1 Spaarloon-, Levensloopregeling en de plannen rond het vitaliteitssparen Zoals u wellicht al in de media heeft vernomen, is de overheid voornemens de spaarloonregeling en de levensloopregeling te laten vervallen. Voor deze twee regelingen wordt de nieuwe spaarregeling vitaliteitssparen in 2013 geïntroduceerd. Omdat het belangrijk voor u zou kunnen zijn om op de hoogte te zijn van de mogelijke wijzigingen hebben wij de, vooralsnog beschikbare, informatie voor u op een rijtje gezet. Let wel: onderstaande informatie is een wetsvoorstel dat nog door de eerste en tweede kamer dient te worden goedgekeurd en dus mogelijk nog onderhevig aan veranderingen. Wat gebeurt er met de Spaarloonregeling? In 2011 verandert er niets. Met ingang van 1 januari 2012 stopt de spaarloonregeling en is het niet meer mogelijk om geld in te leggen. Werknemers die nu meedoen aan de spaarloonregeling kunnen hun opgebouwde tegoed vanaf 1 januari 2012 in zijn geheel opnemen, dit heeft geen nadelige fiscale gevolgen. Deelnemers aan de spaarloonregeling kunnen hun tegoed ook laten staan op de geblokkeerde spaarrekening. De tegoeden worden dan jaarlijks gedeeltelijk vrijgegeven. De vrijstelling in box 3 blijft voor deze tegoeden, zolang ze nog niet zijn vrijgegeven, bestaan. Wat doet de ING bank met het vrijgegeven spaarloon? Op dit moment is de ING bank nog in overleg over de manier waarop en wanneer hun cliënten op de hoogte zullen worden gebracht. Zij zullen hen echter zo spoedig mogelijk informeren. Wat zou er kunnen veranderen voor u als deelnemer aan de Levensloopregeling? De Levensloopregeling wordt per 1 januari 2012 afgeschaft. Als u op 31 december 2011 minimaal heeft gespaard op uw levenslooprekening, dan kunt u onder de huidige voorwaarden doorsparen in Dit wordt de overgangsregeling genoemd en zal onder het volgende kopje worden uitgelegd. Deelnemers die meer dan hebben gespaard zijn niet verplicht om deel te blijven nemen aan de overgangsregeling levensloop. Als u op 31 december 2011 minder dan heeft gespaard op uw levenslooprekening kunt u het tegoed in 2012 opnemen voor verlof. U kunt vanaf 2012 niet meer bijstorten. Alle deelnemers aan de Levensloopregeling kunnen in 2012 en 2013 hun tegoed onbelast doorstorten naar de vitaliteitsspaarrekening. Tot 1 januari 2012 opgebouwde rechten op levensloopverlofkorting kunnen worden verzilverd bij opname van het spaartegoed of bij de omzetting van levensloop in vitaliteitssparen.

2 Wat houdt de overgangsregeling levensloopregeling in? Voor deelnemers die op 31 december 2011 minimaal op hun levenslooprekening hebben staan, blijft het mogelijk om onder de huidige voorwaarden door te sparen in De levensloopverlofkorting die kon worden verkregen via de aangifte inkomstenbelasting komt voor iedereen te vervallen per 1 januari Deelnemers met minder dan spaargeld kunnen het tegoed in 2012 opnemen of ervoor kiezen om dit in 2013 onbelast door te storten naar het vitaliteitssparen. Deelnemers die minimaal gespaard hebben zijn niet verplicht om deel te blijven nemen aan de overgangsregeling levensloopregeling. Zij kunnen het spaartegoed in 2013 ook onbelast doorstorten naar het vitaliteitssparen. Vanaf 2014 kan het levenslooptegoed ook worden doorgezet naar vitaliteitssparen maar dan wordt vanaf een bedrag van belasting geheven. Het is niet mogelijk om deel te nemen aan zowel de overgangsregeling levensloop als aan het vitaliteitssparen. Wat zijn de plannen rond het vitaliteitssparen? Door de afschaffing van de spaarloon- en levensloopregeling komt er, naar alle waarschijnlijkheid, per 1 januari 2013 een nieuwe spaarregeling, te weten vitaliteitssparen. Deze spaarregeling zal werknemers en zelfstandigen de mogelijkheid bieden fiscaal aantrekkelijk te sparen en het gespaarde vermogen naar eigen inzicht op te nemen. Deze spaarregeling dient als een vrij opneembare aanvulling op het inkomen De stortingen zijn fiscaal aftrekbaar en de overheid heft pas belasting als het tegoed wordt opgenomen. Over het opgebouwde tegoed wordt geen belasting geheven in box 3. Een deelnemer kan maximaal fiscaal voordelig sparen. Er geldt een maximale jaarlijkse inleg van Deelnemers kunnen jaarlijks maximaal opnemen en vervolgens opnieuw sparen tot het maximum weer is bereikt. Vanaf het jaar waarin een deelnemer op 1 januari de leeftijd van 62 jaar bereikt kan er per jaar maximaal worden opgenomen. Vitaliteitssparen is fiscaal aantrekkelijk en zal niet via het salaris maar via uw eigen belastingaangifte worden verwerkt. Zou een werknemer alsnog kunnen deelnemen aan levensloop vóór ? Het openen van een levenslooprekening is nog mogelijk, indien u dit jaar niet al heeft deelgenomen aan de Spaarloonregeling. Alsnog deelnemen is echter slechts zinvol mits men minimaal inlegt, bijvoorbeeld uit de eindejaarsuitkering. Op deze manier kunt u nl. vanaf doorgaan met de inleg in de Levensloopregeling. Houdt u wel rekening met het feit dat HR Services de aanmeldingsformulieren hiervoor uiterlijk in hun bezit moeten hebben. Vanaf 2012 kunnen nieuwe deelnemers zich niet meer aanmelden voor de levensloopregeling.

These two schemes will be replaced in 2013 by the new vitality savings scheme. Because it could be important for you to be aware of the possible changes, we have detailed all the information that is presently available for you below. Please note: The following information concerns a draft bill that must be passed by both Houses of the Dutch Parliament and is therefore possibly subject to changes. What will happen to the Salary savings scheme? Nothing will change in The salary savings scheme will end as of 1 January 2012 and it will no longer be possible to make any deposits. Employees who now participate in the salary savings scheme will be able to withdraw their entire accumulated savings from 1 January 2012 with no disadvantageous fiscal consequences. Participants in the salary savings scheme will also be able to leave their balance in the blocked savings account. The balances will be partly released each year. The exemption in Box 3 will continue to exist for these balances as long as they are not released. What will the ING bank do with the released Salary savings balance? At the moment, the ING bank is still consulting about how and when it will inform its clients. The bank will, however, inform its clients as quickly as possible. What could change for you as participant in the Life course savings scheme?

4 The life course savings scheme will end as of 1 January If you have saved a minimum of 3,000 in your life course savings scheme account on 31 December 2011, you will be able to continue saving in 2012 under the present conditions. This is called the transitional arrangement and is explained in the next section of this document. Participants who have saved more than 3,000 will not be obliged to continue to participate in the transitional arrangement for the life course savings scheme. If you have saved less than 3,000 in your life course savings scheme account on 31 December 2011, you will be able to withdraw the balance in 2012 to take leave. From 2012 onwards, you will no longer be able to make any deposits. All participants in the life course savings scheme will be able to transfer their balances untaxed to the vitality savings account in 2012 and Up to 1 January 2012, the participant will be able to collect the accumulated rights to the life course savings scheme leave tax credit when the saved balance is withdrawn or when the life course savings scheme is converted to a vitality savings scheme. What are the details of the transitional arrangement for the Life course savings scheme? Participants who have a minimum of 3,000 in their life course savings scheme account on 31 December 2011 will be able to continue saving under the present conditions in The life course savings scheme leave tax credit that can be obtained through the income tax return will end for everyone as of 1 January Participants with less than 3,000 savings will be able to withdraw the balance in 2012 or choose to transfer it untaxed to the vitality savings scheme in Participants who have saved a minimum of 3,000 will not be obliged to continue to participate in the transitional arrangement for the life course savings scheme. They will also be able to transfer the saved balance untaxed to the vitality savings scheme in From 2014, participants will also be able to transfer the life course savings scheme balance to the vitality savings scheme but tax will be levied on a balance of 20,000 or more. It will not be possible to participate in both the transitional arrangement for the life course savings scheme and in the vitality savings scheme. What are the plans for the Vitality savings scheme? In all probability, there will be a new savings scheme (i.e. vitality savings scheme) as of 1 January 2013, when the salary savings scheme and life course savings scheme end. This savings scheme will offer employees and self-employed people the possibilities of saving with a tax advantage and of withdrawing the saved capital as the saver wishes. This savings scheme will serve as a supplement to the income that can be freely withdrawn.

5 The deposits will be tax-deductible and the government will only levy tax when the balance is withdrawn. No tax will be levied over the accumulated balance in Box 3. Participants will be able to save a maximum of 20,000 with a tax advantage. There will be a maximum annual deposit of 5,000. Participants will be able to withdraw a maximum of 20,000 each year and then save again until the maximum is again reached. From the year in which participants reach the age of 62 year on 1 January, they will be able to withdraw a maximum of 10,000 each year. The vitality savings scheme will be fiscally attractive and will not be processed through the salary but through your own tax return. Can an employee still participate in Life course savings scheme before 1 January 2012? It is still possible to open a life course savings scheme account, if you have not already participated in the salary savings scheme this year. However, it only makes sense to participate if you deposit a minimum of 3,000, for example from the end-of-year bonus. In this way, you can continue to deposit money in the life course savings scheme from 1 January Please note that HR Services must receive the application forms for this by no later than 25 November From 2012, new participants can no longer apply for the life course savings scheme.
