14 Verordening 2009/125 De Commissie erkent dat, zo blijkt uit een vertrouwelijke nota. De helft van de beoogde energiebesparing tot 2020 is het gevolg van het ecodesignbeleid. Als dat beleid er niet was geweest, zou een gemiddeld huishouden nu jaarlijks 490 euro meer aan energie moeten betalen.

42 Toezicht / Handhaving Controle op naleving: Inspectie Leefomgeving en Transport (ILT) Ministerie van Infrastructuur en Milieu Rijksoverheid

43 Toezicht / Handhaving Sinds 2010 houdt de Inspectie Leefomgeving en Transport (ILT) toezicht op de verordeningen die van kracht zijn in het kader van Ecodesign. Dat betekent dat producenten of importeurs van producten die vallen onder deze verordeningen gecontroleerd kunnen worden om na te gaan of zij voldoen aan de gestelde eisen. Het bedrijfsbezoek bestaat uit het doorlopen van een algemene vragenlijst, het beoordelen van documenten en het meten van het energieverbruik van elektr(on)ische apparaten. Het meten gebeurt ter plekke of in een daartoe gespecialiseerd laboratorium. Om de effectiviteit van het toezicht te vergroten en om oneerlijke concurrentie op de EU-markt tegen te gaan, werkt de ILT samen met andere lidstaten. In ADCO verband wordt tussen de lidstaten samengewerkt en zijn verschillende activiteiten geïnitieerd waar ook de ILT haar bijdrage aan levert. Het ADCO is zo een belangrijk forum om samenwerking tussen de lidstaten te organiseren. De ILT participeert in activiteiten zoals het opzetten van uitwisselingsprogramma s, informatie campagnes, gezamenlijke controle programma s, enzovoort. Daarnaast is er een Ecopliant project opgezet. Hierin werken Denemarken, Finland, Duitsland, Hongarije, Ierland, Italië, Nederland, Spanje, Zweden en Groot-Brittannië samen. Het project heeft als doel uniforme werkwijzen voor markttoezicht Ecodesign te ontwikkelen en activiteiten tussen lidstaten op het vlak van toezicht te coördineren.

44 Harmonisatiewetten Basis EU wetgeving The 'Blue Guide' on the implementation of EU product rules 2014, European Commission PRODUCTEN DIE ONDER DE WETGEVING VALLEN Een product dat in belangrijke mate is gewijzigd of gereviseerd met het oog op het veranderen van zijn oorspronkelijke prestaties, doel of type kan eventueel als een nieuw product worden beschouwd. De persoon die de veranderingen uitvoert, wordt dan de fabrikant met de daarmee samenhangende verplichtingen 2.3. IN DE HANDEL BRENGEN Producten die op de markt worden aangeboden, moeten voldoen aan de toepasselijke harmonisatiewetgeving van de Unie op het ogenblik dat zij in de handel worden gebracht. Om een product in de handel te brengen, is een aanbod of een (schriftelijke of mondelinge) overeenkomst nodig tussen twee of meer natuurlijke of rechtspersonen voor de overdracht van bezit of enig ander eigendomsrecht met betrekking tot dat product. Deze overdracht kan tegen betaling zijn of gratis. Er hoeft geen fysieke overdracht van het product te zijn.

46 Product of Systeem? 1253/2014; Article 2; Definitions For the purposes of this Regulation the following definitions shall apply: (5) unidirectional ventilation unit (UVU/EVE) means a ventilation unit producing an air flow in one direction only, either from indoors to outdoors (exhaust) or from outdoors to indoors (supply), where the mechanically produced air flow is balanced by natural air supply or exhaust; (6) bidirectional ventilation unit (BVU/TVE) means a ventilation unit which produces an air flow between indoors and outdoors and is equipped with both exhaust and supply fans;

What if a customer buys one UVU for supply air from one supplier and another UVU for exhaust air from another supplier and combines/assembles them as they were a BVU. Ad 11) The preliminary answer from the Commission is as follows. The responsibility of the suppliers can only be for the products they supply (the UVUs, in this example); nevertheless, a further legal entity (e.g. installer) could be responsible for The putting into service of the BVU. Clarity will be provided on this point.

48 Product of Systeem? E117. Is it possible to install one UVU for supply and on UVU for exhaust in a building or part of a building? Answer: Yes. EU 1253/2014 is a product regulation. The product shall comply when placed on the market the first time. In consequence no product and no manufacturer knows, how the products will be combined in buildings and how they interact, if there is no mechanical design aspect, which has to be considered in the product design. In consequence, the following combinations of units shall be considered as a BVU: Two or more units combined with a RAC heat recovery system Two or more units directly (without building sided ductwork) connected with a mixing chamber. If two or more units in the meaning above are combined on site in the building by a third party (for example installer), a BVU (based on CE-marked UVU s) will be putted into service. This means the third party has to declare the product conformity as a BVU and CE mark.

Toevoer EVE + afvoer EVE = TVE Installateur stelt een TVE in gebruik; Installateur moet dan een CE conformiteitsverklaring opstellen. 1253/2014 kijkt naar systeem waarin product is opgenomen. ETA EHA Systeem voldoet niet aan vigerende wetgeving (ecodesign eisen) is ook niet volgens IOM in gebruikt gesteld is. Opdrachtgever/Huurder kan installateur/leverancier aansprakelijk stellen voor gevolgschade

IOM HHFlex; blz 4 par 1.2 tweerichtingsventilatie-eenheid (BVU): een ventilatie-eenheid die een luchtstroom van binnen naar buiten en omgekeerd produceert en met zowel afzuig- als aanzuigventilatoren is uitgerust. Ook de volgende combinaties moeten als een BVU worden beschouwd: Twee of meer units gecombineerd met een twin coil warmteterugwinsysteem Twee of meer units direct (zonder gebouwzijdig kanalenwerk) verbonden met een mengplenum. Als twee of meer units zoals hierboven beschreven ter plaatse in een gebouw door een derde partij (b.v. een installateur) worden gecombineerd tot één systeem, wordt feitelijk een BVU (gebaseerd op CE-gemarkeerde UVU s) in gebruik genomen. Dit houdt in dat de derde partij moet verklaren dat het product conform de geldende eisen voor een BVU, in gebruik is genomen en er voor moet zorgen dat het product CE gemarkeerd wordt.. ETA EHA

Fan means a rotary bladed machine that is used to maintain a continuous flow of gas, typically air, passing through it and whose work per unit mass does not exceed 25 kj/kg, and which: Housing means a casing around the impeller that guides the gas stream towards, through and from the impeller.

What is a housing in terms of Regulation 327/2011, and what is a casing in terms of Regulation 1253/2014 and Delegated Regulation 1254/2014? Regulation 1253/2014 shall not apply to ventilation units which are axial or centrifugal fans only equipped with a housing in terms of Regulation (EU) No. 327/2011, Article 1 (c). This implies, that such products are considered fans and shall be treated according to Regulation 327/2011. A working draft from CEN TC 156 WG 17 Fans Procedures and methods to determine the energy efficiency for the electrical input power range of 125 W up to 500 kw Complementary element describes the term housing in detail as a casing around the impeller that guides the gas stream towards, trough and from the impeller. The housing may include an inlet bell, an inlet guide vane, an outlet guide vane or an outlet diffuser. For examples of boundaries for different fan types (in line with the draft working document), see sketches (a) to (f) in Figure 3. A fan can be with or without housing. Protective guards are not included in the measurements of fans (are removed for testing). Ventilation units are by definition equipped with a casing, Article 2 (1), which, according to the above, is additional to the housing in terms of Regulation 327/2011. This implies the casing is defined as all parts of the ventilation unit additional to the housing that interfere with the airflow. For a ventilation unit including a fan without housing, there will only be the casing interfering with the airflow. Products that would normally be called box-fans or roof-fans are ventilation units. For examples of ventilation units within the scope of Regulation 1253/2014, see sketches (g) and (h) in Figure 3.

61 Werkpunt bij voorraadproducten? 20. How to declare a NRVU where the design point is not known at the time of placing the product on the market, e.g., in the case of mass-produced NRVUs? Mass-produced NVRUs are normally designed for a wide range of working points and are mostly produced in large quantities. Their capacity is generally given in ranges and they can optionally be used in different buildings and/or applications. Below we suggest an optional method on how to declare such products. Alternatively, the manufacturer can choose a specific working point and assess compliance with Regulation 1253/2014 with the standard approach, see question: What is it meant for nominal flow rate for NRVUs under Regulation 1253/2014? Clarification on toxic, highly corrosive or flammable or in environments with abrasive substances Isolatiekamers in ziekenhuizen Abrasion is the process of wearing away a surface by friction. If a particle can cause wear on a surface, depends on the hardness of the particle and of the surface material. Based on this approach, a stream of air contains abrasive particles, if the transported particles are harder than the typical materials the fans are made of. An abrasive application requires special solutions for fans like special linings for reducing the abrasion of the impeller material. This is generally necessary for more than 100 milligrams of dust with large particles of minimum 5 Mohs hardness per cubic meter of air. 68 FAQ 11 Recirculation 11. Are products designed for 100% recirculation considered ventilation units? If the product is not designed for replacing utilised air with outdoor air, it is not a ventilation unit, unless the same product is also designed to replace only utilised air, and thus it should comply with all relevant requirements of the ecodesign measure (bearing in mind the exclusions of scope of the Regulation itself).in case the product has a connection to the outdoor with a supply/exhaust air flowrate in regular operation of minimum 10% of the total declared recirculated air flowrate, the unit is considered a ventilation unit and falls under Regulation 1253/2014.

69 FAQ 12 Clean rooms 12. We manufacture ventilation equipment for cleanrooms. Cleanrooms can be found in hospitals, research centers, pharmaceutical and certain other manufacturing plants. The ventilation units used for clean rooms treat large volumes of air, with limited replacement of the treated air by new air. One objective is to ensure overpressure in the cleanrooms so that the level of pollutants (dust,microbes ) is kept at minimal or controlled. Are they within scope? As long as: 1. These products can be defined as ventilation units, in line with definition 1 of article2 of the Regulation 1253, i.e."an electricity driven appliance.intended to replace air by outdoor air in a building") 2. What is it meant for nominal flow rate for NRVUs under Regulation 1253/2014? At which conditions shall a manufacturer refer to? The nominal flow rate for NRVUs is the declared design flow rate, at the conditions laid down in definition 6 of Annex I, Part 2. Therefore, freedom is left to the manufacturer on how to determine more in detail such conditions, depending on the specific design choices (e.g, including or not a pressure reserve for clogging). 73 FAQ 10; Industriële toepassing 10. What is meant by to replace utilised air by outdoor air Article 2 (1) says ventilation unit (VU) means an electricity driven appliance equipped with at least one impeller, one motor and a casing and intended to replace utilised air by outdoor air in a building or a part of a building; In a building or part of a building designed for human occupancy, the purpose of the ventilation unit is to replace utilised air by outdoor air. In this respect, the utilised air is the polluted air due to the presence of human beings and their use of the building including emissions from materials, equipment, internal and external heat gains. The Regulation should not apply to a product intended to be used in a building or part of a building not designed for human occupancy or to a product that is not intended, as its primary function, to replace utilised air (as specified above), unless the same product is also designed to only replace utilised air (as specified above) and thus, should comply with all relevant requirements of the ecodesign measure (bearing in mind the exclusions of scope of the Regulation itself). An example of an application where the Regulation should not apply are Data centres.
