechaussee) wordt ingezet voor het opsporen van stra are feiten, dan doet zij dit onder de verantwoordelijkheid en gezag van het Openbaar Ministerie BES. De rechter Een rechter is iemand die rechtspreekt. Meestal wordt met het woord rechter een magistraat van de rechterlijke macht bedoeld. De rechter is we elijk verplicht een oordeel uit te spreken over een concreet geschil, dat hem voorgelegd wordt. Daarbij houdt de rechter rekening met: Ñ de wet Ñ de rechtspraak (of jurisprudentie) Ñ de rechtsleer (of doctrine) Ñ de gewoonte. Een rechter wordt voor het leven benoemd. Dit versterkt de ona ankelijkheid van de rechter, doordat hij niet bang hoe te zijn zijn baan te verliezen. Voor het leven benoemd houdt in dit geval overigens in tot zijn/haar zeventigste verjaardag. Rechters worden door het staatshoofd benoemd. De selectie vindt plaats door de commissie aantrekken rechterlijke macht. Deze commissie bestaat behalve uit juristen ook uit een aantal personen die geen juridische achtergrond hebben. Die ona ankelijkheid, de objectiviteit en de onpartijdigheid van de rechter worden bevorderd door de mogelijkheid een rechter te wraken. Een rechter wordt gewraakt als er een redelijk vermoeden bestaat dat er sprake is van feiten of omstandigheden waardoor de rechterlijke onpartijdigheid schade zou kunnen lijden. Het hoort vooraf, maar kan ook nog tijdens de rechtszi ing. De rechter is we elijk verplicht een oordeel uit te spreken. Justitiële Inrichting Caribisch Nederland locatie Bonaire (JICNB) Een vrijheidsbenemende straf is de zwaarste straf die iemand kan krijgen. Een gevangenisstraf hee drie doelen. Ñ Vergelding: de opgelegde straf laat zien dat de samenleving niet accepteert dat we en en regels zijn overtreden. Ñ Veiligheid samenleving: gevangenisstraf maakt de samenleving veiliger, want de dader vormt in detentie immers geen bedreiging meer. Ñ Herhaling voorkomen: de meeste gedetineerden komen op een bepaald moment weer vrij. De samenleving hee er baat bij dat exgedetineerden niet in herhaling vervallen. Daarom bieden inrichtingen gedetineerden regelmaat, begeleiding en praktische vaardigheden aan, om later zo goed mogelijk terug te keren in de maatschappij. Als de lengte van de straf dat toelaat en de gedetineerde gemotiveerd is, kan hij/zij in de gevangenis ook opleidingen en trainingen volgen. Huis van bewaring en gevangenis Gedetineerden die verdacht worden van een stra aar feit kunnen in afwachting van de uitspraak van de rechter preventief worden ingesloten, dat wil zeggen: voorlopig vastgezet worden. Zij verblijven dan in een huis van bewaring. Na de uitspraak van de rechter gaan veroordeelden naar een gevangenis. De JICNB is zowel een huis van bewaring als gevangenis. Gevangenisstraf maakt de samenleving veiliger. Samenwerking met ketenpartners Binnen de ketens waarin de gevangenis opereert - de vreemdelingenketen, de strafrechtsketen, de jeugdketen en de zorgketen - werken verschillende organisaties nauw samen. Zij hebben een gezamenlijke verantwoordelijkheid om justitiabelen (mensen die vallen onder een bepaalde rechtszaak, red.) goed te laten terugkeren in de samenleving en de kans op herhaling van crimineel gedrag zo klein mogelijk te maken. Zo zorgen we voor een veiligere samenleving voor iedereen. Elke organisatie in de keten werkt vanuit een eigen taak en rol. Dit maakt onderlinge afstemming en samenwerking niet alleen gewenst, maar ook noodzakelijk. Belangrijke partners van de JICNB zijn bijvoorbeeld de politie, het Openbaar Ministerie, de Immigratie- en Naturalisatiedienst, de Reclassering, verslavingszorg, onderwijsinstellingen, Jeugd en Gezin en de Voogdijraad Nieuwe gevangenis op Statia Op Sint Eustatius zal een justitiële inrichting worden gebouwd. De inrichting krijgt ach ien cellen, met in totaal dertig celplaatsen. De inrichting krijgt de bestemmingen huis van bewaring en gevangenis, voor de doelgroepen jeugd, vrouwen en mannen (in een huis van bewaring zi en

4 veelal mensen met een korte straf en verdachten in voorarrest. Een gevangenis is voor mensen die veroordeeld zijn, red.) De inrichting is bedoeld voor gedetineerden die a omstig zijn van Saba en/ of Sint Eustatius. Ook deze inrichting zal gebruik maken van een dagprogramma (urinecontrole, celcontrole, rapportage, luchten, arbeid, sport, recreatie, bezoek, onderwijs, bibliotheek). De inrichting zal worden gebouwd op een stuk grond in het gebied Man o War. Het stuk grond ligt net ten oosten van het industrieterrein bij Man o War, ten noorden van de luchthaven F.D. Roosevelt en is gedeeltelijk verborgen door de heuvels. De daadwerkelijke bouw van de inrichting moet vóór het einde van dit jaar beginnen. Volgens planning zal de inrichting begin 2015 in gebruik worden genomen en ongeveer 35 nieuwe banen opleveren. Ook bij strafzaken waarbij minderjarigen een delict hebben gepleegd, adviseert de Voogdijraad het Openbaar Ministerie en het Gerecht om te voorkomen dat een minderjarige in herhaling valt en zo een stra lad opbouwt. De Voogdijraad werkt nauw samen met de Gezinsvoogdij als kinderen onder toezicht worden gesteld om hun daadwerkelijk een veilige omgeving te bieden. De Gezinsvoogdijinstelling zorgt voor de (verplichte) begeleiding van de minderjarige en de ouders. Als een verdachte of een veroordeelde een verplicht toezicht opgelegd hee gekregen, zal de reclassering dit toezicht uitvoeren. Binnen dit toezicht is er samenwerking met ketenpartners buiten de justitieketen. Denk aan de psychiatrie- en verslavingszorg, Forma, Jong Bonaire en verschillende werkgevers en familieleden. Het toezicht is erop gericht om de verdachte/veroordeelde en indien nodig het gezin/de familie dusdanig te begeleiden dat de kans op nieuwe stra are feiten in de toekomst kleiner wordt. De reclassering kan binnen dit toezicht aanwijzingen aan een verdachte/veroordeelde geven zoals bijvoorbeeld het ondergaan van een training om agressie terug te dringen. De advocaat Een advocaat helpt mensen met een juridisch probleem en zorgt ervoor dat iemand niet alleen staat. Hij adviseert, bemiddelt, onderhandelt en procedeert voor u. Hij behartigt uw belangen en is bevoegd om procedures te voeren bij de rechtbank. Een advocaat is niet altijd verplicht, maar veel mensen weten onvoldoende van de wet om hun zaak bij een rechter goed te vertellen. Bovendien kunnen mensen het lastig vinden om afstand van hun eigen zaak te nemen. Dan biedt een advocaat uitkomst. U staat in een conflict nooit helemaal alleen, uw advocaat staat aan uw zijde. Dit betekent niet dat hij zich volledig met u zal vereenzelvigen. Hij blij volgens de Nederlandse Orde van Advocaten een dienstverlener die u zo goed mogelijk zal bijstaan. Hij zal het dus soms met u eens zijn, maar u soms ook adviseren iets niet te doen. Vandaar ona ankelijk. Verder doet hij alles om voldoende deskundig en integer te kunnen optreden. Een advocaat moet vertrouwelijk omgaan met alles wat zijn cliënt met hem deelt. Hij moet het beroepsgeheim respecteren en hee een verschoningsrecht. Dus zelfs als de rechter hem vraagt iets te vertellen wat zijn cliënt eerder aan hem hee toevertrouwd, mag hij dit weigeren. Een advocaat die zich niet aan de regels houdt, kan voor de tuchtrechter worden gebracht. De Voogdijraad BES werkt samen met de andere justitiële diensten aan een veilig Bonaire, Sint Eustatius en Saba; eilanden waar minderjarigen zich veilig kunnen ontwikkelen tot gezonde volwassenen die dit eiland verder helpen opbouwen. Om te zorgen dat een kind veilig wordt gesteld via het Gerecht of het Openbaar Ministerie is een goede samenwerking met andere ketenpartners zeer belangrijk. Denk aan partners als scholen, politie, Openbaar Ministerie en Jeugdzorg. De SRCN krijgt verzoeken van onder meer de Rechter Commissaris, de Officier van Justitie of de directeur van de JICN. Op verzoek brengt SRCBN een rapportage uit om een besluit te kunnen nemen over de verlenging van de preventieve hechtenis of de strafeis. Ook adviseert SRCN over de mogelijkheden of een gedetineerde in aanmerking kan komen voor het eerder verlaten van de JICN onder voorwaarden, bijvoorbeeld onder elektronisch toezicht. De Rechter-Commissaris, de Officier van Justitie en de Minister van Veiligheid & Justitie beslissen vervolgens of zij het advies opvolgen. June 2012 EDITION 13 I N F O R M AT I O N BU L L E T I N B O N A I R E, S I N T E U S TAT I U S & S A B A The theme of this information bulletin is safety and it anticipates on the Safety and Security Fair that will take place mid-august on Bonaire. This fair focuses entirely on everything related to security. A number of participants at this fair is already explaining a few things about their work. For example, what do the Royal Netherlands Military Constabulary and Customs do? What does the Public Prosecutor s Office do and what is the JICN? Safety on Bonaire: Welfare and Harmony for all as a goal As Lieutenant Governor I value safety in a society very much. In doing so, I prefer to employ a broad definition of the terminology: it is not only about safety with respect to crime. It s also about safety in the sense of human dignity and fundamental rights. Thus: safety in the sense of feeling appreciated and respected, with respect to the own identity, own initiatives, own culture and values. Safety for the individual, but also for organizations and society. Safety for all: also for the vulnerable groups. As Lieutenant Governor I consider it my duty to contribute to this broadly defined safety. In the first place as local chief of police and as the one responsible for the enforcement and surveillance and public order in general. Ensuring safety is also part of the responsibility of the Lieutenant Governor when it concerns disaster relief and prevention. As Chairperson of the Island Council, I can assist the people s representatives in their responsibility to create the frameworks for be er welfare and sense of security in the community. The Lieutenant Governor as Chairperson and a full member of the Executive Council can make sure and contribute to safety and welfare of the citizens being focused on within the government of the Public Entity. The government must meet all the requirements of good governance: only then can it guarantee its citizens that their safety is being dealt with in a responsible manner. It is therefore an important task of the Lieutenant Governor to ensure good governance and call upon the members of the Council to promote transparency, integrity, legality, efficiency in administrative action and public order in the meetings of the Executive Council. I am relying on the cooperation of the entire EC, considering that the EC can exert much influence on the safety in the community. However, safeguarding safety is not only the responsibility of the Lieutenant Governor and of the other administrative bodies of the Public Entity or the National Government, but of citizens as well. The Safe and Security on Statia The safety and security of any community is only achievable through a collective community effort. Traditionally law enforcement has been viewed as the entity responsible for our safety and security however this predominantly repressive aspect forms a small part of the holistic approach toward our experience of safety and security. In our community much emphasis is placed primarily on prevention. As such government continues to focus on improving infrastructure, maintaining and promoting a clean and welcoming environment and proving information with regards to the important role each person must play toward the maintenance of the secure and safe environment we enjoy. Safety and security encompasses every aspect of our daily life. De Governor of Sint Eustatius Gerald Berkel Another important aspect that leads to a heightened feeling of safety and security within our community is proper preparedness. Preparedness for eventualities that are most likely to occur. Here also government has undertaken steps in collaboration with other partners within the region, kingdom and the private sector on St. Eustatius to assure a heightened level of preparedness in for example medical, fire or other natural or manmade disasters. Maintaining a safe and secure environment and reputation is very important as this not only creates a living environment that is conducive to personal growth is also stimulates and encourages economic activity and interest. With simultaneous focus on preparedness, prevention and repression combined with every sector of our community doing their part we can maintain and continue to improve the safety and security that makes us special to our guests and that we have become accustomed to here in St. Eustatius Each and every citizen has the right to be safe De Governor of Saba Jonathan Johnson The security of its citizens is one of the most important hallmarks of a democracy. Our island holds trias politica whereby the separation of the executive, legislative, and judicial branches paramount. Although our island is relatively safe we are at times faced with robberies and domestic violence. As a community we need to address the question why this is happening. Alcohol abuse and drug use is a reality which we cannot pretend isn t happening. Education and awareness are important to ensure that our residents do not become entangled in the web of use and abuse. For those who have fallen victim they will need rehabilitation and help. Each and every citizen has the right to be safe but also the collective responsibility to ensure that others are also safe and secure. At times we see, hear, and experience things which are not socially acceptable. Some feel that it is solely the role of government or the police or the schools to change this negative trend. If we are to correct the ills of society then we as a society must correct them together. Saba is known as a clean and friendly island. This has been passed down from generation to generation. We need to continue to exhibit these traits. This can only be done by example. Parents, family members, and adults in general need to be positive examples for our youth. We cannot blame our youth and say they are lost if they hadn t been le astray by those who are responsible for them.

That is the mission the police stand for. violent crime, home and business burglaries and juvenile crime. For the island governments the visibility and accessibility of the police is of major importance. To achieve this, it is important that the KPCN has sufficient capacity in the coming years. Partly due to the distance between Bonaire and the Windward Islands, extra effort is required with regard to cooperation within and outside the force. The police wants to deliver customized service to the people on our islands. In further building up our force with the abovementioned mission in mind, the police will focus on the implementation of the operational policy objectives that were established in consultation with the Public Entities and the Public Prosecutor s Office. In 2012 the Prosecutor s Office will give priority to prevention and solving of The core of the police task is a structured approach to (the consequences of ) problems and underlying causes, in close consultation with chain partners and other agencies. You as a citizen can help as well. You know and see what happens. The police can make good use of extra eyes and ears on the street. Together we make it safer! Together we make it safe Victim Support Office: for victims of crime or (traffic) accidents The Victim Support Office is for victims of a crime or a (traffic) accident. Some examples of crime are home burglary, stalking, robbery, sexual assault, abuse and domestic violence. The Victim Support Office advises parents and parties involved how best to deal with children or young people who have experienced a shocking event of were involved in it. The office is not only for victims. Also other parties involved, such as surviving relatives, family, witnesses and acquaintances can go there. Assistance is free. The Victim Support Office offers practical, legal and emotional assistance. This means, among other things, that they assist in writing le ers, give information about legal procedures and listen to what happened to you. They personally approach the victims, invite them for an interview and take the time to talk to the victims. Everything that is said, is confidential. We can no longer imagine the community without Victim Support Office is for victims of crime or a (traffic) accident. the Victim Support Office. In 2007, the agency started in Bonaire whereas in that year more than 100 requests were dealt with. In 2011 this number had already risen to 150. What can you do? Ñ Report your damages within two days (48 hours) at your insurance company. Caribbean Brigade, together we make it possible Ñ Ask the police for a copy of the police report. You are entitled to this. The Royal Marechaussee in Dutch Caribbean performs border surveillance and other police tasks The need for safety in the community is great and is always on the rise. Security is a core task of the government. Citizens expect from government that they guarantee their safety. At the same time the security and integrity of the state and the vital interests in the Kingdom must also be safeguarded. Where the police primarily focus on the safety of the citizen and the local community, the Royal Dutch Marechaussee is eminently capable of ensuring the security of national interest. For that purpose, as a police organization, it has a military status and general powers of investigation. The three main focuses of the Royal Dutch Marechaussee are: 1. Border police task; 2. Guarding and Protecting; 3. International and (military) police action. The Royal Dutch Marechaussee in the Dutch Caribbean, just as in the Netherlands, performs the border control and other police tasks on the three islands: Bonaire, St. Eustatius and Saba. It mainly concerns the following tasks: Ñ Border control and combating identity and document fraud; Ñ Combating human trafficking; Ñ Joint Border Control Team (GGCT) within the context of 100 % control of narcotics; Ñ Police tasks and Civil Aviation Security at the airports; Ñ Cooperation with and assistance to the police. The Royal Dutch Marechaussee wants to be a reliable security partner in the security chain all over the world and therefore, with regard to the Dutch Caribbean, works closely with the Public Prosecutor s Office, the Dutch Caribbean Police Force, the Dutch Caribbean Customs Department, the Coast Guard and Stinapa. 11 Customs and security Many people think that the Customs only collects taxes. But Customs also has important tasks in the area of your safety, health and environment. What does the Customs Department do in terms of your safety? The world around us seems more and more violent. Nobody wants criminals holding up the gas station at gun point. No one wants their child to die of a heroin overdose. You want medication that has been approved. Security is also preventing that the underworld will take over our upper world through money laundering. The task of the Public Prosecutor s Office The BES Public Prosecutor s Office (OM) is responsible for the enforcement of the criminal law and other statutory tasks on Bonaire, St. Eustatius and Saba. This main task of the OM can be divided in three sub-tasks: the investigation of criminal offenses, the prosecution of criminal offenses and monitoring the execution of criminal judgments. The Public Prosecutor s Office determines whether and for which criminal offenses someone must appear before the criminal court. The local Triangles Bonaire, St. Eustatius and Saba Each island has its own Triangle. This consists of the respective Island Governor, the Chief Public Prosecutor of the BES Public Prosecutor s Office and the Chief of Police of the Dutch Caribbean Police Force. The Police as well as the Public Prosecutor s Office and the Island Governor each have their own tasks, competences and responsibilities. They are jointly responsible for the overall security of the respective island. The members of the Triangle regularly consult with each other (tripartite consultation). Who the competent authority is for the police, varies per police task. When it concerns enforcement of the public order or assistance, the Island Governor has the authority over the police. When the police (or the Royal Dutch Marechaussee) are used for the detection of criminal offenses, then it does so under the responsibility and authority of the BES Public Prosecutor s Office. The Judge A judge is someone who administers justice. Usually the word judge refers to a magistrate of the judiciary power. The judge has a legal obligation to pass judgment on a concrete dispute that is presented to him. In so doing, the judge shall take into account: Ñ The law Ñ The law of precedents (or jurisprudence) Ñ The legal doctrine (or doctrine) Ñ The custom A judge is appointed for life. This strengthens the independence of the judge, because he does not need to fear losing his job. Appointed for life, in this case, means up to his/her seventieth birthday, by the way. Judges are appointed by the head of state. The selection takes place by the commi ee for the acquisition of the judiciary power. Apart from lawyers this commi ee also consists of a number of people with no legal background. The world has also become smaller ; within one day goods go from one side of the world to the other. All of this requires vigilant surveillance at the borders. Customs is a unit of the Dutch Caribbean Tax Authority. To perform its duties, Customs has modern means such as fully equipped cars, scanning equipment and sniffer dogs. The Customs staff receives training in among other legislation and regulations. Equally important is the collaboration with other departments, for example with the Royal Dutch Marechaussee Police and Coast Guard. That independence, the objectivity and the impartiality of the judge are promoted by the option to challenge a judge. A judge is disqualified if there is a reasonable suspicion that there are facts or circumstances which may prejudice judicial impartiality. This should happen in advance but may still be done during the court hearing. The judge is legally obliged to pronounce a verdict The Dutch Caribbean Penitentiary Institution, location Bonaire (JICNB) A sentence restricting freedom is the harshest punishment that a person can get. A prison sentence has three objectives. Ñ Retribution: the sentence shows that society does not accept that laws and rules have been violated. Ñ Security of the community: prison sentences make the community safer, because a er all, the offender does no longer pose a threat while in detention. Ñ Prevent recurrence: most prisoners are released at a certain point in time. Society beni s from ex-convicts not re-offending. Therefore, institutions regularly offer prisoners, guidance and practical skills, in order to return as best as possible later on to society. If the length of the sentence permits and the prisoner is motivated, he/she can also a end courses and training in prison. Remand prison (house of detention) and prison Detainees who are suspected of a criminal offense may be preventatively taken into custody while awaiting the ruling of the court meaning: provisionally taken into custody. They then stay in a remand prison. A er the judgment of the court the convicts go to a prison. The JICNB is both a remand prison and a prison. These departments exchange information and organize concerted actions. Customs also exchanges information internationally through these departments. The Customs official will ask you upon your arrival at the border to inspect your bag. That is not only to see if it contains expensive equipment. Simultaneously the Customs Officer looks for fire arms, narcotics and illegal drugs. To this end Customs also inspects containers and warehouses. You can regularly read about the results achieved by Customs in newspapers. Prison makes society safer. Cooperation with chain partners Within the chains the prison operates in the immigration chain, the criminal justice chain, the juvenile chain and the chain of care various organizations work closely together. They have a joint responsibility to let litigants (people who fall under a certain court case, red.) return properly into society and to minimize the chance of recurrence of criminal behavior as much as possible. This way we ensure a safer society for all. Each organization in the chain works from its own task and role. This makes consultation and cooperation not only desirable, but also necessary. Key partners of the JICNB are for example, the police, the Public Prosecutor s Office, the Immigration and Naturalization service, the Probation Service, addiction care, educational institutions, Youth and Family and the Court of Guardianship. New prison on Statia A penitentiary institution will be built on St. Eustatius. The institution will have eighteen cells, with a total of thirty cell spots. The institution will have the assigned purposes of remand prison and prison, for the target groups youth, women and men (in remand prison are mostly people with a short sentence and suspects in custody). A prison is for people who have been convicted, red.) The

12 institution is intended for prisoners from Saba and/or St. Eustatius. This institution as well will be using a daily program (urine check, cell check, reporting, airing, labor, sports, recreation, visits, education, library). The institution will be built on a piece of land in the Man o War area. The lot is located just east of the industrial area at Man o War, north of the F.D. Roosevelt airport and is partially hidden by the hills. The actual construction of the institution must start before the end of this year. In accordance with the planning the institution shall be put into operation at the beginning of 2015 and create about 35 new jobs. an offense, the Guardianship Council advises the Public Prosecutor s Office and the Court to prevent that a minor becomes a repeat offender and builds up a criminal record that way. The Court of Guardianship works closely with Family Supervision when children are put under supervision to actually provide them with a safe environment. The Family Guardianship Institution ensures the (mandatory) guidance of the minor and the parents. If an accused or convicted individual has been sentenced to mandatory supervision, the Probation Service will execute this supervision. Within this supervision there is cooperation with the chain partners outside the judicial chain. Think of psychiatric and addiction care, Forma, Jong Bonaire and various employers and family members. The supervision is aimed at guiding the accused / convict and if necessary the immediate family / the family in such a way that the probability of new criminal offenses in the future decreases. The Probation Service may within this supervision give instructions to an accused /convicted individual such as for example to a end anger management training in order to reduce aggression. The lawyer A lawyer assists people with a legal problem and ensures that someone is not alone. He advises, mediates, negotiates and litigates for you. He represents your interests and has the authority to litigate in court. A lawyer is not always required, but many people do not know enough about the law in order to state their case properly to the court. Moreover, people may find it difficult to distance themselves from their own case. Then a lawyer provides a solution. You are never completely alone in a conflict; your lawyer is by your side. This does not mean that he will identify himself completely with you. In accordance with the Netherlands Bar Association, he remains a service provider who will assist you to the best of his abilities. Therefore, he will sometimes agree with you but also at times advise you not to do something. Hence independent. Furthermore, he does everything in his power to act with sufficient expertise and integrity. A lawyer must handle everything his client shares with him confidentially. The Convention on the Rights of the Child is an important point of departure for the Court of Guardianship. The Court of Guardianship consists of three departments: the department of civil affairs, the department of criminal affairs and the child support department. These departments all have the task to advise the Court when a minor is threatened for one reason or the other in his/her development or grossly neglected. Within the frameworks the BES Court of Guardianship advises the Court what will be best for the child. Some situations are so alarming that the Court of Guardianship must act immediately. The BES Court of Guardianship works together with the other judicial services for a safe Bonaire; an island where minors can develop safely into healthy adults who can help build up this island further. To ensure that a child is put into a safe environment through the Court or the Public Prosecutor s Office, good cooperation with other chain partners is very important. Think of partners such as schools, Police, Public Prosecutor s Office and Youth Care. Upon request, the SRCBN issues a report in order to take a decision on the extension of the preventative custody or sentencing demand. The SRCN also advises on the options if a prisoner may qualify for early release from the JICN subject to conditions, for example under electronic monitoring.
