3 Additional comments In general there are stricter measures for the taking and possession of Annex A specimens (source W or F), primates, large felidae, hawks, rhino horns, tiger bones. Through European Regulations and Directives these restrictions apply to more species, such as The European Bird and Habitat Directive. It is only possible to keep hawks with source C if accompanied by DNA fingerprints and an exemption for prohibition of possession. By national law for Annex A specimens of all sources it is obligated to keep a register, this also applies to birds of Annex B without a seamless closed foot ring. Birds of Annex A need to be marked conform the national law on foot rings. Other vertebrates of Annex A need to be marked conform EU Regulations. 6 What were the results of any review or assessment of the effectiveness of CITES legislation, with regard to the following items? CITES). One concluded that overall CITES is adequately implemented. Outreach towards stakeholders and national networks could be further improved. Among others the following actions have been undertaken in 2008: The permit section has started a monthly CITES Newsletter, a compliance assessment for several types of trade has been undertaken and an intervention strategy is launched in order to stimulate information exchange between enforcement agencies and uniform risk/priority assessment. 7 If no review or assessment has taken place, is one planned for the next reporting period? Team IBG (Seizure of CITES goods) of the National Service for the Implementation of Regulations 5 Please provide details of any additional measures taken: Since 2007 the Customs and General Inspection Service organize a special course in Flora and Fauna and CITES. In 2007 the section of Administrative Law Enforcement, part of the National Service for the Implementation of Regulations, has started investigations on behalf of CITES. The Administrative Law Enforcement section is, on behalf of the Minister of Agriculture, Nature and Food quality, authorised to impose administrative measures on offenders. By this procedure the seizure or return of specimens to the country of origin can be organized on account of the offender. Administrative Law Enforcement also re examines denied applications of CITES certificates and permits to see if any legalisation is possible or that criminal investigations would be opportune. In case of small infractions the offender can merely be warned. The administrative law enforcement procedures often run parallel to the procedures of the Public Prosecutor of the Ministry of Justice. Since 2008 Administrative Law Enforcement and General Inspection Service (AID) investigate the compliance of CITES legislation by applicants of CITES documents. 10

Het doel hiervan is het bestand van Europese paling weer op peil te brengen. De hoeveelheid glasaal (jonge paling) is de afgelopen twintig jaar namelijk afgenomen tot 1% van het oorspronkelijke niveau. Daarnaast hebben de Europese visserijministers tijdens de Landbouw- en Visserijraad in Luxemburg een akkoord bereikt over een herstelplan voor de Europese paling. Op kunt u een aantal werkdocumenten over de aal terugvinden die gebruikt zijn tijdens de internationale CITESconferentie in Den Haag. Het gevolg is dat met ingang van 13 maart 2009 de Anguilla anguilla is opgenomen in Appendix II en in Bijlage B van CITES 1. Dit geldt ook voor delen of producten van de Europese paling. Als u paling wilt (weder)uitvoeren naar landen buiten de EG dan heeft u met ingang van 13 maart 2009 een CITES uitvoervergunning nodig. In het geval van invoer heeft u een CITES invoervergunning nodig. Momenteel wordt nog overlegd of er een uitvoerquotum zal worden vastgesteld. CITES invoervergunningen en (weder)uitvoervergunningen kunt u aanvragen bij het CITESbureau. Aanvraagformulieren kunt u terugvinden op onze internetsite: Kies voor het onderwerp vergunning en ontheffing en vervolgens voor CITES. De kosten voor een vergunning zijn 60 euro. Houdt u rekening met de aanvraagtijd. Na ontvangst van de complete aanvraag moeten wij binnen één maand een besluit nemen. Dit kan langer duren als wij derde partijen moeten raadplegen. 1 Een CITES-soort is een soort die is opgenomen in één van de Appendices/Bijlagen van CITES. Appendices zijn afkomstig uit het internationale CITES-Verdrag. In de EU zijn de CITES-soorten opgenomen in Bijlagen (Soortenlijst). Op de Soortenlijst kunt u zien in welke CITES Appendix en Bijlage een CITES-soort is opgenomen. De Soortenlijst is opgenomen in de Basisverordening (Verordening 338/97). De Soortenlijst wijzigt na iedere Conferentie der Partijen door middel van een wijzigingverordening. 21 Nieuwsbrief december 2008 Geldigheid van wetenschappelijke adviezen Als u een aanvraag indient voor een CITES invoervergunning of (weder)uitvoervergunning dan kan het voorkomen dat uw aanvraag wordt voorgelegd aan de CITES-Commissie voor een wetenschappelijk advies. Wij willen u eraan herinneren dat de wetenschappelijk adviezen voor soorten die zijn opgenomen in Bijlage B in principe vijf jaar geldig zijn, tenzij anders beschreven. In artikel 4, lid 2 onder a) van Verordening 338/97 (Basisverordening) staat dat een advies geldig blijft voor latere invoer zolang omstandigheden niet wijzigen. Wij zullen daarom adviezen die ouder zijn dan 5 jaar, opnieuw voorleggen aan de CITES-Commissie. Dit betekent dat het langer kan duren voordat een besluit wordt genomen op uw aanvraag. Ook als een quotum verandert, dan moet opnieuw advies gevraagd worden aan de CITES-Commissie. 22 NIEUWSBRIEF november 2008 Onderwerpen: Aanvragen indienen voor hybride dieren Brochure The illegal trade in wild birds for food Contactinformatie Aanvragen indienen voor hybride dieren Veel mensen lopen tegen een aantal praktische problemen aan bij het aanvragen van CITESdocumenten voor hybride dieren. Ten eerste wordt in het aanvraagformulier maar één CITES soortnaam 1 gevraagd. Ten tweede is het moeilijk vast te stellen in welke CITES Bijlage een hybride soort is opgenomen. Sommige hybriden zijn als zelfstandig soort opgenomen in de CITES Bijlagen. Andere soorten niet, hierbij moet u zelf de kruising aangeven. Aan de hand van een aantal praktijkvoorbeelden kunt u lezen hoe u in dergelijke gevallen uw aanvraagformulier moet invullen. Ter verduidelijking, een hybride soort is een kruising tussen meerdere diersoorten. Een kruising wordt tot en met de vierde generatie als hybride aangemerkt. Praktijkvoorbeelden EG-certificaat Hieronder vindt u drie praktijkvoorbeelden waarbij u zelf de kruising van de hybride soort moet aangeven. Hybriden van ongelijkwaardige ouders U wilt een aanvraag indienen voor een regenboog ara. Hoewel de regenboog ara niet vermeld staat in de Soortenlijst 2, wordt deze ara toch gezien als een soort van Appendix I en Bijlage A. De regenboog ara is een kruising tussen de geelvleugel ara (Ara macao), Appendix I/Bijlage A en de blauwgele ara (Ara ararauna), Appendix II/Bijlage B. Staat één van de ouderdieren op Bijlage A, dan wordt de hybride soort ook gezien als een soort van Bijlage A. U vult op het aanvraagformulier voor een EG-certificaat in vak 16 in: Ara macao. Vul in vak 17 de soortnaam geelvleugel ara in en vermeld in vak 4 de naam van de hybride soort regenboog ara en de kruising Ara macao x Ara ararauna. Hybriden van ongelijkwaardige ouders Het kan ook voorkomen dat beide ouders op dezelfde CITES Bijlage staan maar niet op dezelfde CITES Appendix staan. Bijvoorbeeld een kruising tussen een Appendix I/Bijlage A soort en een Appendix II/Bijlage A soort. In dit geval vult u in vak 16 en 17 de strengst beschermde soort in, in dit geval de soort van Appendix I/Bijlage A. 1 Een CITES-soort is een soort die is opgenomen in één van de Appendices/Bijlagen van CITES. Appendices zijn afkomstig uit het internationale CITES-Verdrag. In de EU zijn de CITES-soorten opgenomen in Bijlagen (Soortenlijst). De Bijlagen lijken veel op de Appendices maar wijken op een aantal punten af. Het kan dus voorkomen dat een CITES-soort in de EU op Bijlage A staat maar buiten de EU op Appendix II staat. 2 Op de Soortenlijst kunt u zien in welke CITES Appendix en Bijlage een CITES-soort is opgenomen. 23 Nieuwsbrief november 2008 Hybriden van gelijkwaardige ouders Een ander voorbeeld is de gier-slechtvalk. Dit is een kruising tussen de giervalk (Falco rusticolus), Appendix I/Bijlage A en de slechtvalk (Falco peregrinus), Appendix I/Bijlage A. Omdat beide ouders opgenomen zijn in Appendix I en Bijlage A dan wordt de hybride uiteraard ook gezien als een soort van Bijlage A. U vult op het aanvraagformulier in vak 16 de wetenschappelijk naam van één van de twee ouderdieren in. Vul in vak 17 ook de soortnaam van één van de twee ouderdieren in. Vermeld in vak 4 de naam van de hybride soort gier-slechtvalk en de kruising Falco rusticolus x Falco pereginus. Hierboven worden voorbeelden genoemd voor het invullen van aanvraagformulieren voor EGcertificaten. Deze werkwijze kunt u ook aanhouden bij het invullen van aanvraagformulieren voor in- en (weder)uitvoervergunningen. Als u een aanvraag indient voor een hybride soort dan kan het CITES-bureau nadere informatie vragen over de stamboom van de hybride soort. Regelgeving In de bijlage bij de Basisverordening (Soortenlijst) is het volgende opgenomen over hybride soorten: 10. Hybriden kunnen uitdrukkelijk in de bijlagen worden opgenomen, doch uitsluitend indien zij in de vrije natuur onderscheidbare, stabiele populaties vormen. Op hybride dieren die in de laatste vier vooroudergeneraties van de lijn één of meer specimens van enige in bijlage A of B opgenomen soort tellen, zijn de bepalingen van deze verordening van toepassing alsof zij tot die soort zelf behoorden, zelfs indien de betrokken hybride niet uitdrukkelijk in de bijlage(n) is opgenomen. Dit betekent dat een hybride gerekend moet worden tot de CITES-soort tot de vijfde generatie na het voor het laatst voorkomen van de CITES-soort in rechte lijn van de voorouders. De brochure is geschreven door TRAFFIC (wildlife trade monitoring network) en is financieel gesteund door het Ministerie van Landbouw, Natuur en Voedselkwaliteit. In Centraal en Zuid-Oost Europa worden honderden duizenden vogels illegaal gedood en geëxporteerd om vervolgens te dienen als delicatesse in restaurants in Noord Italië en Malta. Geschat wordt dat deze industrie een marktwaarde heeft van maar liefst 10 miljoen per jaar. Veel van deze illegaal gedode vogels zijn beschermd op internationaal, Europees en nationaal niveau zoals de Europese Vogelrichtlijn. Veel verhandelde vogels zijn onder andere de veldleeuwerik, de pieper, de kwartel, de snip, de patrijs, de zomertortel, de grasmus en de lijster. 26 NIEUWSBRIEF oktober 2008 Onderwerpen: Export van veel-gekweekte CITES planten Veel gestelde vraag over CITES Contactinformatie Export van veel-gekweekte CITES planten De invoer en (weder)uitvoer van bedreigde plantensoorten is alleen mogelijk met een CITESinvoervergunning of (weder)uitvoervergunning. Het CITES-bureau geeft deze vergunningen af. Echter, voor een aantal plantensoorten die veel gekweekt worden, is voor uitvoer van Nederland naar landen buiten de Europese Unie geen uitvoervergunning nodig. Wel is dan een CITESbijschrijving op het fytosanitaire certificaat vereist. Het fytosanitaire certificaat met deze bijschrijving geldt dan als CITES-uitvoervergunning. Voor welke soorten kan het fytosanitaire certificaat als CITES-uitvoervergunning dienen? CITES-bijschrijvingen op fytosanitaire certificaten worden gedaan door keuringsdiensten. De keuringsdiensten kunnen een CITES-bijschrijving op het fytosanitaire certificaat afgeven bij export van in de EU kunstmatig gekweekte planten van de volgende families: CACTACEAE CYCADACEAE EUPHORBIACEAE LILIACEAE NEPENTHACEAE ORCHIDACEAE SARRACENIACEAE alle soorten opgenomen in Bijlage II van CITES alleen Cycas revoluta alle succulente soorten opgenomen in Bijlage II van CITES alle soorten opgenomen in Bijlage II van CITES alle soorten opgenomen in Bijlage II van CITES alle soorten opgenomen in Bijlage II van CITES en Paphiopedilum hybriden alle soorten opgenomen in Bijlage II van CITES Controleer zelf het fytosanitaire certificaat Contoleer altijd of de keuringsdienst een correcte CITES-bijschrijving heeft gemaakt. Op het fytosanitaire certificaat moet altijd de door CITES erkende, wetenschappelijke naam vermeld staan, in principe met geslacht en soortnaam. Is dit niet (correct) gebeurd en ontstaan daardoor problemen, dan komen deze voor rekening van de exporteur. Planten die u opkweekt uit materiaal dat eerder in de EU is geïmporteerd hebben geen herkomst uit de EU en kunnen dus niet met een fytosanitair certificaat worden uitgevoerd. U moet dan een wederuitvoervergunning aanvragen bij het CITES-bureau. Er geldt een uitzondering voor plantensoorten waarvoor in Verordening 318/2008 de annotatie #1 staat vermeld: In vitro zaailing- en weefselculturen op een vaste of vloeibare voedingsbodem die in steriele recipiënten worden getransporteerd. Verschil in internationale en Europese regelgeving Onlangs is duidelijk geworden dat er een verschil is tussen de internationale en Europese regelgeving betreft het gebruik van fytosanitaire certificaten. Volgens Europese regelgeving moeten de gekweekte planten hun herkomst uit de EU hebben. Echter, volgens de internationale regelgeving mogen alleen fytosanitaire certificaten afgegeven worden door het land waar de planten ook hun herkomst hebben.

27 Nieuwsbrief oktober 2008 Europese regelgeving: Verordening 865/2006 artikel 17, lid 1a): de lidstaten mogen bepalen dat een fytosanitair certificaat wordt afgegeven in plaats van een uitvoervergunning. Hiermee wordt bedoeld dat uitvoervergunningen en dus ook fytosanitaire certificaten in de EU mogen worden afgegeven voor soorten die in de EU zijn gekweekt. Internationale regelgeving: Resolution Conf (Rev. CoP14): c) phytosanitary certificates be used exclusively for the purpose of export from the country of artificial propagation of the specimens concerned. Praktijkvoorbeeld: U wilt CITES planten met herkomst uit Spanje via Nederland met een Nederlands fytosanitair certificaat uitvoeren naar Zwitserland. Volgens Europese regelgeving is het gewoon mogelijk deze planten met een Nederlands fytosanitair certificaat naar Zwitserland uit te voeren. Maar omdat Zwitserland een derde land (land buiten de EU) is mag zij zich beroepen op het internationale recht. Het kan dus voorkomen dat de zending wordt vastgehouden door het derde land omdat het fytosanitaire certificaat niet afgegeven is door het land van herkomst. Aanbeveling Als u planten wilt uitvoeren die in een andere lidstaat zijn gekweekt, raden wij u aan eerst navraag te doen in het land van bestemming over de CITES-regelgeving in dat land. Mocht het toch gebeuren dat uw zending door de douane van een derde land wordt vastgehouden, neem dan contact op met het CITES-bureau. 29 NIEUWSBRIEF augustus 2008 Onderwerpen: Nieuwe Schorsingsverordening Toestemming vragen voor het chippen van CITES-vogels Verbeterde bereikbaarheid van het CITES-bureau Nieuwe Schorsingsverordening Met ingang van 3 september 2008 is de nieuwe schorsingsverordening van kracht (Verordening (EG) nr. 811/2008). De oude schorsingsverordening (Verordening (EG) nr. 1037/2007) komt hiermee te vervallen. In de schorsingsverordening vindt u een lijst van soorten waarvan het niet is toegestaan om deze binnen te brengen in de Europese Gemeenschap. Deze lijst is gewijzigd op basis van informatie van de wetenschappelijke studiegroep. Alle landen van herkomst waarop de schorsingsverordening betrekking heeft, zijn geraadpleegd. Er is een groot aantal soorten toegevoegd aan de nieuwe schorsingsverordening. Een overzicht van de toegevoegde soorten vindt u in de bijlage bij de deze nieuwsbrief. Of de schorsing alleen geldt voor wilde of ook voor ranching of gefokte specimens kunt u in de schorsingsverordening zelf terugvinden. Toestemming vragen voor het chippen van CITES-vogels Een naadloos gesloten pootring is in principe vereist voor: alle vogels die behoren tot een inheemse soort, dat wil zeggen vogels die van nature op het Europese grondgebied van de Lidstaten van de Europese Gemeenschap voorkomen. alle niet-inheemse vogels die zijn opgenomen in Bijlage A van Verordening 1332/2005. Het kan voorkomen dat een vogel niet (meer) voorzien is van een naadloos gesloten pootring. In het algemeen geldt dat eerst toestemming gevraagd moet worden aan het CITES-bureau om een vogel te chippen terwijl een naadloos gesloten pootring vereist is. Na toestemming mag de vogel dan voorzien worden van een microchiptransponder. Vanuit de praktijk hebben wij echter begrepen dat het, vanuit het oogpunt van dierenwelzijn, niet altijd mogelijk is om eerst toestemming te vragen. Voor alle duidelijkheid vindt u hieronder de juiste werkwijze in zo n situatie. Is het niet mogelijk/wenselijk vanuit dierenwelzijn om eerst toestemming te vragen aan het CITES-bureau dan moet u, zodra u de mogelijkheid heeft, alsnog melden aan het CITESbureau dat u de vogel gechipt heeft.
