1 Ernstige gezondheidsrisico's bij de invoer van paardenvlees uit Noord-Amerika Het paardenvleesschandaal brak enkele weken geleden uit en neemt sindsdien steeds grotere proporties aan. Ook bij andere producten doken plots overal gevallen van fraude op. Zo zouden er in Duitsland al jaren eieren verkocht worden als vrijeuitloopeieren, terwijl ze helemaal niet aan de voorwaarden voldoen. In België kwam recent ook aan het licht dat er al sinds 2011 een onderzoek loopt naar een paardenhandelaar uit Neufchâteau die mogelijks ongeschikte paarden in de voedselketen heeft binnengebracht door middel van documentenvervalsing. De politieke autoriteiten, met de Europese Commissie op kop, proberen deze brand, die zich zeer snel verspreidt over onze ganse voedselketen, met man en macht te blussen. Europees Commissaris Borg vroeg afgelopen donderdag, 28 februari 2013, tijdens een vragenuurtje in de Parlementaire Commissie voor Milieubeheer, Volksgezondheid en Voedselveiligheid bijna smekend aan de aanwezige parlementsleden om deze voedselcrisis enkel als een geval van fraude te zien, en zeker niet als een probleem voor de volksgezondheid. Nochtans zijn er zeer sterke aanwijzigingen in deze richting. Meer zelfs, de risico s zijn al jaren gekend, maar tot op heden kan de aan de illegaliteit grenzende trafiek van paardenvlees ongehinderd blijven doorgaan. En België blijkt een centrale rol te spelen in deze zaak. 1/3 geconsumeerd paardenvlees ingevoerd Het paardenvlees dat in de EU geconsumeerd wordt, ton per jaar, wordt deels in de lidstaten zelf geproduceerd (67 procent) en voor een deel geïmporteerd uit derde landen (33 procent). Het merendeel van de import (iets meer dan 85 procent) komt uit drie landen, met name Mexico, Canada en Argentinië (zie tabel). Na een onderzoek van GAIA in werd duidelijk dat de paardenslachthuizen in Mexico en Argentinië alle regels voor het dierenwelzijn op gruwelijke wijze aan hun laars lappen. Ons land blijkt de Europese draaischijf voor de invoer van paardenvlees te zijn. Zo komt bijvoorbeeld 75 procent van het Mexicaans paardenvlees dat bestemd is voor de Europese markt, in België aan. 2 Overgroot deel ingevoerd paardenvlees uit Mexico en Canada komt uit de VS Naast het onnoemelijk dierenleed, waaronder een soms 20 uur durend transport dat de paarden moeten ondergaan, zou het paardenvlees uit Mexico en Canada ook voor de mens schadelijke gevolgen kunnen hebben. De wortels van dit voedselveiligheidsprobleem liggen in de VS. In 2007 werden paardenslachthuizen in de VS bij wet verboden. 3 Vanaf dat moment zien we dat het verdwijnen van de import uit de VS, volledig gecompenseerd wordt door een sterk Humane Society International (2012) Facts and figures on the EU horsemeat trade - met data van Eurostat 3 Pas recent werd onder Obama een wet uitgevaardigd die het slachten van paarden in de VS weer mogelijk maakt. 1

2 opgedreven invoer van paardenvlees uit Mexico en Canada. Wat er in de praktijk gebeurt, is een omvangrijk transport van levende paarden uit de VS naar slachthuizen in Canada en Mexico. Deze getransporteerde paarden maken bijvoorbeeld in Canada 85 procent uit van het totale aantal geslachte paarden. 4 Dit zorgt ervoor dat ongeveer 18 procent van het paardenvlees dat op een Europees bord terechtkomt van een Amerikaans paard afkomstig is (zie tabel). Hierbij worden strenge regels opgelegd en regelmatig worden er door het FVO controles uitgevoerd. Volgens het FVO voldoet slechts een klein aantal slachthuizen aan de voorwaarden (zie Annex). In Mexico bijvoorbeeld, zijn slechts vier slachthuizen goedgekeurd. Opvallend is dat twee van deze slachthuizen een Belgische eigenaar hebben. Multimeats NV bezit Empacadora De Carnes De Fresnillo en Chevideco is eigenaar van Empacadora De Carnes Unidad Ganadera. 5 Een derde Mexicaans slachthuis, Cárnicos de Jerez, is dan weer eigendom van het Nederlandse Visser & Van Walsum. Wat medische behandelingen betreft, moeten paarden die bestemd zijn voor menselijke consumptie, voldoen aan verschillende Europese regels. 6 Met bepaalde middelen, zoals fenylbutazon en ontwormers, mogen ze tijdens hun leven nooit zijn behandeld. 3 Amerikaanse paarden niet gekweekt voor menselijke consumptie Omdat er in de VS geen paarden worden geslacht, worden ze dus ook niet gekweekt voor menselijke consumptie. Paarden worden in de VS gehouden als huisdier of als racepaard, waardoor ze onder andere wetgeving vallen en bijvoorbeeld wel mogen behandeld worden met de bovenvermelde middelen. Wetenschappelijk onderzoek 7 wees uit dat een groot aantal Amerikaanse racepaarden toch in ons voedsel terechtkomt. Deze studie toonde ook specifiek aan dat de onderzochte paarden tijdens hun leven behandeld werden met het verboden middel fenylbutazon. Sommige paarden kregen slechts enkele weken voor de geplande slachting nog een laatste behandeling. Ook de New York Times 8 beschreef onlangs nog uitvoerig het wijdverspreide gebruik van allerhande diergeneesmiddelen bij Amerikaanse racepaarden, waaronder ook veel middelen die zelfs bij paardenraces verboden zijn. Fenylbutazon Fenylbutazon wordt algemeen gebruikt bij paarden die niet bestemd zijn voor menselijke consumptie. Deze stof kent een typisch exponentieel verval, wat inhoudt dat de concentratie net na toediening wel snel afneemt, maar dat er toch zeer lang sporen van het product aanwezig blijven. Het geneesmiddel is streng verboden in voedingsmiddelen omdat het ondermeer risico s tot beenmergdepressie of aplastische anemie inhoudt, een zeer schadelijke vorm van bloedarmoede. Dit ziektebeeld houdt in dat de aanmaak van alle bloedelementen aangetast wordt. De stof is daarnaast ook kankerverwekkend. Documentenfraude Europese wetgeving vereist dat alle paarden die verwerkt werden in geïmporteerd vlees vergezeld worden van een zogenaamd paardenpaspoort, waarmee men het dier kan identificeren. Ook het medische verleden van elk paard, de tijdens het leven gekregen medische behandelingen, moet gekend zijn. Waar wringt nu de schoen? De paarden die uit de VS naar Mexico en Canada geëxporteerd worden, werden niet gekweekt voor menselijke consumptie en zijn dus meestal ook niet in het bezit van dergelijke officiële documenten. Pas wanneer het paard op een Amerikaanse veiling toch gekocht wordt voor transport naar Mexicaanse of Canadese slachthuizen, worden deze documenten opgesteld. De kans op al dan niet moedwillige fraude is in deze fase zeer groot. Omdat de paarden niet in de VS worden geslacht acht de Amerikaanse voedsel- en geneesmiddelenwaakhond, de FDA, zichzelf niet verantwoordelijk en voert het dus ook geen controles uit. Ook met de controle van deze papieren aan de Mexicaanse en Canadese grenzen loopt er heel wat mis. 4 Rapporten van het FVO Zo stond er in een FVO rapport over Canada uit 2011 te lezen dat: "de ontvangen documenten van de paarden afkomstig uit de VS, niet betrouwbaar waren en dat de informatie enkel door middel van het testen op residuen kon worden geverifieerd." 9 Na een onderzoek in Mexico in 2010 concludeerde het FVO: "dat de Mexicaanse autoriteiten de authenticiteit of betrouwbaarheid van de gezworen verklaringen van de schijnbaar drugsvrije paarden niet in vraag stellen, zelfs wanneer de aanwezigheid van medicijnen werd aangetoond." 10 Bij een nieuwe controle in 2012 stelde het FVO vast dat de situatie onveranderd was gebleven en dat: "het systeem voor de identificatie en de informatie over de voedselketen ontoereikend zijn om te garanderen dat er standaarden worden toegepast die equivalent zijn aan de EU-wetgeving. Dit gaat dan voornamelijk over de beëdigde verklaringen betreffende het niet behandelen van de paarden met bepaalde medische substanties zes maanden voor de slachting, zowel voor de paarden uit de VS als de Mexicaanse paarden." 11 Europese verantwoordelijkheid De Europese Commissie, die samen met de lidstaten verantwoordelijk is voor de voedselveiligheid op de Europese markt, heeft tot op heden weinig ondernomen om hier paal en perk aan te stellen. De vrees voor nieuwe handelsdisputen met derde landen en met de Wereldhandelsorganisatie kan hier voor iets tussen zitten. Men kan zich afvragen of dit ten koste mag gaan van de volksgezondheid? Commissaris Borg heeft meer dan voldoende reden om dringend aan te kloppen bij zijn collega voor handel De Gucht. Een van de sleutelelementen om vleesproducten in de EU te mogen invoeren 12 is de aanwezigheid van een bevoegd veterinair controleorgaan dat doeltreffende inspecties kan uitvoeren en geloofwaardige garanties kan bieden aan het importerende land. 5 medische geschiedenis van de uit de VS afkomstige paarden? Mogen deze landen dus nog blijven exporteren naar de EU? Gaat vrijhandel voor gezondheid? Nationale verantwoordelijkheid Elke lidstaat van de Europese Unie is verplicht controles uit te voeren wanneer voedsel op het grondgebied van de Unie wordt binnengebracht. In ons land is de FAVV hiervoor bevoegd. Het aantal fysieke testen bij geïmporteerd vlees is volgens Europese regelgeving afhankelijk van de risicofactor van het betreffende product. Moet bij geïmporteerd paardenvlees geen groter aantal proeven worden uitgevoerd, gezien de hierboven beschreven risico s? En wordt er wel op een adequate manier getest op de aanwezigheid van fenylbutazon en andere gevaarlijke stoffen in verse en verwerkte vleesproducten? Wordt er met andere woorden naar fenylbutazon gezocht daar waar de stof het meest voorkomt en dus de aanwezigheid het gemakkelijkst kan worden aangetoond, namelijk in het bloed of in de nieren? 13 Vorig jaar in juli werd bij een controle fenylbutazon aangetroffen in paardenvlees afkomstig uit Canada. 14 De open communicatie die hierrond werd gevoerd, kan zeker als positief worden beschouwd. Toch roept deze zaak bepaalde vragen op. Welke gevolgen werden gegeven aan de resultaten van de controle? Kan er nog beweerd worden dat er geen risico voor de volksgezondheid is en dat die er ook nooit geweest is? Kan de FAVV ook meer duidelijkheid scheppen over de betrokkenheid van Belgische bedrijven bij de Mexicaanse slachthuizen? Consumptie van besmet paardenvlees Bij het eten van één stuk paardenvlees waar residuen fenylbutazon in aanwezig zijn, blijft het gezondheidsrisico eerder beperkt. Maar bij veelvuldige consumptie van ongeschikt paardenvlees worden de risico's veel groter. De recente voedselschandalen tonen ons dat zelfs mensen die overtuigd zijn geen paardenvlees te consumeren, mogelijks toch via bijvoorbeeld diepvrieslasagnes meerdere malen met fenylbutazon in aanraking komen. Ook de meeste frituur- en andere vleessnacks bevatten een groot percentage paardenvlees. Hoewel bij deze producten de aanwezigheid van paardenvlees normaalgezien duidelijk op de verpakking staat vermeld, toont een enquête van Humane Society International aan dat de meeste Belgische frituurgangers zich hier niet bewust van zijn. 15 Ander voedselsysteem nodig Dit nieuw onderzoek toont eens te meer aan dat er, zeker met betrekking op vleesproducten, een sterke nood is aan een minder geïndustrialiseerde en minder complexe voedselketen. Wat we nodig hebben is een voedselketen die overzichtelijk en controleerbaar blijft, met respect voor mens en natuur. 6 vermindert. En waar er toch fraude wordt vastgesteld, moeten zware sancties worden opgelegd. Ook een rechtstreekser contact tussen consument en producent is noodzakelijk. Dit kan bijvoorbeeld gebaseerd zijn op korte-ketens en oorsprongslabeling. Kortom, we moeten meer weten wat we eten! Voedsel moet de belangrijke plaats in ons leven krijgen dat het verdient! 6

During the evaluation of the information provided by the CCA and the FBOs visited, it was noted that discrepancies exist between the number of horses imported and sent to the four approved slaughterhouses according to the CCA, and the number of horses with US origin slaughtered according to the FBOs." Rule 117 Bart Staes (Greens/EFA) Subject: Phenylbutazone and clenbuterol in Canadian horsemeat imports In July 2012, the Belgian authorities notified the European Commission regarding a consignment of chilled and frozen horsemeat from Canada in which residues of phenylbutazone and clenbuterol were found during official controls in a non-member country. According to the notification in the RASFF database, this consignment underwent physical/chemical treatment before being further distributed in Belgium, France, Germany, Italy, Luxembourg and the Netherlands. 16 The discovery of these substances highlights a greater concern about horsemeat imports from North America. I am also reliably informed that there is no mandatory veterinary medical record-keeping for horses raised in the United States and that the use of substances, such as phenylbutazone, is ubiquitous there too. It is a grave concern that audits carried out by the EU s Food and Veterinary Office in both Canada and Mexico between 2010 and 2012 concluded that the reliability and veracity of vendor affidavits with respect to the medical treatment history of US origin horses cannot be guaranteed and yet their meat is still accepted for import to the EU. Could the Commission please explain: 1. Why was the import and distribution of this consignment of horsemeat from Canada still permitted despite residues of substances banned for use in foodproducing animals being found? 2. What kind of physical/chemical treatment did this consignment of horsemeat undergo in order to justify its import and further distribution to six EU Member States? 3. Is there any indication that the horsemeat concerned derived from horses of US origin imported to Canada for the sole purpose of slaughter and export to the EU? 4. Why has the Commission not taken action to act on the FVO audits in Canada and Mexico to preclude the sale of horsemeat imports from North America that do not meet EU import requirements?

Rule 117 Carl Schlyter (Greens/EFA) Subject: Horsemeat imports from Canada and Mexico to the EU According to EU import requirements for food of animal origin from non-eu countries, only horses with a known medicinal treatment history, and which on the basis of medicinal treatment records can be shown to have satisfied the appropriate veterinary medicine withdrawal periods, may be slaughtered for export to the EU. Between 2010 and 2012, the EU s Food and Veterinary Office (FVO) carried out several audits in Canada 17 and Mexico 18. These audits consistently found that the systems implemented for the identification of horses, the food chain information and the reliability and authenticity of affidavits concerning the veterinary treatment of horses, particularly those of US origin, are insufficient to guarantee standards equivalent to those provided for by EU legislation are applied. The primary reason for this is that US horses are typically not raised for slaughter and there is consequently no mandatory veterinary medical treatment record-keeping and widespread therapeutic usage of substances, such as Phenylbutazone, banned for use in food-producing animals.
