1 Draaiboek bij overlijden van NL expats in Thailand Het overlijden van een partner, familielid, of goede bekende is altijd een aangrijpende zaak. Hieronder zijn adviezen vermeld hoe in dit geval te handelen. Het proces is redelijk eenvoudig, maar het vergt wat tijd & kosten. De consulaire afdeling van de Nederlanse ambassade raadt vrijwel direkt aan hiervoor de diensten van een gespecialiseerde begrafenisondernemer te gebruiken, maar deze diensten zijn kostbaar. U kunt het in de meeste gevallen zelf doen. Het proces is beschreven in 10 hoofdstukken: 1. Thuis overlijden, politierapport, overlijdensakte, euthenasie 2. Thuis overlijden Wanneer u, of een arts, het overlijden heeft geconstateerd, dient het dichtstbijzijnde politiebureau zsm te worden gewaarschuwd. Vervolgens komt de politie om te constateren dat er ogenschijnlijk geen misdaad in het spel is. Er wordt een rapport opgemaakt. De politie heeft in elk geval het paspoort van de overledene nodig. Een dag later kan het (gratis) politierapport op het bureau worden opgehaald. Zorg dat de naam correct is vermeld in het rapport en dat u het paspoort terugkrijgt! Het lichaam van iedere buitenlander die in Thailand thuis overlijdt (of in een particulier ziekenhuis, of elders buitenshuis; zie hoofdstuk 2) gaat naar het Forensic Department van het Police Hospital in Bangkok. De lokale politie regelt dit vervoer, als regel via de (gratis) diensten van de lokale Sawang Booriboon Foundation. Met het politierapport en het paspoort gaat u vervolgens naar het gemeentehuis/city Hall om een (gratis) overlijdensakte te verkrijgen. Ook hier: zorg dat de naam correct is vermeld en dat u het paspoort terugkrijgt! Pas op: deze akte vermeldt de vermoedelijke doodsoorzaak; de na autopsie vastgestelde doodsoorzaak staat pas in het rapport van het Forensic Department (zie verder). Maak een aantal kopieen van het paspoort, het politierapport, en de overlijdensakte, en zorg voor een gecertificeerde vertaling van de overlijdensakte in het Engels belangrijk voor allerelei andere meldingen. (Voor certificatie zie hoofdstuk 10.) Wanneer het Forensic Department heeft geconstateerd dat het een natuurlijke dood betrof (als regel vindt autopsie binnen 2 dagen plaats), wordt het stoffelijk overschot vrijgegeven voor crematie of begrafenis in Thailand, of voor vervoer naar Nederland. Daarbij wordt een autopsierapport verstrekt (zie verder). NB: De behandeling van het lichaam in het Forensic Department is correct en uiterst simpel, maar wekt op buitenstaanders gauw de indruk respektloos te zijn. U kunt het lichaam laten tonen, bv aan overgevlogen familie. Zorg dan wel eerst voor kleding van de overledene. Voor een vergoeding van (heden) 500 Baht verzorgt de staf het reinigen en aankleden van het lichaam. Belangrijk: Om het lichaam op te kunnen halen is een vervoersvrijgavebewijs (in het Thais) nodig van de consulaire afdeling van de Nederlandse ambassade in Bangkok (gratis). Zie hoofdstuk 3. Dit kan om goede redenen, zie verder enige tijd vergen. 1

2 Ga na ontvangst van het vervoersvrijgavebewijs vervolgens (kan direkt na het ambassadebezoek) naar het Forensic Department van het Police Hospital. De ingang is op Henri Dunant Road, niet ver van Rama I Road (achter Siam Square). Zorg dat u een Thaise helper bij u hebt, want niemand spreekt Engels! Naast het vervoersvrijgavebewijs heeft u nodig de Thaise overlijdensakte en het paspoort. (En ook uw paspoort, als u wordt genoemd in het vervoersvrijgavebewijs!) Het Forensic Department verstrekt een autopsierapport in het Thais waarin de feitelijke doodsoorzaak is vermeld. Daarvoor moet (verplicht) enige duizenden Baht worden betaald (ca Baht op dit moment). Maak van het autopsierapport een kopie want dat kan later (met een gecertificeerde & gelegaliseerde vertaling) nodig zijn voor de nalatenschap! Met het vervoersvrijgavedocument van de ambassade (en de andere genoemde documenten) kan het lichaam aan u worden vrijgegeven voor verder transport. Zorg dat u het vervoersvrijgavedocument & de andere documenten terugkrijgt! Voor zover nog niet gedaan: zorg voor kleding voor de overledene. Voor een vergoeding van heden 500 Baht verzorgt de staf het reinigen en aankleden van het lichaam. Voor verder transport zie de hoofdstukken 4 & 5. Samengevat, bij overlijden zijn 7 documenten belangrijk voor verdere akties: -Het paspoort van de overledene -Het politierapport -De overlijdensakte van de gemeente/city Hall (Thai) -De gecertificeerde vertaling in het Engels van de Thaise overlijdensakte -Het vervoersvrijgavebewijs van de ambassade, nodig voor elk transport -Het autopsierapport van het Forensic Department (of staatsziekenhuis) nodig voor testament e.d. -Een testament (zie hoofdstuk 7) Vermeld in documenten altijd eerst de achternaam, daarna de voornamen = exact gelijk aan datgene wat in uw paspoort staat, en doe dat in hoofdletters (want Thaise ambtenaren maken heel vaak fouten); zorg ook dat de Thaise vertaling van de Nederlandse naam altijd hetzelfde is! Euthanasie In Nederland is euthanasie in een onmenselijke of uitzichtloze situatie wettelijk geregeld; in Thailand niet. Een Nederlands codicil heeft hier dan ook geen waarde. Artsen in Thailand willen wel individueel hun standpunt geven, maar zekerheid krijgt men niet. Men moet dus hier ofwel afspraken met een arts maken, of zekerstellen dat er zonodig vervoer van de betrokkene tbv euthanasie naar Nederland wordt geregeld. Zie echter de bijlage Uiterste wilsbeschikking bij medische behandeling dat in principe door elk ziekenhuis wordt geaccepteerd omdat het berust op de Thai National Health Act, Art. 12, Part 1, 20 March2550. Hoofdstuk 2. In een ziekenhuis of elders buitenshuis overlijden Wanneer de betrokkene in een particulier ziekenhuis is overleden, dan volgt dezelfde procedure als in hoofdstuk 1. Wanneer de betrokkene enige dagen in een staatsziekenhuis heeft gelegen en aldaar is overleden, dan behoeft het lichaam niet naar het Forensic Department in Bangkok. De arts van het staatsziekenhuis verstekt in dat geval een overlijdensrapport (combinatie van politierapport & autopsierapport) waarmee men zich binnen 24 uur moet melden bij het gemeentehuis/city Hall, alwaar vervolgens de officiele overlijdensakte wordt afgegeven. Voor crematie of begrafenis in Thailand, of voor vervoer naar Nederland, is echter wel het vervoersvrijgavebewijs nodig van de ambassade (zie hoofdstukken 1 & 3). 2

3 Het lichaam wordt pas vrijgegeven door het ziekenhuis wanneer alle rekeningen zijn voldaan door de verzekering of door een nabestaande. Zie ook hoofdstuk 3, NB. Bij een misdrijf kan het een tijd duren voordat het stoffelijk overschot wordt vrijgegeven; eerst dient de schuldvraag te worden geadresseerd. Dit is ook het geval bij een ongeval buitenshuis met dodelijke afloop; het lichaam wordt dan naar het dichtstbijzijnde staatsziekenhuis gebracht, en vandaar (soms ook: direkt) naar het Forensic Department in Bangkok (zie hoofdstuk 1). Hoofdstuk 3. De Nederlandse ambassade & het vervoersvrijgavedocument Ongeacht waar het overlijden plaatsvond, moet de consulaire afdeling van de Nederlandse Ambassade in Bangkok direct worden gewaarschuwd (zie hoofdstuk 10). Eerst telefonisch, later door een bezoek aan de ambassade om het belangrijke (gratis) vervoersvrijgavedocument te verkrijgen. Dit document is nodig voor vrijgave van het lichaam door het Forensic Department en voor elk transport van het lichaam in Thailand, voor crematie of begrafenis, of voor transport naar Nederland. Ga naar de ambassade in Soi Tonson, Ploenchit Road (= vlak bij de kruising met Wittayu/Wireless Road). Neem het paspoort en de overlijdensakte + de gecertificeerde vertaling mee (en ook uw eigen paspoort!). Pas op: Het paspoort van de overledene wordt ter plaatse door de ambassade ongeldig gemaakt door er grote ponsgaten in the maken (vandaar: maak zelf eerst kopieen van het paspoort om leesbare kopieen te hebben!). Belangrijk: De consulaire afdeling van de ambassade kan het vervooersbewijs alleen direct aan u verstrekken indien u kunt bewijzen (d.m.v. wettelijke stukken) dat u de wettelijke partner van de overledene bent (b.v. door huwelijksakte of partnerschapscontract of ander erkend document), of een familielid. Al deze opties hierna te noemen wettelijke relatie. Voor het verkrijgen van het vervoersvrijgavebewijs van de ambassade is het volgende van belang: Voor een overledene zonder een wettelijke relatie in Thailand is de ambassade verplicht om het Ministerie van Buitenlandse Zaken in Den Haag in kennis te stellen van het overlijden. De ambassade kan dan verlangen dat de gecertificeerde Engelse vertaling van de overlijdensakte wordt gelegaliseerd door het Thaise Ministerie van Buitenlandse Zaken (zie hoofdstukken 9 & 10). Door legalisatie krijgt het vertaalde document dezelfde, geautoriseerde, juridische status als het oorsprokenlijke Thaise document. Via het Nederlandse Ministerie van Buitenlandse Zaken worden dan vervolgens familieleden ingelicht (zo die er zijn; het is raadzaam ook naam, adres, telefoon van deze familieleden te verstrekken), en dat kan, o.a. door tijdsverschil, enige tijd duren. Wanneer niemand in Nederland het stoffelijk overschot opeist, dan wordt dit gemeld aan de ambassade, en dat geeft de ambassade het recht om te autoriseren dat het lichaam in Thailand wordt gecremeerd of begraven en het het vervoersvrijgavedocument aan u te verstrekken. Dit proces kan enige tijd vergen, ook door tijdsverschil en beschikbaarheid van familieleden. Bespreek dit z.s.m. met de consulaire afdeling om dit te versnellen. De ambassade kan afzien van een gelegaliseerde vertaling van het overlijdensbericht en accepteren dat u gescande documenten per toestuurt. Uiteraard dient u bij later bezoek aan de ambassade de originele documenten te verstrekken. NB: Wanneer er geen Thaise of Nederlandse nabestaanden zijn, en ook anderen niet de kosten dragen, dan worden alle verdere zaken door de ambassade geregeld (in Bangkok). De ambassade kan uw medewerking verzoeken voor de verdere afwikkeling. Hoofdstuk 4. Vervoer in Thailand voor crematie of begrafenis Het vervoersvrijgavedocument van de Nederlandse ambassade is nodig voor elk transport in Thailand en 3

4 voor de crematie of begrafenis. Zie hoofdstuk 3. De tempel of kerk is de laatste instantie die dit document gebruikt (en behoudt!). Het vervoer vanaf het Forensic Department in Bangkok dient u zelf te regelen. Personeel van de Sawang Booriboon Foundation in Pattaya kan dat verzorgen, maar nu tegen betaling van (heden) ca. 8,000 Baht, inclusief de gebruikelijke, vrij eenvoudige, wit-met-goud-kist. Ook kan het vervoer ter plekke bij het Forensic Department worden geregeld (niet echt aan te raden). Het vervoer is per pick-up truck. U kunt uiteraard ook kiezen voor duurder transport per ambulance. Om de crematie/begrafenis te regelen gaat u naar een lokale tempel/kerk. U meldt zich bij de abt/pastorie. Er wordt een ceremoniemeester aangewezen om met u de crematie/begrafenis te regelen. De tempel/kerk heeft het vervoersvrijgavedocument van de ambassade nodig om het lichaam te mogen cremeren of begraven. De transportkist wordt voor de opbaring in de tempel/kerk als regel tijdelijk verwisseld door een fraaier uitschuifbaar exemplaar met koeling. Uiteraard kan men bloemen, evt muziek, en andere zaken zelf regelen, maar in de praktijk is het aan te raden uw wensen aan de ceremoniemeester kenbaar te maken. Hij weet hoe deze zaken het beste kunnen worden geregeld. Lever zsm een grote foto met lijst (minimaal A4) van de overledene aan de tempel/kerk; deze wordt bij de kist geplaatst. In een tempel is het gebruikelijk om drie avonden lang vier tot negen monniken om 19:00 uur crematiegebeden te laten opzeggen. Iedere keer biedt men na dit ritueel wat bloemen aan en een envelop met geld. Na deze gebeden wordt elke keer heilig water door de ceremoniemeester in een bord gegoten. In een kerk zijn soortgelijke rituelen. Op de dag van de crematie regelt de ceremoniemeester een simpele maaltijd voor het aantal monniken dat de dienst zal uitvoeren. Deze maaltijd is om 11:00 uur (de tijd voor het laatste dagmaal voor de monniken). Een papieren bloem met kaarsje wordt tijdens de gebeden aan de aanwezigen verstrekt; later legt men deze op op/in de kist bij het crematorium. Wanneer de monniken klaar zijn met het opzeggen van de gebeden worden er door de gasten bloemen en een envelop met geld aangeboden aan alle monniken. Dit is dan tevens het moment waarop een eventuele toespraak kan worden gehouden. Aan het eind van de dienst wordt het lichaam van de gekoelde kist in de simpele wit-met-goud kist gelegd. De ceremoniemeester arrangeert de dragers van de kist. Dat kunnen bekenden zijn van de overledene, of tempelhulpen. Naar keuze kan men met de kist driemaal om het crematorium lopen, maar de kist kan ook rechtstreeks op het platform van het crematorium worden gebracht. Als de kist voor de oven staat kan de Thaise gewoonte worden gevolgd om daar robes te plaatsen die later aan de monniken worden gegeven. De ceremoniemeester opent de kist, en de gasten lopen langs de kist en leggen daarin de papieren bloem met kaarsje. Men kan de kist ook gesloten houden. Ook kan het zijn dat de kist eerst in de oven wordt geschoven en dat de gasten langs de oven lopen. De monniken reciteteren wederom gebeden, waarna hen de robes en een envelop met geld wordt aangeboden. U kunt na afloop ter plaatse nog wat drinken/eten, of u kunt met de gasten naar een gelegenheid gaan om nog na te praten en de gasten de gelegenheid tot condoleren te geven. Er is overigens niets mis mee om meteen naar huis te gaan. De dag na de crematie gaat u met een katoenen of linnen witte doek plus urn naar het crematorium om de as en wat beenderen van het stoffelijk overschot te ontvangen. Het verzamelen wordt gedaan door de ceremoniemeester. Het is niet ongebruikelijk dat dan weer enkele monniken gebeden opzeggen en daarna bloemen en een envelop krijgen. Er zijn ook andere mogelijkheden waarover de ceremoniemeester u kan inlichten. 4

5 Met de urn kan men doen wat men wil. Sommigen strooien de resten uit op zee, anderen brengen de urn naar het geboorteland van de overledene, en weer anderen plaatsen de urn in huis. De richtprijs voor een dergelijke crematie is (heden) rond Baht (reken op minimaal 25,000 Baht). In de enveloppen die een paar maal aan de monniken na de gebeden worden gegeven doet men een bedrag van 2 á 300 Baht. Hoofdstuk 5. Vervoer naar Nederland De procedure voor repatriatie vergt circa een week. Er zijn begrafenisondernemers die over ervaring beschikken om dit transport te verzorgen. Raadpleeg de ambassade. De firma zorgt voor de voorgeschreven balseming en een zinkbeklede kist. Met de overlijdensakte en het vervoersvrijgavebewijs van de Nederlandse ambassade haalt de firma het lichaam op bij het Forensic Department en ontvangt daar ook het autopsierapport (zorg dat u daarvan een kopie ontvangt). De firma verzorgt een verklaring van balseming, en kan desgewenst het transport met de luchtvaartmaatschappij regelen. De totaalkosten daarvan zijn zeer fors. Men zou daarom ook kunnen kiezen voor het verzenden van de urn. Hoofdstuk 6. Verzekering Veel toeristen (maar ook aardig wat expats) zullen een reis- of ongevallenverzering hebben die een deel of (zelden) alle kosten van overlijden vergoedt. Een enkeling zal zelfs een overlijdensverzekering hebben. (Verstrek dergelijke details als onderdeel van uw testament!) Bij een permanente verzekering ontvangt men als regel geen jaarlijkse polis; een betalingsbewijs is dan het enige houvast. Expats zullen als regel niet zijn gedekt bij overlijden in Thailand indien uitgeschreven in Nederland. Onderzoek of er een verzekering is, en neem contact op met de verzekering. Als dat niet direct mogelijk is, houd dan de uitgaven op een matig niveau, bewaar alle betalingsbewijzen en controleer later de papieren van de overledene om te zien of er enige dekking is. Repatriatie van het lichaam (naar Nederland) is verreweg het kostbaarste. Sommige verzekeraars dekken deze kosten, vaak op voorwaarde dat zij onmiddellijk in kennis worden gesteld van het overlijden. Zij bepalen dan als regel ook welke dienstverlener moet worden gebruikt (begrafenisondernemer, luchtvaartmaatschappij). Hoofdstuk 7. Testament & Afwikkeling Testament Houd rekening met het feit dat alle transakties waarvoor de handtekening en/of aanwezigheid van de overledene vereist is, niet langer mogelijk zijn. Dat klinkt vanzelfsprekend, maar weinigen houden hiermee vooraf rekening. Het is aan te bevelen om, als onderdeel van regelingen voor een testament, contact op te nemen met de Thaise bankmanager om te bespreken welke regeling mogelijk is om te voorkomen dat Thaise (of andere) nabestaanden zonder geld komen te zitten. Vrijgave van bezitingen aan nabestaanden/erfgenamen hangt af van het al dan niet bestaan van een testament in Thailand (of in Nederland). Zonder geldig Thais testament zullen de Thaise autoriteiten beslissingen nemen over de bezittingen (via een gerechtsuitspraak, vergt als regel ca. 3 maanden). Dit kan problemen opleveren voor de nabestaande(n). Het maken van een testament in Thailand is eenvoudig. Een geschreven document in de eigen taal of in het Thais, voorzien van de eigen handtekening en de handtekeningen van twee getuigen, is voldoende. Voor het gerechtshof moet een testament gecertificeerd in het Thais worden vertaald (zie hoofdstuk 10). 5

6 Voor het maken van een testament verdient het aanbeveling een Thaise certified notary public in te schakelen (zie hoofdstuk 10). Deze heeft standaard voorbeelden, weet wat er zoal in een testament zou moeten staan, en getuigen zijn op kantoor aanwezig. In het testament kan, naast het benoemen van erfgenamen, ook worden aangeven of men in Thailand gecremeerd of begraven wilt worden. Uiteraard ook de naam van de executeur testamentair (= degene die de laatste wil moet uitvoeren). Wanneer er een erkend partner is, is een testament-op-de-laatst-levende gewenst, waarin ook aangegeven dat de overlevende gebruik kan maken van huis, bankrekeningen en dergelijke. Zonder een geregisteerde partner kan alleen de executeur of de advokaat noodzakelijke betalingen verrichten. Het is mogelijk om een Nederlands testament geldig te maken in Thailand. Laat daarvoor in Nederland een gecertificeerde vertaling in het Engels maken, en laat deze vertaling hier gecertificeerd vertalen in het Thais (zie hoofdstuk 10). Het is aan te bevelen om altijd de eigen naam en adres plus dat van een goede bekende in Thailand bij u te hebben. Zo kan er altijd iemand gewaarschuwd worden. Ook de plaats van sleutels, code van de safe, pincodes en zaken als de toegangsprocedure voor de computer zouden (bv verzegeld) moeten worden achtergelaten bij de partner of een betrouwbare derde. De executeur testamentair is verantwoordelijk voor de afwikkeling van de nalatenschap. In Thailand: raadpleeg desgewenst de advokaat die het testament heeft opgemaakt. In Nederland: via internet en notaris, belastingdienst/-adviseur zijn nadere instrukties te krijgen. Hoofdstuk 8. Formaliteiten in Nederland Bericht van overlijden dient zo spoedig mogelijk te worden verstuurd aan allerlei instanties, zoals: De gemeente waarin de overledene woonachtig was (indien niet uitgeschreven). Indien uitgeschreven, stuur melding aan de Gemeente Den Haag via formulier (de link vermeldt huwelijksakte maar het formulier is ook voor inschrijving van de overlijdensakte). Pensioenfondsen (particuliere pensioenfondsen en de Sociale Verzekeringsbank voor AOW) en levensverzekeraars Ziektekostenverzekeraars Banken in Thailand & Nederland Credit card companies Belastingdienst Voormalige werkgever(s) Etc. Controleer de papieren (en portemonnee) van de overledene om te zien of er meer nodig is; ook bankafschriften. Zorg dat u het burgerservicenummer van de overledene heeft. Het beste is aan alle organisaties een aangetekende brief te verzenden met daarbij ingesloten de gecertificeerde vertaling van de overlijdensakte plus een copie van het ongeldig gemaakte paspoort. Voor hen die in Nederland staan ingeschreven kan de burgerlijke stand verlangen dat de gecertificeerdvertaalde overlijdensakte is gelegaliseerd door het Thaise Ministerie van Buitenlandse Zaken. Gezien de effort & kosten is het aan te raden met deze legalisatie te wachten totdat dit verzoek wordt ontvangen. Kan eventueel ook in Nederland bij de Thaise ambassade. Hoofdstuk 9. Documenten De volgende documenten zijn belangrijk: 6

7 Paspoort van de overledene: nodig voor alle andere hoofd-documenten (en voor meldingen in Nederland aan diverse instanties); maak kopieen, want het paspoort wordt door de ambassade direkt ongeldig en onleesbaar gemaakt. Leesbare kopieen kunnen later nodig zijn, bv voor het Thaise gerechtshof en de afwikkeling van het testament. Politierapport van het overlijden: is beschikbaar op de dag nadat de politie van het overlijden werd verwittigd. Nodig voor het verkrijgen van de overlijdensakte bij City Hall/gemeentehuis. Overlijdensakte van City Hall/gemeentehuis: wordt direkt gemaakt op basis van het politierapport en het paspoort. Maak kopieen! Gecertificeerde Engelse vertaling van de Thaise overlijdensakte: is nodig voor meldingen aan de Nederlandse ambassade en allerlei instanties in Nederland, zoals burgerlijke stand, belastingdient, verzekeringen, SVB en pensioenmaatschappijen, etc. Maak kopieen! Vervoersvrijgavebewijs van de Nederlandse ambassade in Bangkok: is nodig om het lichaam op te halen voor verder transport, bv voor tempel of kerk in Thailand, of voor het transport van het lichaam naar Nederland. Autopsierapport van het Forensic Department in Bangkok: is nodig voor de crematie, begrafenis, of het transport naar Nederland. Maak kopieen! Testament: is aan te raden voor een soepele afwikkeling van de nalatenschap. Kan zowel in Thailands als in Nederland worden gemaakt (in Thailand bij voorkeur bij een certified notary public ). Laat een verzegelde kopie achter bij uw partner of een vertrouwde! Legalisatie van documenten kan nodig zijn voor bepaalde juridische handelingen. Voor oorspronkelijk Thaise documenten wordt dat in Thailand tegen betaling verzorgd door de afdeling Legalization van het Department of Consular Affairs van het Thaise Ministerie van Buitenlandse Zaken (zie hoofdstuk 10) en in Nederland via de Thaise ambassade, op basis van een (eerdere) gecertificeerde vertaling in het Engels. Kan worden verlangd voor de overlijdensakte van City Hall en het autopsierapport van het Forensic Department. Hoofdstuk 10. 10 30 June 2010 E. What to do when a Dutch expat passes away in Thailand? No matter how prepared we may be, the passing away of a loved-one is always a matter of great grief and sadness. Below is a description of the process to deal with the physical and especially administrative details. The process is relatively simple & straightforward, but it takes time and expenses. You can also choose to make use of a professional service company, but their service is not cheap and in most cases you can handle it yourself. The process is described in 10 chapters: 1. Passing away at home, Police Report, Death Certificate, Euthanasia 2. Passing away at a hospital or elsewhere outside the home 3. The Dutch Embassy & the Release Document 4. Transport of the body in Thailand & cremation or burial in Thailand 5. Transport of the body to the Netherlands 6. Insurance 7. Last Will & execution of the Last Will 8. Passing away at home After you or a doctor have noticed the death, contact the nearest Police Station as soon as possible. The police will come to verify the death and to make an initial assessment that no crime was committed. (If a crime is suspected, then a forensic team will be called.) The police will request the passport of the deceased and will make a Police Report (free) that can be picked up at the police station on the same or next day (do not forget to ask for the return of the passport). Make sure that the name of the deceased is stated correctly = exactly as in the passport! Make a copy of the Police Report, and also make several good copies of the passport of the deceased. (When possible: make scans.) The body of any foreigner passing away in any other location than a government hospital, must be transported to the Forensic Department of the Police Hospital in Bangkok at Henri Dunant Road, see chapter 10. The local police will take care of this transport, usually through the (free) services of the local Sawang Booriboon Foundation. Go to City Hall with the Police Report and the passport. In Pattaya go to the second floor in the front of the building. After filling in a form, you will receive almost immediately a (free) Death Certificate that lists the probable cause of death (the actual cause of death will be listed on the autopsy report of the Police Hospital in Bangkok). Make sure that the name of the deceased is stated correctly = exactly as in the passport. Make several copies of the Death Certificate & get it translated into English by a certified translator (see chapter 10). Also make several copies of the certified translation. (When possible: make computer scans.) After the Forensic Department of the Police Hospital in Bangkok has determined a natural cause of death (= no crime was involved; the autopsy is usually performed within 2 days), the body can be claimed for transport to the location of the cremation or burial, or for transport to the Netherlands. However, the body can only be claimed with a (free) Release Document in Thai that is issued by the Dutch Embassy in Bangkok. See chapter 3. With the Release Document + Thai Death Certificate + Passport (& your passport, when you are named in the Release Document!) then go to the Forensic Department on Henri Dunant Road (name is on the building) to claim the body (not free, count on around 5,000 Baht). Fill in some forms, pay the amount 10

11 requested, and get the Autopsy Report (make several copies). It is best to have a Thai-speaking person with you as the forensic staff mostly does not speak English. Make sure that the Release Document is returned to you (plus all other documents) as it is also the authorization needed for the cremation or burial or for transport to the Netherlands. (For the latter: see chapter 5). Have clothing for the deceased with you. You (or the family, friends) can see the body at the Forensic Department, basically at any time. However, be prepared for the fact that bodies are treated correctly but very simply. This may create the impression of being disrespectful. For a small fee (currently 500 Baht), the staff of the Forensic Department will clean & dress the body. The next thing to arrange is the transport of the body from the Forensic Department to Pattaya (or wherever this is needed). See chapters 4 & 5. In summary, the following 7 documents are the most important for further actions: - Passport of the deceased - Police Report - Death Certificate of City Hall (of course in Thai) - Certified translation of the Death Certificate into English - Release Document of the Dutch embassy, required for transport, cremation, etc. - Sometimes: Autopsy Report of the Forensic Department (or state hospital) - Last Will/Testament (see chapter 7) Euthanasia: Thai law does not have provisions for euthanasia, nor does it recognise euthanasia codicils made in the Netherlands. Doctors in Thailand may or may not cooperate. Do not take matters into your own hands! In the worst case arrange transport of the ill patient to the Netherlands, or go to a friendly hospital (ask first). The Thai National Health Act, Art. 12, Part 1, dated 20 March 2550 makes it possible to limit the extent of medical help at all costs. See attachment. Chapter 2: Passing away at a hospital or elsewhere outside the home When the deceased passed away at home, in a private hospital or anywhere else outside the home, the procedure as described in chapter 1 must be followed. When the deceased passes away in a government hospital (after some days of hospitalization) then the government hospital will issue a Medical Declaration that is a combination of the police report and the autopsy report. Make copies & get a certified translation (& make copies of the translation). You must then report within 24 hours to (the nearest) City Hall/Sub District/District Office to obtain a Death Certificate. Make copies & get a certified translation (& make copies of the translation). Just as described in chapter 1, you must get a Release Document from the Dutch Embassy in order to transport the body in Thailand, and also for the cremation, burial, or transport to the Netherlands. See chapters 3-5. You must have the Release Document before the body can be transported! Also note that a hospital will usually only release the body after all bills have been paid, or guaranteed by the insurer. See also chapter 3, final paragraph. The release of the body may be delayed in case of a (suspected) crime as the guilt needs to be established. This may also be the case with a deadly accident (traffic or otherwise). In such cases, the body is transported by the police to the nearest government hospital and from there to the Police Hospital in Bangkok. 11

12 Chapter 3. The Dutch Embassy IMPORTANT: Regardless of where the person has died, the Consular section of the Dutch Embassy must be notified as soon as possible. First by telephone (see chapter 10), then by a visit to obtain the important (free) Release Document that is needed for any transport of the body in Thailand, and for the cremation or burial in Thailand, or for transporting the body to the Netherlands. The Consular section may also help you with any questions. To obtain this document, go to the embassy in Soi Tonson, Ploenchit Road (= near the intersection with Wittayu Road), see chapter 10). Bring Death Certificate + Certified Translation + Passport (and your own passport!) Please note: During your visit, the embassy will invalidate the passport of the deceased by punching big holes in it. (That is why you must make several copies in advance.) Important: The embassy s consular section can only issue the Release Document immediately to you when you can prove (= with related documents) that you are the legal partner (by marriage or partnership agreement recognized by Dutch law) or a family member of the deceased (all these categories hereafter called legal relation ). If there is not such a legal relation in Thailand, then the embassy must notify the Dutch Ministry of Foreign Affairs, and for this, the embassy may ask for a legalized translation of the Death Certificate by the Thai Ministry of Foreign Affairs, Consular Department (chapter 10) = the certified translation receives an official seal of approval and now has the same legal status as the Thai original. The Dutch Ministry of Foreign Affairs must notify the family of the deceased in the Netherlands (to speed up this process, provide name(s), address, telephone numbers of relatives to the Dutch embassy). This may take some time. When the body is not claimed by relatives in the Netherlands, then the Dutch embassy will be notified, and the embassy can issue a Relase Document that is needed for transportation of the body in Thailand and for cremation or burial in Thailand. This process make take some time, caused by different time zones and the availability of relatives. Call the Dutch embassy s consular section as soon as possible to speed up this process (see chaper 10). The embassy may waive the legalization of the certified translation of the Death Certificate and accept that you send scanned documents via of course, you must present the originals of the scanned documents later to the embassy. Note: When there are no Thai or Dutch relatives or dependents, and no one will pay the expenses, then the Dutch embassy will take care of this (in Bangkok). The embassy may request your cooperation for further arrangements. Chapter 4. Transport of the body in Thailand, cremation or burial Please keep in mind that you need the Release Document of the Dutch Embassy for any transport in Thailand, as well as for the cremation or burial. See chapter 3. The temple or church is the last one to use (& keep) this document, and may also ask for other documents (have copies ready). You must arrange the transport of the body from the Forensic Department in Bangkok to the final destination (temple for cremation or church for burial). Transport to Pattaya can be arranged via employees of the Sawang Booriboon Foundation in Pattaya (the police can tell you where to find them). The transport is by pick-up truck or van with the body in a simple (white & gold) casket and currently costs around 8,000 Baht, inclusive the casket. The driver can assist you with formalities at the Forensic Department. The transport can also be arranged by pick-up truck services at the Forensic Department (not a good idea), or by ambulance (costly). The cremation or burial is arranged with the temple or church. Every temple and church has someone with whom you can discuss details of the ceremony. The temple or church needs the Release Document for the cremation or burial. The cost for the cremation or burial depends on the temple or church, the level of services, decorations & ceremonies. The cheapest cremation in Pattaya will cost around 50,000 Baht. 12

13 It is customary to have a portrait of the deceased at the ceremonies (minimum size A4, framed). You can have speakers (but don t speak too long) and you usually can bring your own music. Not necessary, but commonly done, is a get-together at a local restaurant after the service, with snacks and drinks offered by the partner/family of the deceased. Chapter 5. Transport to the Netherlands The process of repatriation takes around one week. As the body must be embalmed and placed in a zincclad casket, you must use the services a professional undertaker. Contact the Embassy for such undertakers. The undertaker needs the documents as discussed earlier. You (or the undertaker) must also make arrangements with the airline. Price & options for this may differ per airline. Be prepared for high total costs. When the deceased is insured (e.g. via travel insurance), then contact the insurance to find out what is covered, and get written permission (fax, ). Note: The cost of shipment of the remains can of course be substantially reduced by sending an urn with the cremated remains to the Netherlands. Chapter 6. Insurance Many people have some type of travel insurance that covers most or part of the cost associated with passing away in a foreign country. Some may even have a burial insurance. Others may have a health insurance that covers some level of expenses. (You should consider listing details on this as part of your Last Will.) Notice that there are many permanent travel insurance policies for which an annual policy is never received! The only proof is the annual payment of the premium. Also notice that many expats in Thailand may not qualify as they are a resident in Thailand (no longer registered in the Netherlands). Find out about this possible insurance and contact the insurer to learn what is covered. If you cannot do so right away, then keep the expenses at a moderate level and find out later by checking the papers of the deceased. Keep records of all payments and avoid cash payments without receipts! Repatriation of the body to the Netherlands is by far the most costly item. Some insurers cover such costs, often under the proviso that they are notified immediately of a death and they usually also determine which service companies must be used (undertaker, airline). Chapter 7. Last Will & execution of the Last Will Please note that all transactions that require the signature (or presence) of the deceased are no longer possible. That relates to the use of bank accounts and (free use of) property in the name of the deceased. This effect may seem obvious but it is often overlooked. As part of your efforts of making a Last Will, contact your Thai bank manager to see what arrangements can be made in advance to avoid that your Thai or other dependent(s) is/(are) without money. The release of possessions that are registered in the name of the deceased to the rightful heir(s) depends on whether or not a Last Will was made, and on the terms and conditions of the Last Will. This chapter will focus on a Thai Last Will. Without a Thai Last Will, Thai authorities (after a court decision, usually taking 3 months) will make decisions on all possessions that are in the name of the deceased, and this may cause problems for the remaining partner or dependents. Making a Last Will in Thailand is easy: a document in any language or in Thai, signed by yourself and 2 witnesses is all that is needed. It is best to use a Licensed Notary Public for this (see chapter 10). This 13

14 Notary Public will have standard examples and may help defining particular clauses. Also include what you want to have done with your body when you pass away. In any case you must appoint an executor of your estate (can be your partner). Always make sure that the name(s) in any document is (are) spelled correctly and in line with the name(s) as mentioned in the passport(s)! Mistakes are often made, and there may be complications when this simple rule is not followed. It is advisable to make a Last Will on the Last Living Partner = all possessions go to the remaining partner. This can either be for use only (for certain possessions) or for unconditional use. Consult with a Certified Notary Public on the process & procedures to get access to (or: use of) the estate. For a court review, the Last Will must be certified & translated into Thai. See chapter 10. A Last Will registered in the Netherlands can be used in Thailand. This requires a certified & legalized translation into English in the Netherlands, followed by a certified translation into Thai in Thailand. Always carry your name & address with you and that of a good friend in Thailand. Also make arrangements for bank accounts, PIN codes, keys, safe and so on. Store them with your partner or a reliable friend in a sealed envelope. The execution of the Last Will is the responsibility of the executor mentioned in the Last Will. Contact the Notary Public for the process that must be followed. Chapter 8. Formalities in the Netherlands The death of a Dutch citizen must be reported as soon as possible to various organizations, such as: The Civil Administration of the city of which the deceased was a resident. If the deceased is no longer registered in the Netherland (= emigrated to Thailand), go to the website of Gemeente Den Haag to download notification document: (the link mentions marriage certificate but the form is also used for the death certificate). Any questions: contact the Dutch embassy in Bangkok. Pension fund companies (private & state pension authority SVB), life insurance companies Medical insurance company Banks Tax authority (Internal Revenue Department) Former employer(s) Etc. Check the deceased s records (and wallet) to see if other organizations need to be informed. Make sure you have the deceased s civil service number ( burgerservicenummer ), needed for all correspondence. The best is to send such organizations a formal letter that includes the certified English translation of the Death Certificate. Where needed, add a copy of the (invalidated) passport. The Dutch Civil Administration may require that the Death Certificate already translated into English by a certified translator is legalized by the Thai Ministry of Foreign Affairs. If so, then go to the Consular Department of the Thai Ministry of Foreign Affairs, located at Chaeng Wattana Road in Bangkok. See chapter 10. Chapter 9: Summary of important documents 14

Make copies immediately as the passport will be invalidated by the Dutch Embassy by punching big holes in it that make reading impossible.
