Kistenkas Language of instruction and examination: Dutch (necessarily in Dutch because most lawtexts (national and subnational legislation, case law) are in Dutch only) Assumed prerequisite knowledge: We assume general understanding of social concepts and theories for forest and nature conservation, achieved in the introductory WU BSc course RDS Continuation course: FNP Contents The core features of the course are basically fourfold: 1 Introducing EU and domestic governance The first lectures in week 1 deal with basic principles of public administration and public law, such as key principles and main features of Dutch and European government and institutional law (trias politica, redtapism/bureaucracy, regulatory hierarchy, centralization/decentralization, deconcentration and devolution). 2 Government & governance The 2d week focuses on the shift from government to governance, emerging New Public Management and governance approaches, variety of regulatory instruments, legal and spatial planning instrument mixes, environmental policy and environmental law transitions. 3 Regional governance De 3d week is about the scaling problems and scaling myths in environmental policy and law. Nature conservation, forest and landscape networks seem to demand an upscaling from local government to subnational, national or perhaps even European government

2 and governance. Also the traditional sectoral approach in environmental matters is currently being challenged by integral approaches. 4 European governance European law and policy is currently said to dominate nature conservation and forest law and policy (EU environmental directives, notably the Habitats Directive with its Natura 2000 network). Also global governance is emerging (f.i. Kyoto). The contents and impacts of these are being analyzed and discussed in week 4. In week 5 and 6 the acquired knowledge, skills and analysis of the first four weeks is being applied and integrated by means of a case study carried out by group work presentations, discussions and reports. The case studies are always introduced and discussed by a specialized guest lecturer in week 5 and in week 6 reflected by a legal workshop (lecturer: Kistenkas) and a governance workshop (lecturer: Termeer). Learning Outcomes After successful completion of this course students are able to: - 1. apply both European and domestic legislation and jurisprudence as well as governance approaches and new public management principles in solving novel cases on nature conservation and spatial planning (tested during written exam and through group work presentation and report; tutorials provide opportunities to practice the acquired knowledge and legal problem solving skills) - 2. analyze different actors, institutions and principles of Dutch and European governance and institutional law (tested during written exam) - 3. critically evaluate colliding or concurring views in literature, policy and law on nature conservation and spatial planning interactions (tested during group work presentation, report and discussion on group work case solving in parallel projects) - 4. creating a link between theoretical developments in public management and governance to environmental and rural area policy and law (tested during group work problem solving producing original work (report) and presentation+discussion (communication); parallel projects) - 5. recall different governance concepts and sections of Nature Conservation Act (Nbw), Spatial Planning Act (Wro), Forest Act (Boswet), Estate and Countryside Act (Nsw), Wildlife Act (Ffw) and Wild Birds and Habitats Directives (tested during written exam; lectures and tutorials provide opportunities to practice the acquired knowledge)

3 Course material Lecture slides (on Edu-web), case study material (to be used during parallel projects in week 5 and 6) and two textbooks (a governance textbook written by Termeer and a lawbook written by Kistenkas both on rural green-blue spatial development). Educational activities The final mark will be assembled from the score for the written exam (70%) and the score for the group work case report/oral presentation/in-class discussion (30%). In this course different methodologies for training and research are combined. Learning outcome sub 1 is achieved by lectures, tutorials, guest lecture, workshops, group work case report/oral presentation/in-class discussion. Feed back is given in tutorials, workshops and the final in-class discussion. As is already shown above, the learning outcome sub 1 is tested during written exam and through group work presentation and report; tutorials provide opportunities to practice the acquired knowledge and legal problem solving skills Learning outcomes sub 2 and sub 5 are mainly tested in the written exam after being analyzed in lectures and tutorials. Learning outcomes sub 3 and 4 are mainly tested and feedbacked in the week 5-6 parallel projects and group work case studies. Though also during lectures and guest lecture there will be complementary feed back possible. The written exam consists of governance questions (50%) and law questions (50%). Previous exam questions are being practised and discussed during lectures. Also reading skills on legislation and jurisprudence is practiced during lectures. Attending lectures is compulsory. Group work report and presentation will be assessed as follows: - contents must be complete as all particular case questions have to be answered and students must adequately master the relevant literature, legislation and jurisprudence - students must show creativity, originality and perhaps even novelty in discussing the topics of the case - students need to use both textbooks, lecture notes but also other scientific sources and additional referencing - composition of the report and writing style must be adequate: especially consistency and clarity of argumentation - presentation of the report and research findings (in powerpoint) and in-class discussion must be concise Schedule of the course See annexe I.
