3 4 Opinio Iuris 2014/2015(3) VOORWOORD VOORZITTER 5 Voorwoord Voorzitter Robert Strooper Beste lezer, Voor u ligt de derde, en daarmee laatste, uitgave van de Opinio Iuris van dit studiejaar. De Opinio is weer gevuld met interessante artikelen, nieuwtjes, foto s en verslagen dus dat belooft een hoop leesplezier! De redactiecommissie heeft weer haar uiterste best gedaan om het blad naast inhoudelijk en interessant ook informeel te houden. Een opzet waar ze goed in zijn geslaagd! Graag zou ik in dit voorwoord stilstaan bij enkele activiteiten die sinds de vorige uitgave plaats hebben gevonden. Het Algemene Ledenweekend in Appelscha was erg geslaagd. Onder het genot van enkele drankjes en in dierenoutfits gehuld werden leuke spelletjes gespeeld en gingen de voetjes van de vloer. Een mooie manier om elkaar beter te leren kennen. Dit gezellige weekend werd al snel gevolgd door een evenement waar al het hele jaar naar uitgekeken werd, het Internationaal Studie Project. Van 3 tot 13 mei waren we in Skopje en Prishtina waar we een ongelooflijk bijzondere tijd hebben gehad. Het volle programma, waar jullie verder in dit blad meer over kunnen lezen, werd afgewisseld met de mogelijkheid om de verschillende steden te leren kennen. De ervaring van de cultuur en de omgeving was een onvergetelijke en meermaals is gezegd dat we hier nog maar een keertje terug moeten komen. Iets wat zeker aan te raden valt! We werden nog even opgeschrikt door de onrust die op dat moment in Macedonië woedde, maar na uitvoerig contact met de verschillende instanties ter plaatse werd duidelijk dat wij onze weg gewoon konden vervolgen. Het was een intensief en leerzaam programma waar wij instanties van de VN, NAVO en EU hebben bezocht alsmede het Kosovaarse parlement, het Helsinki Committee for Human Rights en de Nederlandse ambassades in beide steden. Het wordt zeker een uitdaging om dit volgend jaar te overtreffen! Na het ISP was het tijd voor de Actieve Ledenbedankdag. Als bedankje voor het afgelopen jaar was voor de commissies een moordspel georganiseerd door de hele binnenstad van Groningen. Een groot succes welke werd afgesloten met het semesteretentje. Hier volgde uiteraard een gezellige borrel op in De Hoppe. En opeens was het alweer 26 mei. De dag van de overdracht van het bestuur. Een ALV behoeft altijd veel voorbereiding, maar deze laatste keer zat er toch wel een sentimenteel randje aan. Het is dan toch onze laatste keer. Deze ALV is goed verlopen. De laatste borrel, van 2 juni, valt dan wel onder onze opvolgers, maar ik wil toch graag melding maken van een leuke borrel met veel eerstejaars studenten. Deze werden geïnformeerd over de opleiding door dr. De Hoogh, een goed initiatief van het nieuwe bestuur! Ondertussen heeft het 25e bestuur, het lustrumbestuur(!), de taken dus overgenomen. Daarom staat er achter mijn naam nu oud-voorzitter, een vreemde gewaarwording. Dit collegejaar is bijna afgelopen en daarmee ook het jaar van VINTRES. Het is een erg mooi jaar geweest met geslaagde activiteiten. We hebben hier als bestuur ontzettend van genoten en dat had natuurlijk niet gekund zonder de fantastische inzet van alle actieve leden. Hier wil ik, namens het 24e VINTRES bestuur, iedereen dan ook van harte voor bedanken. Wij hebben het volste vertrouwen dat onze opvolgers een uitdagende, spannende en leuke tijd tegemoet gaan. 4 6 Opinio Iuris 2014/2015(3) ACTIVITEIT 7 ACTIVITEIT ISP 2015: Kosovo & Macedonië Leonie van Vliet weten is dat de NAVO door de Kosovaarse bevolking het meest gewaardeerde internationale instantie is omdat zij worden gezien als de bevrijders van het volk. Daarna kwam de legal advisor van het leger die ons het wettelijke perspectief van de missie uitlegde en sloten we af met een kop koffie. Vervolgens werden we weer afgezet bij het hostel en konden we door naar het UNDP. De directeur van de afdeling vertelde ons over hun werk daar en interessante projecten. Op 3 mei was het zover, na maanden van voorbereiding werden onze plannen werkelijkheid, tien dagen zouden we gaan vertoeven in het mooie Macedonië en Kosovo. De heenreis verliep soepel, geen doem scenario s waarbij de trein vertraging had en een vliegtuig dat zonder ons vertrok. Wizzair, een vliegtuigmaatschappij waar ik nog nooit van had gehoord, zette ons netjes af in Skopje. Op het vliegveld begon meteen de eerste uitdaging, het bleek namelijk dat de taxi s niet berekend waren op de hoeveelheid bagage die we hadden meegenomen. Van Wizzair mochten we namelijk 32 kg bagage mee en dat staat gelijk aan een hoop onnodige rotzooi in je koffer stoppen. Het resultaat van de grote koffers was bij ons op de achterbank met Emmelie, Milou en Willemijn goed zichtbaar, mijn oranje koffer kreeg ook een mooi plaatsje op de achterbank. Gelukkig zat ik zelf lekker onderuitgezakt voorin en had ik daar zelf geen last van. Skopje was dus de eerste tussenstop van de reis. De volgende dag gingen we laat in de middag met de bus naar Prishtina, Kosovo. Laten we zeggen dat het openbaar vervoer in de Balkan te wensen overlaat want ook hier verliep de busreis niet geheel soepel. Guido en Everhard hadden namelijk bij het treinstation geïnformeerd of we met de trein naar Prishtina konden reizen. Dit was niet mogelijk omdat de trein te klein zou zijn voor onze bagage. De bus leek een goede tweede optie, maar ook deze was te klein voor 22 personen en dus besloten we om de groep in tweeën te splitsen. De eerste groep om uur en de volgende groep om uur. Ik zat zelf in de eerste groep en vol goede moed vertrokken we naar het busstation. Op het busstation bleek dat we inderdaad in een kleine bus zaten en ook hier werd onze bagage vakkundig tussen ons in gepropt. Dit lijkt natuurlijk niet zo erg, maar stel je even het volgende voor: 30 graden, volle zon en géén airco en een pietlullig raampje bij de chauffeur. Gelukkig had deze beste man ook geen haast want bij de grens moest er uitgebreid worden gerookt en wij mochten de stikhete bus niet uit. Na een reis van drieënhalf uur kwamen we aan in Prishtina, en mocht je denken dat het niet erger kon, de groep die een uur later was vertrokken kwam twee minuten later aan. Zij hadden in een super grote touringcar gezeten met airco en genoeg ruimte voor de koffers. Het was wel praktisch, de hosteleigenaar kwam in zijn vw tje onze koffers ophalen en wij konden lopend naar het hostel. Het hostel bleek een prima uitvalbasis voor onze bezoeken. Het hostel zat op 5 minuten lopen van het centrum en ook de instanties waren dichtbij. De eigenaresse bleek bovendien erg vriendelijk te zijn en hielp ons met alles. Op de eerste echte dag in Prishtina hadden we meteen twee bezoeken gepland staan: de NAVO KFOR en United Nations Development Programme (UNDP). Bij de NAVO hadden we geregeld dat we met speciale KFOR busjes werden opgehaald en naar de legerbasis werden gebracht. Onze contactpersoon Pietro bleek een super aardige Italiaan te zijn die van alles over de missie kon vertellen. Interessant om te Ook het stappen werd in Prishtina niet overgeslagen. Vooral een bepaald persoon heeft ongelofelijke indruk achtergelaten, want alles was guur en hij ging vanavond ook helemaal kaal. Door het veelvuldige gebruik van deze woorden werd er een strafregel op deze woorden gezet. Bij het gebruik van deze woorden moest er een shotje rakija worden gedronken. Ik noem verder geen namen maar er zijn een aantal mensen die hierdoor veel rakija hebben gedronken. Woensdag was een vrije dag en kon iedereen doen waar hij/zij zin in had. Een deel van de groep vertrok naar Mitrovica, een stad waar de spanningen tussen de Albanezen en Serven nog te voelen zou zijn, en het andere deel van de groep ging hiken bij een waterval. Donderdag hadden we weer instanties op de planning staan. De EULEX vertelde over hun missie in Kosovo. In Kosovo blijkt namelijk veel corruptie te zijn en sommige rechters zijn daar om te kopen. Daarom heeft EULEX daar een aantal rechters van verschillende landen zitten om in Kosovo recht te spreken. Daarna hadden we de mogelijkheid om met een Nederlandse rechter te praten. Tijdens de oorlog zijn namelijk veel Albanezen en Serven hun huis kwijt geraakt nadat ze waren gevlucht. Aan de rechter de taak om te achterhalen van wie de rechtmatige eigenaar was van het huis. We sloten donderdag af bij de Nederlandse ambassade. De rol van Nederland in Kosovo werd hier uitgelegd en ook een aantal projecten dat de Nederland financiert zijn aan bod gekomen. Ook vrijdag stond in het teken van het bezoeken van instanties. Deze keer gingen we naar het Kosovaarse Parlement en UNMIK. Bij het Kosovaarse Parlement hadden we een tegenvaller, het programma werd van twee uur naar een half uur ingekort. Dit kwam omdat het parlement moest stemmen over wetten. De twee Kamerleden die we spraken deden beide buitenlandse zaken. Zij hadden veel kritiek op de gang van zaken binnen het parlement. Zo lichtte de minister van buitenlandse zaken bijvoorbeeld niet zijn collega s in over de stand van zaken. Aan het einde van de middag gingen we naar de UNMIK. Daar kregen we een college over de geschiedenis van Kosovo en de rol van UNMIK binnen het conflict. Zaterdag was een vrije dag en iedereen kon zelf weer bepalen wat ze gingen doen. De dag kreeg een andere draai toen we via Facebook vernamen dat er problemen bij de grens waren in Macedonië. Aangezien we een dag later terug zouden reizen naar Macedonië, hebben we contact opgenomen met de ambassade om te kijken of het veilig was om terug te reizen. Dit was gelukkig het geval en daarom konden we zondag gewoon vertrekken naar Macedonië.

5 8 Opinio Iuris 2014/2015(3) INTERNATIONAL LAW 9 De terugreis liep weer wat vertraging op, maar daar keken we niet meer van op. Er was namelijk een grote marathon op de rondweg van Prishtina waardoor we na 10 meter van het busstation een uur stil stonden. De instanties die we bezochten waren ontzettend interessant. Dit kwam mede dankzij het feit dat het volk in opstand was gekomen tegen de corrupte regering. Er waren namelijk een aantal telefoongesprekken van de ministers uitgelekt waaruit bleek dat de regering, bijvoorbeeld in een moordonderzoek, veel invloed uitoefende en corrupt was. De Nederlandse Ambassade kon ons goed uitleggen wat de huidige politieke situatie was en ook het eventuele lidmaatschap van de Europese Unie werd besproken. Daarna gingen we door naar het Helsinki Committee for Human Rights. Voor mij is dit een van de organisaties die veel indruk heeft achtergelaten. Het kantoor leek een beetje op een groot studentenhuis met allemaal kleine kamertjes waar vergaderd en gewerkt kon worden. De sfeer was heel anders dan bij de andere bezoeken, er hing een zeer gespannen sfeer. De Helsinki Committee is namelijk een activistengroep die erg actief is bij de protesten tegen de regering. Een aantal van hun leden was ook opgepakt en iedereen was daar hard aan het werk om ze weer vrij te krijgen. Ook waren ze bang dat er in Macedonië een grote oorlog kunnen uitbreken en zij wouden dit met alle macht voorkomen. Het maakte op mij een grote indruk omdat deze mensen echt leven voor hun ideaal en ook bereidt zijn om er veel dingen voor te laten. Als laatste gingen we naar de Europese Delegatie. Hier werd ook de situatie uitgelegd en de uitdagingen van Macedonië. Al met al was het een zeer geslaagde reis. Ik heb veel dingen geleerd en veel dingen gezien. Wat mij betreft ga ik er nog een keer naar terug naar Kosovo en Macedonie om meer van de natuur en gezellige mensen te genieten. INTERNATIONAL LAW Human rights in the current displacement crisis The Great Leap Forward? Veronika Flegar, LLM Sadly, pictures of overcrowded boats with asylum seekers and other migrants on the Mediterranean Sea have become common in today s news articles. In reacting to the current crisis, the European Union (EU) seems to be paralyzed. While much speculation already exists on the politics that govern this crisis, also the legal aspects involved are not always clear. Notably, a lack of consistent definitions has created confusion. Defining and reconceptualizing some of these definitions along the 1993 Vienna Declaration and Programme of Action s notion of interrelated, inalienable and universal human rights might bring us closer to a more comprehensive approach. This can contribute to legally sound and morally just implementation practices, which offer the necessary protection to those in extreme need. The flow of displaced or internationally relocating persons is highly diverse and involves many different and sometimes overlapping categories. These categories are regularly referred to in public discussion and in the media, often without specifying what they actually mean. You have probably heard of asylum seekers, refugees, regular migrants, economic migrants, political refugees, economic refugees, irregular or illegal migrants, undocumented persons, rejected asylum seekers and maybe of even other terms not mentioned here. However, do those terms really mean what some people think they do? Contrary to what is commonly assumed, traditional refugees in legal terms are not currently in the process of relocating. Rather, they have already arrived in another country and were granted international protection status there. This status can be granted on the basis of the 1951 Refugee Convention because the individual has a well-founded fear of being persecuted due to his or her race, religion, nationality, membership of a particular social group, or political opinion. 1 In addition to this refugee protection status, there are possibilities for subsidiary or complementary protection status, which is strictly speaking not a refugee status. 2 This protection can be granted for reasons such as fear of the death penalty, torture or indiscriminate violence and war and sometimes also for less explicitly articulated reasons. 3 Although legally speaking not entirely correct, people falling within any of these protection categories are often referred to as political refugees because the reasons for requesting protection are considered to have no economic motive. 4 So if refugees are not actually in the process of fleeing, who are the people we see escaping wars and terror on the news nowadays? These people are commonly called asylum seekers : people who are fleeing their country and request international protection i.e. asylum on the basis of one of the above-mentioned reasons. This still leaves us with other terms that are often used and remain less clearly determined in legal terms, but it is possible to make some basic distinctions: economic migrants and economic refugees are generally distinguished on the basis of whether they have left their country voluntarily ( migrants ) or 1 Article 1A(2) 1951 Refugee Convention. In the Netherlands, this is commonly referred to as the a-status in accordance with Article 29(a) Aliens Act In the Netherlands, this is the so-called b-status of Article 29(b) Aliens Act 2000.

6 10 Opinio Iuris 2014/2015(3) INTERNATIONAL LAW 11 involuntarily ( refugees ). However, since there is no clear legal basis for granting international protection on the basis of economic reasons, the term economic refugees is, strictly speaking, non-existent in legal terms (see below for some possible exceptions). In addition to the differences in reasons for international relocation, a distinction is also often drawn on the basis of residence status. This is where the terms of rejected asylum seeker, regular and irregular, illegal or undocumented migrant have evolved in common use. All persons crossing borders legally in order to reside permanently in another country would be considered regular migrants. This involves migration for reasons such as study, family, work and so on. On the other hand, people who may often be migrating for similar reasons but who are not entering or residing in a country legally would be called irregular, illegal or undocumented migrants. This can be due to them having overstayed a visa, having crossed the border with a false passport or without having been registered by the authorities, having been born to irregular parents in that country or due to a rejection of their asylum request (then rejected asylum seekers ). As I briefly hinted at above, these different and sometimes overlapping categories might help to explain why the displacement crisis is so hard to tackle: who of these persons should be granted what rights? What is their legal status? Are we even using the right categories? What if a person falls into more than one of these categories? Where should we draw the lines? Not only is the public generally confused and does the media even refer to legally incorrect terms such as illegal refugees, also when having in mind the core categories of refugees, asylum seekers, regular migrants and irregular migrants, the lines are increasingly blurred. For instance, how would you categorize the following persons and what protection and rights should they be given: a person fleeing the Ebola crisis? Someone who is forced to move due to a famine? A girl who fears female genital mutilation? A medical patient who cannot get the medical care necessary for his survival? A woman who is not actively persecuted but discriminated against indirectly through, for instance, lack of access to the labor market? A man who cannot marry his boyfriend or who might even go to jail for publicly displaying affection? A farmer whose crops, land and existence are destroyed due to climate change? Is it possible to fit these persons within any of the existing categories of those persons actually being granted protection in another country? For some of the above examples there are certainly possibilities while for other, arguably even more life-threatening, situations this may not be the case. This leads to the question of whether there are ways to reconceive internationally relocating persons in a more coherent manner. Human rights can contribute to such a reconceptualization through viewing persons in need of protection along the lines of actual need rather than along the lines of the five abovementioned persecution categories of the 1951 Refugee Convention, which were established in the aftermath and as a result of World War 2. The most promising principle in that respect is the principle of non-refoulement: this principle holds that a person may not be returned to a country where he or she would suffer torture or inhuman or degrading treatment or punishment. The principle had already been established in Article 33 of the 1951 Refugee Convention. However, the 1951 Refugee Convention only prohibits refoulement in the cases of the same five already outlined persecution categories of race, religion, nationality, membership of a particular social group, or political opinion. Moreover, the principle is limited by the provision that it does not apply to individuals who form a danger to the security or community of the country in which they are present. 5 This is where human rights law steps in and provides additional protection. The United Nations Convention against Torture as well as the International Covenant on Civil and Political Rights and the European Convention on Human Rights refer to the principle of non-refoulement directly or implicitly through prohibiting inhuman or degrading treatment. 6 These provisions generally broaden the concept beyond the five categories of the 1951 Refugee Convention to all types of torture or inhuman or degrading treatment or punishment that reach a certain level of severity. In addition, no limitations are possible and the principle is considered to be absolute even with regard to derogations in times of emergency. 7 Keeping this principle in mind, any state must very carefully assess whether returning someone to a situation of human rights violations of any kind would violate this principle. Still, the question remains: where do we draw the line? Which human rights are essential enough for their violation to amount at least to a sufficiently severe level of inhuman or degrading treatment (the thresholds of torture and punishment being even higher)? The right to life? The right to water? The right to employment? The right to health? The right to education? This is a difficult question, which human rights courts are still struggling to answer coherently. The European Court of Human Rights provides some guidance on this issue through cases such as MSS v Belgium and Greece and Tarakhel v Switzerland. 8 However, many aspects remain unclear and it is essential to redefine and reconceptualize who may be granted protection under what particular circumstances through streamlining these cases and truly live up to not only civil and political human rights standards but also pay more attention to protection needs due to economic, social and cultural rights violations. I do not call for an abolition of the five categories mentioned in the 1951 Refugee Convention because it still provides the most commonly acknowledged base line. Nevertheless, human rights law provides the key to make international protection status fit for reality. We need a redefinition of who may claim protection as well as a redefinition of what protection really means. This includes the protection of persons in a temporary or permanent situation of vulnerability and adapting the protection and rights granted on the basis of this vulnerability. Only in doing so, we can stay true to the values and morals we claim to have which is in essence the reason why we adopted human rights treaties in the first place. I do not have a clear answer on where to draw the line between those persons in a sufficiently severe situation of extreme need as to be granted protection and those who are not. Nevertheless, it is exactly this line, rather than the increasingly blurry line between political and economic reasons, that we have to remember, challenge and redefine if we want to solve the displacement crisis. Since we claim to have interrelated, inalienable and universal human rights, let s also make sure to truly live up to them when it comes to protecting those in extreme need for whatever reason. De rechter pas wel opzettelijk terughoudendheid toe. INTERNATIONAL LAW Klimaatzaak: Staat: het kan als je het wilt! Clara Palazzi Afgelopen woensdag 24 juni was het dan zover, de uitspraak van de Klimaatzaak stond voor deze dag gepland. Waar gaat de klimaatzaak over? Samen met 900 mede-eisers is Urgenda de Klimaatzaak begonnen tegen de Nederlandse Staat. Urgenda is de klimaatzaak tegen de Staat gestart omdat de overheid de urgentie van het klimaat probleem weliswaar erkent, maar te weinig maatregelen neemt om gevaarlijke klimaatverandering te voorkomen. Willen we niet dat het leven op aarde al in de tweede helft van deze eeuw zeer onaangenaam wordt, dan zal de uitstoot van broeikasgassen al voor 2020 sterk verminderd moeten worden. Aangezien de politiek er tot nu toe niet is uitgekomen heeft Urgenda zich tot de rechter gericht. De wetenschap is heel helder: we moeten voorkomen dat de aarde met meer dan twee graden opwarmt. De wereld koerst nu nog af op een opwarming van vier of zelfs zes graden Celsius, dit zal een onleefbare wereld betekenen in de toekomst. Het is de eerste keer dat een rechter een staat verplicht om maatregelen te nemen tegen klimaatverandering. De uitspraak was wereldnieuws de afgelopen week, niemand had verwacht dat de rechter zoveel lef zou tonen. Internationaal betekent deze uitspraak een steun in de rug voor alle klimaatzaken in andere landen. Het is nu duidelijk dat klimaatverandering een groot probleem is en dat het veel efficiënter moet worden aangepakt: Staten kunnen zich niet meer veroorloven onvoldoende te doen. Ze dienen hun burgers te beschermen. Het is nu dus aan de staat om de vele reeds bestaande duurzame oplossing te benutten. Of de Nederlandse staat nog in Hoger Beroep gaat zullen we moeten afwachten. Hopelijk heeft Sukke gelijk!: Bij het starten van de rechtszaak werd Urgenda geïnspireerd door Revolutie met Recht. In dit boek wordt gesteld dat het Nederlands recht genoeg aanknopingspunten heeft om klimaatregels van de overheid af te dwingen. Urgenda heeft aan de rechter gevraagd om naar de feiten te kijken en vast te stellen dat de Nederlandse staat onrechtmatig handelt. De uitspraak - (RB Den Haag 24 juni 2015, ECLI:NL:RBDHA:2015:7145) Tot ieders grote verbazing heeft de Rechtbank in Den Haag de eisers in het gelijk gesteld! De overheid moet nu meer en effectievere klimaatacties ondernemen om het aanzienlijke Nederlandse aandeel in de mondiale uitstoot te verminderen. Eigenlijk eist de rechter dat de overheid gaat doen wat ze zelf al noodzakelijk acht voor het voorkomen van gevaarlijke klimaatverandering. De Nederlandse staat moet in 2020 de uitstoot van broeikasgassen met ten minste 25 procent hebben teruggebracht ten opzichte van het niveau in (De huidige inspanning van de staat koerst slechts op zo n 16 a 17 procent in 2020.) De rechter concludeerde dat klimaatverandering wordt veroorzaakt door uitstoot en dat dit ernstige gevaren met zich meebrengt, onder meer door de zeespiegelstijging en voor de voedselvoorziening. Daarom is de rechter van oordeel dat de staat een zorgplicht heeft voor de bescherming en verbetering van het leefmilieu. De kosten voor het terugdringen van de uitstoot acht te rechtbank niet onaanvaardbaar hoog. Het argument dat Nederland maar een klein onderdeel is in het wereldwijde proces van klimaatverandering gaat niet op; elke vermindering kan tenslotte bijdragen aan het voorkomen van gevaarlijke klimaatverandering. Nederland kan natuurlijk niet in haart eentje het klimaat probleem oplossen, maar zij kan wel haar deel doen. Nederland behoort historisch gezien tot de grootste uitstoters ter wereld, per hoofd van de bevolking. Andere Europese landen zoals Denemarken en Duitsland richtten zich al op een reductie van 40% voor Het argument dat de rechtbank door uitspraak te doen in deze zaak op de stoel van het kabinet zou gaan

Dorit Hornung to a potential regulatory chill, meaning that states might become more and more reluctant to adopt legislative measures in areas such as health, safety and the environment as doing so could make them the target of exceptionally costly claims for damages. Secondly, another significant risk to social welfare poses the intended removal of NTBs, aimed at the safeguarding of sensitive policy areas governing, for instance, the regulation of genetically-modified food and product standards. A removal of such protective mechanisms could lead to an undesirable decrease of EU standards and, thus, a decrease in our quality of life. By analyzing the benefits and costs of TTIP, one is forced to conclude, that TTIP as it stands now is incapable of enhancing social welfare in the EU and will, therefore, be of limited success. In addition to this, after the EU Commission and the US agreed on the exact terms of the treaty, the EU Parliament and the parliament of every single EU Member State will have to agree to the treaty for it to come into force. Therefore, the transatlantic agreement would very likely be more successful if it was strictly limited to the reduction of trade barriers in sectors, which do not attempt to tackle highly sensitive policy areas, even though this would mean that smaller steps have to be taken in the liberalization of trade. Or because of different safety standards were you prevented from driving your precious German car in the US? The Transatlantic Trade and Investment Partnership (TTIP) currently negotiated between the European Union and the United States of America might be the solution to all of your problems or not? Dorit Hornung is a European Law School student and she wrote her bachelor thesis about the efficiency of the TTIP agreement. This article is a summary of her thesis. TTIP is a free trade agreement, which attempts to reduce barriers to trade; promising economic growth and increased employment rates on both sides of the Atlantic. The prospective treaty has received an unprecedented level of public attention due to the fact the initial negotiations between the EU Commission and the US about TTIP were conducted in secret and even now the lack of transparency is alarming. Even though the Commission has begun to publish fact sheets and textual proposals on TTIP in 2014, many anti-ttip campaigners remain skeptical regarding TTIP s efficiency and perceive it as a Trojan horse invading Europe, rather than a beneficial agreement aimed to enhance social welfare, i.e. the quality of life, in the EU. The main benefits brought forward by the Commission are TTIP s positive influence on economic growth and employment rates. As indicated by the Centre of Economic Policy and Research, TTIP is expected to increase the gross-domestic product in the EU by almost 130 million and in the US by 90 million until These numbers, however, are highly dependent on the level of compromises reached by the two TTIP partners concerning tariffs and non-tariff barriers to trade (NTBs). Furthermore, even though the EU Commission promised an increase in job creation, an initial shock is predicted, leading to many European citizens loosing their job before being reallocated to a new TTIP-related workplace. Notwithstanding the petty benefits TTIP is expected to generate, a decrease in social welfare may be caused by a prospective Investor-State Dispute Settlement (ISDS) mechanism and the removal of non-tariff barriers (NTBs). Firstly, the ISDS mechanism suggested in a current proposal on TTIP is seen as a major threat to democracy. This clause is supposed to enable investors to directly challenge governments in private international tribunals for changes in their legislation, which are detrimental to the investors business profits. 11 20 Opinio Iuris 2014/2015(3) INTERNATIONAL LAW 21 INTERNATIONAL LAW The Use of Drones under International Law Cleo Ruardij The use of unmanned aerial vehicles (UAVs), or so-called drones, in modern warfare is increasing rapidly. UAVs have proven to be highly successful and effective in operations in the Middle-East to fight and prevent terrorism. Therefore, the numbers of drones are most likely going to multiply in the future. Although UAVs are helpful, they are also controversial due to a high number of civilian casualties. Back in 2009, United Nations Special Rapporteur on Extrajudicial, Summary, or Arbitrary Executions Philip Alston stated that: My concern is that these drones, these Predators, are being operated in a framework which may well violate international humanitarian law and international human rights law. 1 The main purpose of international humanitarian law, or the jus in bello, is protecting those who do not directly participate in the hostilities and addressing rules for the behavior of belligerents. 2 The use of weapons during an armed conflict is not illegal. In the literature, there are several examples of legal and illegal weapons; nonetheless, since the use of UAVs is a relatively new one, they are not naturally mentioned in the literature. The three fundamental principles of jus in bello that governs the legal use of force, which are based in the Geneva Conventions of 1949, are the principle of military necessity, the principle of distinction and the principle of proportionality. 3 Distinction Besides military necessity, the targeting with UAVs needs to meet the principle of distinction. According to Article 48 of AP I, parties should make a distinction between the the civilian population and combatants and between civilian objects and military objectives. 7 Furthermore, article 51 AP I also requires that civilians enjoy general protection against the dangers arising from military operations. 8 According to the principle of distinction, only combatants are permitted to take a direct part in hostilities. 9 Civilians cannot do this and, as long as they refrain from doing so, they are protected under the rules of IHL. 10 Article 25 of the Hague Convention states that in case of an aerial bombardment, it is prohibited to hit undefended towns, villages or dwellings. 11 Although these articles give a clear explanation of the principle of distinction, it is often difficult to find the exact lines between on one hand combatants and military objectives and on the other hand civilians and civilian objects. This demands that enough information is available for the attacker at the time the decision whether or not to attack is taken. 12 Proportionality The principle of proportionality requires that the losses resulting from an attack should not be excessive in relation to the (expected) military advantage. 13 There is no specific article for the principle of proportionality, but is found in the spirit of two different articles: Article 51(5) of AP I prohibits attacks which may be expected to cause incidental loss of civilian life, injury to civilians [ ] which would be excessive in relation to the concrete en direct military advantage anticipated and Article 57 AP I which requires operators of weapons to refrain from deciding to launch any attack which may be expected to cause incidental, but excessive losses, in relation to the concrete and direct military advantage anticipated. 14 An example would be a munitions factory. This is most likely of such important matter that the death of civilians working there would not be disproportionate due to the military gains it provides. There is however some disagreement on this point. There are critics who argue that the civilian casualties as a result of drone targeting are never proportionate. 15 Moreover, some say that the military advantage is most of the times minimal and the importance of the target is overstated. 16 When bearing in mind these three fundamental principles, it is clear that the legality of drone strikes under international humanitarian law should be reviewed on a case-by-case basis. This, of course, is very difficult. Every strike is different. The conclusion that can be made is therefore that every strike could be considered disputable. Military Necessity Article 52(2) of Additional Protocol I requires that an armed attack shall be limited strictly to military objectives, make an effective contribution to military action and offers a definite military advantage. 4 According to this article, UAVs will most likely meet the principle of necessity. As noted above, UAVs are very successful in order to achieve the legitimate purpose of a specific conflict: currently eliminating terrorist forces. Nevertheless, it does not mean that every drone strike automatically is legal according to the principle of necessity. 12 22 Opinio Iuris 2014/2015(3) EUROPEAN LAW 23 Treaties were no longer applicable and Algeria had to renegotiate its relations with the EC. 4 EUROPEAN LAW Smooth transition: Introduction to the Principle of Harmonious Continuation Niek Berendsen Throughout the past decade, a movement in Scotland has grown in prominence, which aspires an independent Scotland within the European Union. This movement reached a zenith in 2014 when the Scots were given a vote on independence, which, however, resulted in a majority opposing secession. Leading up to the referendum, the European Commission stated that, despite Scotland s desire to remain inside the EU, international law dictated that when a region secedes from a Member State, this new state will automatically leave the EU on the day of independence, so it will need to reapply for membership. 1 In addition, negotiations on EU membership prior to its independence are regarded impossible, because accession matters can only be negotiated with states. The problem is that EU law does not provide any rules on internal enlargement, and therefore the Commission s statements are the only lead we have. However, if these statements of the Commission were to be followed, a hypothetical Scottish secession would amount to an uncertain situation, which should be prevented by applying the principle of harmonious continuation; a name which was invented by the present writer in his bachelor thesis. This article is an excerpt of that thesis and focusses on this principle. Principle of Harmonious Continuation This principle entails a duty to make arrangements to adequately cope with changing circumstances and avoid unnecessary and sudden disruptions, which often benefits both parties involved. In the case of Scotland, the abrupt termination of EU membership and subsequently the disturbance of the internal market, 2 EU citizenship 3 and the institutional status quo, can be regarded as such a disruption. This especially holds true, because Scotland is perfectly capable of becoming a Member State through the ordinary accession process, which typically takes about five years to conclude, so the disruption only takes a few years, which makes it unnecessary. According to the principle of harmonious continuation, the European institutions have a duty to prevent these disruption, for instance by providing a transitional period, negotiations or an exceptional application of the Treaties to allow Scotland to accede through internal enlargement. This principle, however, has not yet developed as a full-fledged legal principle, although it can be identified in the practices of several cases. In the following paragraphs, some of these cases will be discussed, in order to illustrate the functioning and origin of the principle. In 1962, Algeria gained independence from the 4th French Republic, of which it had been an integral part. In that capacity, Algerian territory enjoyed full EC (European Community) membership. After independence, the application of EC law did not abruptly cease. EC law remained applicable, although throughout the transitional period the applicability of EC law gradually eroded. After the Congress of Vienna in 1815, the present canton of Jura, which was previously an independent principality, was joined to the canton of Bern in the Swiss Confederation. The Jura is mainly Francophone and Roman Catholic, while the rest of Bern is Germanophone and protestant and therefore it wished to become a canton of its own. The Swiss constitution does not contain any provisions on internal enlargement, but instead of answering the question whether internal enlargement is possible, negotiations concluded the creation of an independent Republic of Jura on 1 January 1979, which simultaneously acceded as a canton to the Swiss Confederation. It inherited the rights and duties from the international and intercantonal agreements of Bern, for so far as they apply to the territory of the new canton. This prevented unnecessary disruptions. 5 When West Germany annexed the territory of East Germany in 1990, the EC territory also expanded. Usually, an expansion of EC s territory requires a Treaty amendment, but as the reunited Germany was regarded as the continuing state of West-Germany, no new Member State joined the EC and arrangements were made to avoid a time consuming Treaty amendment. Additionally, the international obligations of East Germany did not abruptly end, but were gradually terminated or incorporated into German law. 6 Greenland was an integral part of Denmark, until it was granted home rule in This meant that the region received a very high degree of autonomy, while it remains a part of the Danish realm. EC law remained applicable in Greenland, but in 1982 it held a referendum to leave the EC. It gained the status of Overseas Country or Territory (OCT) and EC law ceased to be applicable in Greenland. However, before this was executed, the Commission required negotiations, which took five years, in order to prevent disruption of the internal market. 7 Since the Treaty of Lisbon 2009, the TEU contains Article 50, which allows for EU Member States to withdraw their membership. This Article explicitly requires a Member State to notify the European Council and open negotiations with the EU institutions and other Member States, for the same reasons, namely the prevention of the internal market and other aspects EU law. It would be absurd if voluntary withdrawal requires negotiations, while negotiations are refused in the case of forced expulsion. Even in the practices of the CJEU a variant on the principle of harmonious continuation can be identified. In case C-295/90 European Parliament v Council [1992] ECR I-4193, the Court annulled a Regulation concerning residence rights for students. However, the effects of the Regulation annulled were maintained, until the a new regulation was adopted, in order to prevent the annulment from creating legal uncertainty by undermining student s residence rights conferred by the Treaties. Conclusion Although the principle of harmonious continuation is not yet a fully recognised legal principle, it is already widely used and should therefore also be applied to cases in which a region, for instance Scotland, secedes from an EU Member State.
