4 ( ) Zouden Guillaume Vinke en zijn Marjolein echt vinden dat ik (terwijl ze me niet kennen) dit alles van hen mag weten? Ik heb na vijf minuten speurwerk geboortedata, telefoonnummer, volledig adres, namen van werkgevers, de naam van hun zoon, de school van hun zoon, en nog zo wat aanvullende informatie. Ik kan me -virtueel- al aardig als een van hen voordoen. In dit concrete geval kan me dit verder niet boeien, maar wat als ik het om een of andere reden op Guillaume Vinke voorzien zou hebben? Mensen reageren vaak tweeslachtig op dit soort analyses, die niets spannends om het lijf hebben en door iedereen uitgevoerd kunnen worden. De kern is echter dat onschuldige gegevens, vaak uit verschillende bronnen, ineens een heel ander karakter kunnen krijgen als iemand ze met kwade bedoelingen zou willen gebruiken. Mijn advies blijft om zuinig om te springen met persoonlijke informatie, ook als die ogenschijnlijk van onschuldige aard is. En daar waar je gegevens aan een derde of internet toevertrouwt, zie toe op een zorgvuldige verwerking ervan, binnen de doelstelling waar je die gegevens voor verstrekt hebt. Veel mensen mogen veel van mij weten, maar ik bepaal graag wie, wat en in welk verband. 6 De WBP is gebaseerd op Richtlijn 95/46/EC van 24 Oktober 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (30) Whereas, in order to be lawful, the processing of personal data must in addition be carried out with the consent of the data subject or be necessary for the conclusion or performance of a contract binding on the data subject, or as a legal requirement, or for the performance of a task carried out in the public interest or in the exercise of official authority, or in the legitimate interests of a natural or legal person, provided that the interests or the rights and freedoms of the data subject are not overriding; whereas, in particular, in order to maintain a balance between the interests involved while guaranteeing effective competition, Member States may determine the circumstances in which personal data may be used or disclosed to a third party in the context of the legitimate ordinary business activities of companies and other bodies; whereas Member States may similarly specify the conditions under which personal data may be disclosed to a third party for the purposes of marketing whether carried out commercially or by a charitable organization or by any other association or foundation, of a political nature for example, subject to the provisions allowing a data subject to object to the processing of data regarding him, at no cost and without having to state his reasons; (71) Whereas this Directive does not stand in the way of a Member State's regulating marketing activities aimed at consumers residing in territory in so far as such regulation does not concern the protection of individuals with regard to the processing of personal data; 11 De algemene uit 1995 THE DATA SUBJECT'S RIGHT TO OBJECT (Article 14) The data subject's right to object Member States shall grant the data subject the right: ( ) (b) to object, on request and free of charge, to the processing of personal data relating to him which the controller anticipates being processed for the purposes of direct marketing, or to be informed before personal data are disclosed for the first time to third parties or used on their behalf for the purposes of direct marketing, and to be expressly offered the right to object free of charge to such disclosures or uses. Member States shall take the necessary measures to ensure that data subjects are aware of the existence of the right referred to in the first subparagraph of (b). 12 De algemene uit

7 De bijzondere e-privacy richtlijn Article 6 Traffic data 1. Traffic data relating to subscribers and users processed and stored by the provider of a public communications network or publicly available electronic communications service must be erased or made anonymous when it is no longer needed for the purpose of the transmission of a communication without prejudice to paragraphs 2, 3 and 5 of this Article and Article 15(1). 2. Traffic data necessary for the purposes of subscriber billing and interconnection payments may be processed. Such processing is permissible only up to the end of the period during which the bill may lawfully be challenged or payment pursued. 3. For the purpose of marketing electronic communications services or for the provision of value added services, the provider of a publicly available electronic communications service may process the data referred to in paragraph 1 to the extent and for the duration necessary for such services or marketing, if the subscriber or user to whom the data relate has given his/her consent. Users or subscribers shall be given the possibility to withdraw their consent for the processing of traffic data at any time. 4. The service provider must inform the subscriber or user of the types of traffic data which are processed and of the duration of such processing for the purposes mentioned in paragraph 2 and, prior to obtaining consent, for the purposes mentioned in paragraph Processing of traffic data, in accordance with paragraphs 1, 2, 3 and 4, must be restricted to persons acting under the authority of providers of the public communications networks and publicly available electronic communications services handling billing or traffic management, customer enquiries, fraud detection, marketing electronic communications services or providing a value added service, and must be restricted to what is necessary for the purposes of such activities. 6. Paragraphs 1, 2, 3 and 5 shall apply without prejudice to the possibility for competent bodies to be informed of traffic data in conformity with applicable legislation with a view to settling disputes, in particular interconnection or billing disputes. 14 E-privacy uit
