7 Welzijn: Algemeen Europa Grenswaarden versus REACH: darft opinion Protection of workers' health from risks arising from exposure to chemicals at the workplace: EU Occupational Exposure Limit Values under OSH and limit values under other EU legislation. EU legislation under the Chemical Agents Directive (98/24/EC) and the Carcinogens and Mutagens Directive (2004/37/EC) defines occupational exposure limit values (OELs) for chemicals. Such limit values are set via a well-established process involving Scientific Committee on Occupational Exposure Limits (SCOEL), governmental, employers and workers representatives. In order to respect the consistency and coherence of EU legislation and taking note of REACH Article 2.4 (a) which stipulates that REACH is without prejudice to EU workplace legislation, the ACSH is of the opinion that it is unacceptable for limit values, that are relevant to occupational exposure, to be set in the context of other EU legislation.

8 Welzijn: Algemeen Europa Grenswaarden versus REACH: darft opinion EU Occupational Safety and Health (OSH) legislation foresees the involvement of expert scientific evaluation, following a defined methodology and including external consultation via national contact points and the social partners in line with article 152 of the Treaty on the Functioning of the EU. The resultant SCOEL Recommendations are discussed in the tri-partite ACSH which adopts Opinions on proposals for OELs. This procedure is scientifically based and follows an open and inclusive consultation and discussion with all relevant stakeholders. Thereafter, the Commission initiates the relevant legislative procedure.

9 Welzijn: Algemeen Europa Aanpassing richtlijn Carcinogene agentia: Proposal of the Commission on the amendment of Directive 2004/37/EC on carcinogens and mutagens, OJ L 229, (1) Rubber process fume and dust (2) 1,3 Butadiene: An 8h TWA of 1 ppm (= 2,25 mg/m3) is proposed. No STEL (short time exposure limit) or skin notation was considered necessary. (3) Bromoethylene / Vinyl bromide: An 8h TWA of 1 ppm (= 4.37 mg/m3) is proposed following the SCOEL recommendation for vinyl chloride, the carcinogenic effect of which are similar to vinyl bromide.

MOCA is a genotoxic carcinogen without an identifiable threshold limit for health effects and it has a high potential for dermal absorption. Therefore a biological limit value is considered to be the best available option. The numerical value of 5 umol total MOCA in urine/ mol creatinine for a possible binding biological OEL is acceptable provided a suitable analytical method is available.

According to the SCOEL recommendation for the substance, a skin notation is warrented. (6) 1,2-Epoxypropane: An 8h TWA of 1 ppm (= 2.41 mg/m3) is proposed, which corresponds to the value also proposed by SCOEL in its recommendation (Nevertheless, a potential for higher exposures does remain during maintenance and loading operations. In these cases, 1 ppm threshold can only be achieved with breathing personal protective equipment)

(8) Hexachlorobenzene No OEL is proposed due to the fact that the substance has already been prohibited globally under the Stockholm Convention and the Protocol on Persistent Organic Pollutants unter the UN Convention on Long-Range Transboundary Air Pollution.

13 Welzijn: Algemeen Europa Aanpassing richtlijn Carcinogene agentia: Proposal of the Commission on the amendment of Directive 2004/37/EC on carcinogens and mutagens, OJ L 229, (9) 1,2-Dichloroethane : An 8h TWA of 2 ppm (= 8.14 mg/m3) is proposed. However it should be recognized that there is a lack of robust and up to date scientific data (especially concerning the mode of action). For technical reasons, a 2 ppm OEL may be difficult to achieve for some activities, especially in the case of multipurpose facilities using the substance in batch processes not operating continuously. Additional time may be requested for implementing the OEL at 2 ppm.

14 Welzijn: Arbeidsongevallen Alles samen werden er in de privésector in België arbeidsongevallen (op de arbeidsplaats en op de weg naar en van het werk) geregistreerd. Dat komt overeen met een daling van 7,7 % in vergelijking met En dat terwijl de tewerkstelling gelijkgebleven is. Vooral het aantal arbeidsongevallen op de arbeidsplaats ( ) is gedaald (-8,6 %). De daling van het aantal ongevallen op de weg naar en van het werk (22 013) is minder sterk (-1,5 %).

22 Welzijn: Wetgeving in voorbereiding Financiëring externe diensten Dit project kadert in het eenheidsstatuut tussen arbeiders en bedienden (vooropzeg & carenzdag). De nieuwe tarieven zijn voor het gezondheidstoezicht en het risicobeheer in het kader van de prestaties van de externe diensten. De forfaitaire bijdragen worden onderverdeeld in twee niveau s in functie van de aard van de activiteiten. Het laagste niveau wordt voorzien voor werkgevers die maximaal 5 werknemers hebben.
